Recommended motion:
That the Mayor be authorized to execute a Memorandum of Understand-
ing with Caltrans relative to adjustment of the construction
schedule for the Route 30/330 Freeway project, in order to accom-
modate the target opening date for the Wal-Mart Development at
Highland Avenue and Boulder Avenue.

STAFF REPORT
The Wal-Mart Development, at Highland Avenue and Boulder
Avenue, has a target opening date of April, 1992. Certain im-
provements will need to be done on Highland Avenue, in order to
handle the additional traffic projected to be generated by this
development.
Basic street improvements will be installed on Highland
Avenue (current State Route 30), under Caltrans' contractor for
the Route 30/330 Freeway project. These improvements will be
done as one of the last phases of work, after mountain traffic
has been diverted to the new freeway. According to the
contractor's schedule, the improvements to Highland Avenue will
not be done until 1993.
Interim improvements will be needed on Highland Avenue, in
the event that this development opens for business prior to the
improvements in Caltrans' project having been constructed. These
interim improvements will have to be removed to allow Cal trans'
contractor to do the items of work in their contract. This will
create additional costs.
The proposed Memorandum of Understanding provides, in gen-
eral, that Caltrans will amend their contract to provide for the
installation of interim improvements. These interim improve-
ments will shift traffic to the ultimate alignment of Highland
Avenue. This shift will allow the developer to install traffic
signals at Highland Avenue and Boulder Avenue, and access pro-
visions in their final location.
It is estimated that the additional cost to Caltrans for
these interim improvements will be $70,000. The Memorandum of
Understanding states that this amount will be paid by the City.
However, We expect that the City will require the developer to
provide the funds to finance this cost, since the work is being
done to accommodate their scheduled opening date.
We recommend that authorization be granted for the Mayor to
sign the proposed Memorandum of Understanding in order to permit
planning to continue.

MEMORANDUM OF UNDERSTANDING
ongoing construction activities on State Routes 30 and 330
are anticipated to be incompatible with the scheduled completion
dates of local development being considered in the northwest
quadrant of the intersection of Highland Avenue (Route 30) and
Boulder Avenue (Route 330 in northeast San Bernardino.
This Memorandum of Understanding (MOU), between the State of
california, Department of Transportation (Caltrans) and the city
of San Bernardino (City) outlines the general areas of
responsibility for City funded alterations to the existing
Caltrans construction project which will provide improved interim
access, in a timely manner, to the above-referenced City
development. This MOU is solely a quide to the obligations,
intentions and policies of the parties involved. It is not
intended to authorize funding or project effort, nor is it a
legally binding contract. Funding commitments providing for the
deposit of funds or specific work phases or project effort
committing machine or personnel time will be covered by one or
more separate cooperative agreements as outlined herein.
The City, caltrans, and Caltrans' contractor, the E. L.
Yeager Construction Company, Inc., have cooperatively
investigated alternatives that would provide adequate access to
the proposed development by the scheduled opening date of April,
1992. It has been determined that the existing Caltrans contract
cannot be accelerated to meet this date. However, interim
improvements are possible which will serve the interests of the
City. It is further understood that Caltrans cannot expend any
public funds to accommodate local development; and therefore, any
and all costs incurred in carrying out-the terms of the MOU are
to be borne by the City and will be specified in a Cooperative
Agreement to be executed prior to the commencement of any interim
construction.
This basic terms and conditions of this MOU are as follows:
1. Caltrans will prepare the plans and determine the cost
to construct the interim improvements required to
accomplish the above-stated goal.
2. Upon approval of this MOU, Caltrans will prepare a
Cooperative Agreement with the City formally defining
the roles and responsibilities of both parties.

3. city will pay all construction, engineering, and
demolition costs associated with the interim
improvements and provide these funds to Caltrans prior
to the start of any such construction. This cost is
estimated to be $70,000.00.
4. Caltrans will amend its contract with the Yeager
Company to cause the interim improvements to be
completed, to the extent possible, by the City's
improvement completion date of April 1992.
