The Street Terrorism Enforcement and Prevention Act (S.T.E.P. Act) was
enacted in 1988. It's intent is to seek the eradication of criminal
activity by street gangs, by focusing on patterns of criminal gang
activity and on the organized nature of street gangs which together
are the chief source of terror, created by street gangs.
As defined in Penal Code Section 186.22, 'Pattern of criminal gang
activity' means the commission, attempted commission, or solicitation
of two or more of the following offenses, provided at least one of these
offenses occurred after the effective date of this Chapter and the last
of those offenses within three years after a prior offense, and the
offenses are committed on separate occasions, are by two or more persons.
1) Assault with a deadly weapon, 2) Robbery, 3) Homicide or Manslaughter,
4) Sale or possession for sale of narcotics and controlled substances,
5) Shooting into an inhabited dwelling or vehicle, 6) Arson and
7) Witness intimidation.

It will be the responsibility of the Intelligence Unit to gather all
the pertinent data on a particular street gang and present it to the
District Attorney's Office for review. The data will include an alpha
roster of all known members of that particular gang, criminal histories
on all members of that gang, a copy of all police reports involving
members of that gang and a copy of all SMASH cards completed on that
particular gang's members. All this information will be placed in a
binder. The District Attorney's gang prosecution unit will then review
the data (in binder form) and determine if the gang qualifies to be
profiled under the S.T.E.P. Act. As new members are identified the
binder will be updated. The binder will be maintained and updated by
the Intelligence Unit.
Once a street gang has been profiled under the S.T.E.P. Act, it will
be the responsibility of the MET Team to personally serve members of
that gang with the notice signed by the Chief of Police and District
Attorney that the gang is a criminal street gang within the meaning
of Penal Code Section 186.22. The officer contacting that particular
gang member will also fill out a proof of service card and also obtain
right and left thumbprints on the hard copy of the proof of service
card. A completed proof of service card will then be returned to the
Intelligence Unit for distribution. The original will be maintained
by the police department and the hard copy is then immediately forwarded
to the San Bernardino Sheriff's Department Gang Detail for information
input into the Countywide gang computer. The hard copy then gets
forwarded to the San Bernardino County District Attorney's Office, Gang
Violence Suppression Unit.

It will be the responsibility of the Crime Analysis Unit to make the
appropriate entries in the San Bernardino Police Department's Record's
Management System on a gang member served under the S.T.E.P. Act. The
gang members MNI number will be modified in the Record's Management
System with the sentence "S.T.E.P. Act served."
When a member of the profiled gang is arrested, an inquiry will be made
to determine if the member has been served under the S.T.t.P. Act.
When service has been confirmed, the police and District Attorney will
file appropriate charges and include charges for Penal Code Section
186.22.

engaging in a pattern of criminal street gang activity within
the meaning of Penal Code Sect ion 186.22. The gang has
demonstrated this pattern by participating in the commission,
attempted commission or solicitation of two or more crimes
involving the offenses of l)Assault with a deadly weapon, 21
Robbery, 3) Homicide or manslaughter, 4) Sale or possession for
sale of narcotics and controlled substances, 5) Shooting into
an inhabited dwelling or vehicle, 6) Arson, and 7) Witness
intimidation with one or more of the offenses occurring after
September 24, 1988 and the last of those offenses within three
years after a prior offense.

GANG VIOLENCB
IN 1988 THE STATE LEGISLATURE FOUND THAT VIOLENT STREET GANGS
HAVE CAUSED A STATE OF CRISIS IN THE STATE OF CALIFORNIA. THE. CITY
OF SAN BERNARDINO FOR ALL INTENT AND PURPOSE IS NOT IMMUNE FROM
GANG VIOLENCE AND IS ALSO IN A STATE OF CRISIS. IN FACT, GANG
RELATED CRIME IN SAN BERNARDINO IS INCREASING. EVEN THOUGH OUR
POLICE DEPARARTMENT IS ATTEMPTING TO REDUCE THE GANG ACTIVITY IN
OUR CITY, SAN BERNARDINO'S EFFORTS ARE QUICKLY NEUTRALIZED BY THE
ACCELERATION OF OUR NEIGHBORING CITIES POLICE DEPARTMENTS CRACK-
DOWN ON GANG ACTIVITIES IN THEIR RESPECTIVE CITY. OUR POLICE
EFFORTS ARE FURTHER HAND-CUFFED BY THE FACT THAT OUR COUNTY'S
JUDICIAL SYSTEM IS SO BACKED-LOGGED THAT CRIMINALS ARE WALKING OUT
OF OUR COURT ROOMS WITH VERY LIGHT PENALTIES AND WITH THE THOUGHT
THAT IT IS NOW VERY PROFITABLE TO COMMIT A CRIME.
WE HAVE WITH US TODAY, SEVERAL MEMBERS OF OUR POLICE
DEPARTMENT TO BRIEF THE MAYOR AND COUNCIL AND MORE IMPORTANT, THOSE
RESIDENTS WHO ARE VIEWING THIS MEETING ON TELEVISION, ON WHAT IS
TAKING PLACE ON THE GANG ISSUE IN SAN BERNARDINO. THEY WILL EXPLAIN
THE INTENT OF THE STREET TERRORISM AND PREVENTION ACT AND WHAT WE
CAN EXPECT FROM OUR POLICE DEPARTMENT IN THE FUTURE IN FIGHTING
GANG CRIME. WE HAVE A TOUGH JOB AHEAD OF US BUT THIS MAYOR AND
COUNCIL MUST MAKE CRIME IN SAN BERNARDINO THEIR NUMBER ONE
PRIORITY.
IT IS VERY IMPORTANT THAT WE WHO RESIDE IN SAN BERNARDINO
REALIZE THAT OUR FEDERAL AND STATE GOVERNMENTS CAN NOT BE DEPENDED
UPON FOR ANY MEANINGFUL ASSISTANCE. IF OUR HIGHEST FEDERAL
OFFICIALS CAN NOT RID WASHINGTON D.C. OF BEING THE HIGHEST CRIME
CITY IN OUR NATION, A CITY WHERE OUR FEDERAL LAWS ARE ENACTED AND
CRIME STILL PREVAILS, THAT MEANS THAT THE BURDEN OF ELIMINATING
GANG VIOLENT ACTIVITIES WILL FALL ON OUR SHOULDERS AND OUR POCKET
BOOKS. AFTER THE PRESENTATION BY OUR POLICE DEPARTMENT, I WILL BE
PROPOSING A VERY UNPOPULAR BUT WHAT I FEEL MAY BE THE ONLY SOLUTION
TO OUR GANG VIOLENCE PROBLEM IN THE COUNTY OF SAN BERNARDINO.
PROPOSBD SOLUTION
IT IS OF VERY LITTLE VALUE FOR OUR POLICE DEPARTMENT TO
APPREHEND CRIMINALS IN OUR CITY IF THEY CAN NOT BE TRIED BECAUSE OF
THE BACKLOGGED JUDICIAL SYSTEM THAT PRESENTLY EXISTS. WE NEED
APPROXIMATELY 10-15 MORE JUDGES IN ORDER TO RELIEWTHE CONGESTION,
BUT THE GOVERNOR HAS DENIED OUR COUNTY MORE JUDGESHIP APPOINTMENTS.
I AM SURE THAT WE ALSO NEED MORE PROSECUTORS, OFFICE SPACE AND
OTHER SUPPORTING STAFF. WE MUST ASSESS WHAT WE NEED TO DO TO
ACTIVATE A COUNTY-WIDE GANG VIOLENCE ELIMINATION PROGRAM.
WHAT I AM PROPOSING IS THAT WE, AS TAXPAYERS, FIND AND DECLARE
THAT GANG CRIME IN SAN BERNARDINO COUNTY IS OUR NUMBER ONE
PRIORITY, THAT WE WILL TAKE EVERY LAWFUL ACTION THAT IS REQUIRED TO
ELIMINATE ALL GANG VIOLENCE IN OUR COUNTY, AND THAT WE WILL SPEND
THE NECESSARY MONIES THAT ARE NEEDED IN ORDER TO SUCCEED. WE HAVE
NO OTHER CHOICE.

THE ASSESSMENT COULD BE IN THE FORM OF A 1/4 OR 1/2 CENT SALES TAX
INCREASE.
THE INTENT IS NOT TO CREATE ANOTHER BUREAUCRACY, ANOTHER
EMPLOYMENT PROJECT NOR A PERMANENT PROGRAM. I AM PROPOSING A THREE
(3) YEAR# PROJECT. A PROGRAM THAT IS LOCKED INTO AN ACCOUNTABILITY,
PRODUCTIVE AND SUCCESS-INTENSIVE MODE. A PROGRAM THAT WILL BE
MONITORED BY A COUNTY-WIDE CITIZENS BLUE-RIBBON COMMISSION. THE
FUNDS GENERATED BY THE ASSESSMENT MUST BE RESTRICTED SOLBLY FOR THE
FIGHT AGAINST GANG VIOLENCE.
