As I told you on the phone, there is a further complication to the encroachment problem which I discussed with the Board two years ago. I also had follow-up conversations by telephone and written corre~pondence with several people at Pacific Savings Headquarters in Costa Mesa. They failed to respond to our letters so we have just placed the matter on hold knowing that future sale of the property would cause the encroachment problem to be resolved at that time. The problem to which I refer is one that we encountered when we cut doors and windows on to the former Miles property from our current building. We were informed, after an inspection by the Fire Department, that doors and/or windows which open on to a property line require a 10 foot non-buildable easement as per San Bernardino City Fire Code. Since there are both doors and windows on the eastern end of the Pacific Savings Building, that same fire code applies to the building and adds 10 feet to the encroachment for the nonbuildable easement along the full eastern width of the building. The Board did discuss the problem and did discuss the fact that we are willing to sell enough property to provide the easement on the condition that the ease- ment language provide access over it to our district. I am sure the Board will be happy to discuss terms and conditions with you or through their agent to resolve this problem. The only alternative I can see is to move the building or remove 10 feet of the eastern end of the building and that does not appear to be an acceptable alternative. t"J114 /l/~~d c::...c</M? wr ''1JI ..
