05-20-91 -- Plans approved and authorization granted to advertise
for bids.

STAFF REPORT
Bids for this project were opened at 2:00 p.m. on July 2,
1991.
A total of 9 bids were received, ranging from $51,281.90
to $66,510.00. The low bid of $51,281.90 is 18.4% under the
Engineer's Estimate of $62,840.00.
Below is the total estimated project cost, based upon the
actual low bid price:

Curb and gutter, and paving will be constructed on the
south side of 40th Street, between Third Avenue and Cottage
Lane. Plans are being developed for 40th Street to Electric
Avenue. However, acquisition of right of way, undergrounding of
utilities and other factors will delay full improvements a
minimum of one year. However, the south side wi thin these
limits can be developed now and provide two east-bound traffic
lanes into the community center.
An amount of $75,000 was allocated in the 1990/91 Traffic
Systems Fee Budget, under Account No. 250-670-57428. The
transfer of an additional amount of $21,500 was approved on 5-
20-91, for a total allocation of $96,500.
Staff recommends adoption of the resolution awarding a
contract to the low bidder.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO BOB BRITTON, INC. FOR WIDENING OF FORTIETH STREET,
BETWEEN THIRD AVENUE AND COTTAGE DRIVE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Bob Britton, Inc. is the lowest responsible
bidder for: Widening of Fortieth Street, between Third Avenue
and Cottage Drive, in accordance with Plan No. 8433. A contract
is awarded to said bidder accordingly for the total amount of
$51,281. 00, but such award shall be effective only upon the
contract being fully executed by the parties. All other bids,
therefore, are hereby rejected. The Mayor is hereby authorized
and directed to execute said contract on behalf of the City; a
copy of the contract is on file in the office of the City Clerk
and incorporated herein by reference as fully as though set forth
at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.
