BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
5 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1.
The Mayor of the City of San Bernardino is
7 hereby authorized and directed to execute on behalf of said City
8 a contract with the County of San Bernardino relating to the
9 City's utilization of minors in the Juvenile Work Program, a copy
10 of which is attached hereto as Exhibi t "A" and incorporated
11 herein by reference as fully as though set forth at length.

WHEREAS, COUNTY, through the Probation Department, is authorized to conduct the
Juvenile Work Program, hereinafter referred to as "JWP", and
WHEREAS, COUNTY requires written contracts with the organizations utilizing JWP
services.
NOW, THEREFORE, FOR AND IN CONSIDERATION OF THE MUTUAL PROMISES, COVENANTS AND
CONDITIONS HEREIN CONTAINED, THE PARTIES HERETO AGREE AS FOLLOWS:

CONTRACTOR agrees that there will be no publicity concerning this program without
the express written permission of the COUNTY. The names of the minors involved in this

In consideration of the above, CONTRACTOR agrees to reimburse the COUNTY the sum
of $350 per day per work crew upon presentation to CONTRACTOR of a certified claim, said
claim to be paid within thirty (30) days after presentation; provided, however, that when
the crew size as defined in paragraph IA falls below ten probationers, the per-diem rate of
$350 per work crew shall be reduced pro-rata on the basis of a ten percent reduction in the
per-diem rate per crew for each probationer by which the crew falls short of ten persons. Tbtal

AFFIRMATIVE ACTION COMPLIANCE GUIDELINES FOR NONCONSTRUCTION CONTRACTORS
These Compliance Guidelines have been designed to provide the
San Bernardino County Personnel Division Contract Compliance
Office with information pertaining to the nonconstruction
contractor's work force. It is the intent of this program to
guarantee that equal opportunity for employment is practiced
by the contractor without regard to race, age, color, sex,
religion, ancestry, national origin, marital status, or handicap.
CONTRACTORS FOR SERVICES AND SUPPLIES ARE
URGED TO CONTACT THE CONTRACT COMPLIANCE
OFFICE, 157 WEST FIFTH STREET, SAN BERNARDINO,
CA 92415, PHONE (714) 383-2364, FOR ANY NECESSARY
TECHNICAL ASSISTANCE IN COMPLYING WITH THIS
PROGRAM IF THEY ARE CONSIDERING DOING BUSINESS
WITH THE COUNTY. The complete text of the Affirmative
Action Compliance Program is available upon request in the
Contract Compliance Office.
I. SAN BERNARDINO COUNTY AFFIRMATIVE ACTION
COMPLIANCE POLICY
The County has adopted an Affirmative Action policy
which embodies the following principles:
A. Discrimination because of race, color, age, sex, religion,
ancestry, national origin, marital status, or handicapped
status is inconsistent with the constitution, laws, and
policies of the United States, State of California and
County of San Bernardino.
B. The County of San Bernardino is committed to
insuring that there be no discrimination by vendors,
contractors (including professional services and con-
sultants), lessors, or lessees doing business with the County.
II. REOUIREMENTS OF AFFIRMATIVE ACTION COM-
PLIANCE PROGRAM
A. On July 5, 1977, the San Bernardino County Board of
Supervisors adopted a contract Compliance Program. This
Program, as amended on September 5, 1978, requires that
all contractors and vendors who are submitting to the
County a bid or offer on a nonconstruction contract, or
who receive business of the County, must have a "Contract
Compliance Qualifying Report for Nonconstruction
Contractors and Vendors" on file with the County, prior to
the award of such contract or business.
B. All reports will be kept on file in the Contract
Compliance Office for a period of one year and shall be
updated by the contractor at least annually, or upon
request of the Contract Compliance Officer.
In addition to the "Contract Compliance Qualifying
Report for Nonconstruction Contractors and Vendors," the
contractor or vendor may be requested to submit to the
Contract Compliance Office additional information con-
cerning the contractor's affirmative action programs and
policies.
C. The following persons/contracts (as defined by the
Con tr act Com pi iance Office/Personnol Division) shall be
exempt from this program:
1. Sole source.
2. Emergency requisitions.
3. Contracts and leases which have been executed by
the contractor prior to October 1, 1978.
4. Churches.
Any contractor who feels qualified for an exemption
should contact the Contract Compliance Office for
verification.
III. DEFINITIONS
Unless a provision of a contract otherwise requires, certain
words and phrases shall be defined as follows:
A. "Affirmative Action" is a commitment to increase the
number of members of protected classes in the work force
by setting employment goals and timetables, including
action programs to achieve objectives through reform of the
system. Affirmative Action seeks to ensure that discrim-
ination is eliminated in all dealings' with employees or
applicants for employment whether the discrimination is
intentional or unintentional. In addition, Affirmative
Action seeks to improve job standards and productivity
through the removal of artificial and unnecessary barriers to
employment and promotion and ensure that all job actions
are related to job performance measures.
B. "Construction Contract" means a contract which calls
for the construction, rehabilitation, alteration, conversion,
extension, demolition or repair of buildings, highways or
other changes or improvements providing utility services.
C. "Contract" means a purchase order, offer and
acceptance, lease, agreement or other arrangement creating
. an obligation to which the County is a party, which would
make one of the parties within the definition a contractor.
D. "Contractor" means all persons (including suppliers.
consultants, vendors, lessors and lessees) who provide, or
offer to provide to the County, property, labor, equipment,
materials, or services of any kind or type pursuant to a
nonconstruction contract with the County.
E. "County" means the County of San Bernardino. and
includes those special districts for which the Board of
Supervisors of San Bernardino County acts as the governing
body.
F. "Emergency" contracts or leases are those which
require immediate approval by the County due to
unforeseen circumstances or by the resulting state thereof,
as determined by the COUNTY ADMINISTRATIVE
OFF ICE R (CAO) or Purchasing Department.
G. "Employee" means one who performs work for
compensation. For purposes of calculating numbers of
employees, a person who works 40 hours per week is

considered one employee. Part-time workers are to be
counted as fractional employees based upon the number of
hours worked per week. Therefore, one who works
half.time (20 hours a week) is to be counted as 1/2
employee.
H. "Handicapped Status" means any person who:
1. Has a physical or mental impairment which sub-
stantially limits one or more of such person's major life
activities.
2. Has a record of such impairment, or,
3. Is generally regarded as having such an impairment.
I. "Minorities" means members of the following racial or
ethnic groups: Black (not of Hispanic origin); Hispanic;
Asian or Pacific Islander; American Indian or Alaskan
native.
J. "Nonconstruction Contract" means any contract
which does not fall within the definition of "Construction
Contract."

K. "Officer" means the Contract Compliance Officer, who
is the County Administrative Officer, County of San
Bernardino, or his designated agents.
L. "Program" means the Affirmative Action Compliance
Program for County vendors and contractors.
M. "Sole Source" means a contract or lease in which the
Non-County party is in a unique position to fulfill the
County's needs.
N. "Vietnam-Era Veteran" means a'person who:
1. Served on active duty for a period of more than
180 days, any part of which c-ccurred between
August 5, 1964, and May 7, 1975, and was discharged
or released therefrom with other than a dishonorable
discharge, or
2. Was discharged or released from active duty for a
service-connected disability if any part of such active
duty was performed between August 5, 1964, and
May 7, 1965.
0.. "Women" means female members of racial and ethnic
minority and nonminority groups. .

INSTRUCTIONS FOR COMPLETING CONTRACT COMPLIANCE
QUALIFYING REPORT (SECTION B)
I.
JOB CATEGORY
Data is to be completed for all listed job categories of employees.
Definitions:
Administrators: Occupations which require that employees set
broad policies, exercise overall responsibility for execution of these
policies, direct individual departments or a special phase of the
contractor's operations, or provide specialized consultation on a
regional, district or area basis.
Includes: directors. deputy directors, department heads,
COntrollers. foremen, supervisors, inspectors, and kindred workers.
Professional: Occupations which require specialized and
theoretical knowledge which is usually acquired through college
training or through work experience and other training which
provides comparable knowledge.
Includes: personnel and labor relations workers, social workers,
doctors, psychologists, registered nurses, economists, dieticians.
lawyers, system analysts, accountants, engineers, employment and
vocational rehabilitation counselors, teachers or instructors, and
kindred workers.
Technical: Occupations which require a combination of basic
scientific or technical knowledge and manual skill which can be
obtamed through specialized post.secondary school education or
through equivalent on.the-job traming.
Includes: computer programmers and operators, draftsmen,
surveyors, licensed practical nurses. photographers. radio operators,
technical illustrators, highway technicians, technicians (medical,
dental, electronic. physical sciences), assessors, inspectors, and
kindred workers.
Sales: Occupations in which the act of selling takes place;
exchange of property of any kind, or of servICes for an agreed sum
of money or other valuable consideration. One employed as a
traveling agent or representative to sell goods or services.
Office and Clerical: Occupations in which workers are
responsible for internal and external communication, recording and
retrieval of data and/or information and other paperwork required
in an office.
Includes: bookkeepers, secretanes, office machine operators,
clerk typists. stenographers, statistical clerks, dispatchers, payroll
Clerks, messengers, and kindred workers.
Skilled: Occupations in which workers perform jobs which
require special manual skill, a thorough and comprehensive
knowledge of the processes involved in the work which is aCQUired
through on.the-job training, experience, through apprenticeship or
other formal training programs.
Includes: mechanics and repairmen. electricians, heavy
equipment operators, stationary engineers. skilled machinist
occupations, carpenters, and compositors and typeseners, and
kindred workers.
Operative (Semiskilled): Occupations in which workers are
partly skilled, or doing manual work that requires only limited
traming, experience or knowledge.
Laborers (Unskilled): Occupations in which a worker performs
a variety of manual work in the maintenance, repair and
construction of highways, buildings, and other facilities: an
unskilled worker who brings materials to, and does preparatory
work for, skilled workers in a trade,
Service Work.rs: Occupations in which workers perform duties
which result in or contribute to the comfon, convenience, upkeep
and care of buildings, facilities or grounds of public property.
Workers in this group may operate machinery.
I ncludes: chauffeurs, laundry and dry cleaning operatives,
truck drivers, bus driv.rs, garage laborers, custodial personnel.
gardeners and groundkeepers, refuse collectors, constructIOn
laborers.
II. CURRENT WORK FORCE
This category is to establish the contractor's current employment
status.
A. Total number of employees: The contractor is to fill out the
total number of persons currently employed in each job category.
B. Black: The contractor is to place the current number of Black
employees in each, box in this column for each jOb clrtegory.
C. Hispanic: The' contractor is to place the current number of
emplovees of Hispanic origlO in each box in this column for each
jOb category.
O. Asian or Pacific Islanders: The contractor is to place the
current number of employees of Asian or Pacific Island origm in
each box in this column for each job categorv.
E. American Indian or Alaskan Native: The contractor is to place
the current number of American Indian or Alaskan Native
employees in each box in this column for each jab category.
F. Total Minority: The number to be placed in each box in thiS
column can be reached by adding the curr.nt numbers of Black.
