RESOLUTION OF THE CITY OF SAN BERNARDINO -AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH THE INLAND EMPIRE SYMPHONY
ASSOCIATION THE PROMOTION OF ARTS AND CULTURE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
The Mayor of the City of San Bernardino is
hereby authorized and directed to execute on behalf of said City
an Agreement with the Inland Empire Symphony Association a copy
of which is attached hereto, marked Exhibit "A" and incorporated
herein by reference as fully as though set forth at length.
SECTION 2.
The authorization to execute the above-
referenced agreement is rescinded if the parties to the agreement
fail to execute them within sixty (60) days of the passage of
this resolution.

AGREEMENT
Fine Arts Fundinq
THIS AGREEMENT is entered into between the CITY
OF SAN BERNARDINO, a municipal corporation, referred to
as "City", and the Inland Empire Symphony Association a
non-profit organization, referred to as
"Organization".
The parties agree as follows:
1. Recitals.
A. Organization has requested financial
assistance from City for the fiscal year 1988-89, in
order to assist in defraying the expense of certain
concerts, shows, festivals or events or activities
sponsored by Organization as set forth in Organi-
zation's grant proposal (hereinafter "the proposal")
approved by the Fine Arts Commission of the City, a
copy of which proposal is on file in the Office of
Cultural Affairs. The terms of the proposal are
incorporated herein by reference and shall govern the
uses of the funds provided herein. The financial
assistance provided for in this agreement is made on a
one-time only basis, and receipt of said funds shall
not imply a continuing obligation of the City beyond
the terms of this Agreement.
B. The expenditure is for a valid munici-
pal pUblic purpose, to wit: for the promotion of music
appreciation in San Bernardino, as more fully set forth
in the proposal submitted by Organization.
2. Pavment. Upon presentation of a claim to

the City Finance Director, City shall pay to Organiza-
tion from the budget for the 1988-89 fiscal year, the
total sum of fifty thousand dollars, to cover the costs
per the Fine Arts grant application agreement.
3.
Use of Funds. The funds paid to Organi-
zation shall be used solely for the purposes set forth
in Paragraph 1 and in strict compliance with the
provisions set forth in the proposal. No deviation
from the proposal shall be made without the express
approval of the City of San Bernardino. Said funds
shall be expended by June 30, 1989 and any unexpended
funds shall be returned to City by Organization.
4. Accountinq. At such time or times as may
be requested by the City Administrator or Director of
Finance of City, Organization shall submit to the City
Administrator, with a copy to the Director of Finance
and the San Bernardino Fine Arts Commission, an
accounting of the proposed and actual expenditures of
all revenues accruing to the Organization for the
fiscal year ending June 30, 1989. Financial records
shall be maintained in accordance with generally
accepted accounting principles by Organization in such
a manner as to permit City to easily trace the expendi-
tures of the funds. All books and records of
Organization are to be kept open for inspection at any
time during the business day by the City or its
officers or agents.
5. Hold Harmless. Organization covenants and

agrees to indemnify and hold harmless the City and its
employees and agents from all liabilities and charges,
expenses (including counsel fees), suits or losses
however occurring, or damages arising or growing out of
the use or receipt of the funds paid hereunder and all
operations under this agreement. Payments hereunder
are made with the understanding that the City is not
involved in the performance of services or other activ-
ities of Organization. Organization and its employees
and agents are independent contractors and are not
employees or agents of the City in performing said
services.
6. Termination. City shall have the right to
terminate this Agreement and any funding remaining un-
paid hereunder for any reason by mailing a ten-day
written notice to Organization and this agreement shall
terminate ten days after the mailing of such notice. In
the event this Agreement is terminated for reasons of
improper use of funds or use of funds for any purpose
other than those authorized, any unexpended portion of
the funds provided by City shall be returned to City.
In addition, Organization shall reimburse to City any
funds expended which were used for any purposes other
than those authorized under this Agreement.
7. Assiqnment. Organization shall not assign
its interest in this Agreement without the prior
written approval of City.
8. Insurance. Organization shall take out

and maintain during the life of this Agreement such
public liability and property damage insurance as shall
insure City, its elective and appointive boards,
commissions, officers, agents and employees, permittee
and its agents performing acts covered by this
Agreement from claims for damages for personal injury,
including death, as well as from claims for property
damage which may arise from Organization's or its
agents' operations hereunder, whether such operations
be by Organization or its agents or by anyone directly
or indirectly employed by either Organization or its
agents, and the amounts of such insurance shall be as
follows:
(a) Public Liability Insurance. In an
amount not less than $100,000 for injuries, including,
but not limited to, death, to anyone person and,
subject to the same limit for each person, in an amount
not less than $100,000 on account of anyone
occurrence;
(b) Property Damage Insurance. In an
amount of not less than $50,000 for damage to the
property of each person on account of anyone occur-
rence.
City shall be set forth as an additional
named insured in each policy of insurance provided
hereunder.
9. Organization hereby convenants that it has
taken all actions necessary to make the adherence to
the obligations imposed by this agreement a binding

11. Entire Aqreement. This Agreement and any
documents or instruments attached hereto or referred to
herein integrate all terms and conditions mentioned
herein or incidental hereto, and supersede all negotia-
tions and prior writing in respect to the subject
15 matter hereof. In the event of conflict between the
16 terms, conditions or provisions of this Agreement, and
17 any such document or instrument, the terms and condi-
18 tions of this Agreement shall prevail.

Dear Mrs. Press and Members of the Fine Arts Commission:
In its relatively short 28-year history, the Inland Empire Sym-
phony has grown from a small community orchestra serving a
limited audience to a regional orchestra serving large enthusias-
tic audiences throughout the County of San Bernardino. within
the City of San Bernardino, where the majority of its programs
are staged, the Inland Empire Symphony has become the foundation
for both opera and ballet, as well as music education through a
cooperative program involving the San Bernardino Unified School
District. Additionally, the Inland Empire Symphony serves as
supporting orchestra to eight major performing arts organizations
throughout the State of California. This growth would not have
been possible without the support of the numerous organizations,
businesses, and individuals that, fortunately, recognized the im-
portance of the fine arts in the development of the total com-
mun"lty.
We are extremely appreciative of the past support provided by the
Fine Arts Commission of San Bernardino and we look forward to
your continued support and encouragement in 1988-89.
The remainder of the 1988-89 season offers an exciting array of
programs to include "A Little Romance", a subscription concert
featuring guest conductor, Robert Henderson, and pianist, James
Barbagallo, to be held March 18; "Grand Finale", another sub-
scription concert featuring Varujan Kojian as guest conductor,
and violinist, Leonidas Kavakos, scheduled for April 29; and
"Younq Virtuosi", our special school concert for elementary
school children from throughout the County of San Bernardino.

Enclosed is the 1988-89 annual program book which>~describes, in
more detail, our future programs as well as those programs per-
formed earlier in the season.
The $50,000 requested in this application will be used to support
the Symphony's 1988-89 general operating budget. Among those
areas requiring support are four planed children's concerts
(serving 4,000 fourth grade children); the Symphony's core five-
concert series (two remaining); and administrative support for
special season's performances sponsored by the Sinfonia Mexicana,
the Inland Dance Theatre, and the Inland Empire Opera.
The attachments to this request contain reviews of concerts held
earlier in the year as well as the annual program book.

An estimated 65% of the revenues needed to support the Inland Empire Symphony's programs
and services in its 1988-89 season are expected to come from pr~vate and public funds,
fundraisers, and contract revenues. The remaining 35% are expected to come from paid
admission: Without substantial public support these p~ograms would not be possible.
VUI. Intended Results:
The mission of the Inland Empire Symphony Association is provide quality music programs
to the Inland Empire'S rapidly growing population. The funds requested will enable the
Inland Empire Symphony Association to continue to provide symphonic, dance, opera and
music education programs for the benefit of all Inland Empire residents.

talented young conductors Clre
vying for the post of music direc-
. tor and conductor of the Inland
'Empire Symphony, and are serv-
.ing as guest conductors for this
1988-89 season as part of the final
.selection process. On Saturday
, night, the first of these, Charles
Zachary Bornstein, trotted out
his best stutTin an all-Mozart pro-
',gram.
A merry performance of the
overture to the opera "The Mar-
Ia riage Of Figaro" and a stunning
. realization of the "Jupiter" sym-
.tphony (No. 41 in C, K. 551) were
:., the highlights of a program that
':gave evidence to Bornstein's pro-
fessed arlinity for the music of
,:Mozart. Bornstein's musical and

emotional points of view were
stated in moslly grand and elo-
quent Mozartean.style.
The "Jupiter" emerged as the
best success of the evening in a
warm, ripe reading. Bornstein fo-
cused on the finale in his delinea-
tion and sharply outlined profiles
of the inner workings of the mu-
sic. lie used the first three
movements beautifully as canny
foils for a blockhuster finish that
inspired and uplifted the listener.
Similar qualities were evoked
in the concert's opening work -
the "Figaro" overture. Here, one
instantly perceived a lightness
and huoy.wcy a('ross the orches-
tral fabric. The playing had a
pleasant sense of simultaneous
Italianate warmth and Teutonic
precision. The overture was
played with such captivating, in-
fectious elan that it was a bit of a
disappointment that the actual
opera was not about to follow!
Hornstein was, literally, a
<me-man show in both playing
and conducting the evening's
solo work, Mozart's Piano Con-
certo No. 24 in C minor, K. 491 -
but with variable r.esults.
lie positioned the piano with
the keyboard facing the audience
and the instrument burrowed
well into the orchestra. This
tended to integrate the piano's
sound nicely within the orches-

gauntlet in grand style
figure on the podium and uses
sweeping, forceful ~estures -
even to stamping his foot for em-
phasis - to coax what he wishes
from his players. The orchestra
sounded quite polished, though a
tendency for the violins to sound
squawky and raw during exposed
passages was an intrusive, worri-
some element. This was the only
flaw in an otherwise fine - and
oflen exceptlonall- efTort.

But is Bornstein "Mr. (or,
Maestro) Right" for the Inland
Empire Symphony? His vivid,
flowery program notes and overt
podium style suggest a heads-
trong emotionalism that .might
not find fulfillment with our gen-
erally undemonstrative local au-
dience.
On the other hand, in terms
of the musical disciplines .,JIId
subtle verities with which few
other composers challenge musi-
cians as MOlart docs, he ('ertain-
Iy proved his ability to elicit not
only a fine, but in many ways a
remarkable performance from
our orchestra.
The next candidate, Stewart
Hobertson, will appear with the
Inland Empire Symphony at 8:15
p.m. Oct. 29. Robertson will ofTer
Hussian masterworks featuring
Rimsky-Korsakov's orchestral
showpiece "Capriccio Espagnol"
and a flail-length performance or
Igor Stravinsky's ballet score,
