HomeMy WebLinkAbout1989-162 10 11 12 1 RESOLUTION NO. 89-162 2 3 RESOLUTION OF THE CITY OF SAN BERNARDINO ADOPTING POLICY IMPLEMENTING DRUG FREE WORKPLACE ACT OF 1988. 4 WHEREAS, the Drug Free Workplace Act of 1988 (PL100-690) 5 6 requires the city of San Bernardino to certify the City will provide a drug-free workplace before the City can obtain 7 8 federal contracts of $25,000 or more; and WHEREAS, the city is a recipient of said federal con- 9 tracts; NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO that the attached policy 13 tion, is adopted effective June 6, 1989. The unlawful manufacture, distribution, dispensation, 4 possession, or use of a controlled substance without a 5 6 prescription while at work is prohibited. As a condition of employment, each city employee is required to abide by 7 8 9 this statement. In addition, any employee who is convicted of any "criminal drug statute" occurring in the workplace is required to notify the Director of Personnel 10 no later than 5 days after such conviction. Any employee 11 who violates these requirements shall be subject to 12 disciplinary action up to and including dismissal in 13 accordance with city policy governing disciplinary 14 action. 15 16 2. Drug abuse in the workplace may lead to serious safety 17 concerns for the abuser, fellow employees, and the 18 general public being served by the abuser. Specifically, 19 drug users may be causing irreparable damage to their 20 bodies which can lead to serious illness and even death; 21 and, endangering the lives and property of others because 22 of their impaired mental and physical condition. 23 24 3. The City of San Bernardino has established this policy 25 of maintaining a drug-free workplace. The City contracts with "The Counseling Team" to provide a comprehensive employee assistance and counseling program. The Counseling Program is designed to help employees and their family members find direction in solving personal or emotional problems. Drugs and alcohol are two problem areas in which "The Counseling Team" provides assistance. All employees are encouraged to contact one of their trained counselors when faced with such personal problems. Their confidential telephone number is (714) 884-0133. The supervisor of an employee using this service will not be notified unless requested by the employee. 4/25/89 GRJ: j r
