DescriDtion) N/A Finance: Council Notes: 7",.n'62 Agenda Item No ~5 - - I> CITY OF SAN BERt4IRDINO - REQUEST ~R COUNCIL ACTION STAFF REPORT On October 1, 1990, authorization was given to proceed with the proposed annexation of the area generally located East of Waterman Avenue, between 3rd street and 6th Street. This was a City initiated action. On April 15, 1991, Resolution No. 91-124 was adopted, making formal application to the Local Agency Formation Commission (LAFCO). Part of those proceedings requires that the affected agencies of the proposed annexation adopt a resolution detel'llining the Dount of property tax revenues to be exchanged between the agencies as a result of the proposed change of jurisdictional boundaries. On June 17, 1991, Resolution No. 91-229 was adopted, determining property tax revenues to be exchanged between the City of San Bernardino, and the County of San Bernardino. The proposal has been reveiwed and approved by LAFCO, directing the City, as conducting authority, to hold a public hearing on the proposal. RESOLl1l'ION OF THE CITY OF SAN BERNARDINO INITIATING PROCEEDINGS AND SE'M'ING A PUBLIC HEARING FOR THE PROPOSED ANNEXATION OF THE AREA GENERALLY LOCATED EAST OF WATERMAN AVENUE. SOUTH OF 6TH STREET AND NORTH OF 3RD STREET, LAFCO 2671. WHEREAS ,preli.inary proceedings for a reorganization (annexation) were initiated when the City of San Bernardino filed its Resolution No. 91- 124. applying to the Local Agency Formation C~ission in the County of San Bernardino for annexation of certain territory pursuant to the Cortese-Knox Local Gove~ent Reorganization Act of 1985. Division 3. c~encing with section 56000 of the California GovernJlent Code; and WHEREAS, no City other than the City of San Bernardino is affected by this annexation; and WHEREAS, the proposal is for annexation of the territory described below to the City of San Bernardino. The area is legally inhabited. It has an assessed valuation of $1,618,508 (land only); and WHEREAS, the proposal was initiated by the City of San Bernardino, in order to facilitate an orderly growth of the area; and WHEREAS, the Local Agency Formation Co_ission has set forth the 19 following te~s and conditions in its Resolution No. 2329 : 20 "Condition No. 1. The conducting authority for this 21 proceeding shall be the City Council of the City of San Bernardino. 22 "Condition No.2. The boundaries are approved as set forth 23 in Exhibit "A" attached. 24 .Condition No.3. The following distinctive short fo~ 25 designation shall be used throughout this proceeding: LAFCO 2671. 26 "Condition No.4. The conducting authority is required to 4 provide notices pursuant to the provisions of Governaent Code Section 5 57025(b) . 6 "Condition No.6. The date of issuance of the Certificate 7 of Co~letion shall be the effective date of this annexation."; and 8 WHEREAS. a description of the boundaries for the proposed 9 annexation is as follows: generally located East of Waterman Avenue. South 10 of 6th street and North of 3rd Street. and and is more fully described in 11 Exhibit "A", attached hereto and incorporated by reference as though fully 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 set forth in length. BE IT RESOLVED BY THE MAYOR AND COHMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That a public hearing shall be conducted on Monday, -_....-----~~ -'---'-..- ---- -~-... San Bernardino, California, at the hour of 10:00 a.m., or as soon after that time as the matter may be heard. to receive, consider and rule upon written protests to the annexation designated LAFCO 2671. SECTION 2. That at any time prior to the conclusion of the hearing in the notice given by the clerk, but not thereafter, any owner of land or any registered voter within inhabited territory proposed to be annexed, aay file a written protest against the annexation. Each written protest shall state whether it is made by a landowner or registered voter and the naae and address of the owner of the land affected and the street address or other description sufficient to identify the location of the land or the name and address of the registered voter as it appears on the affidavit of registration.
