RESOLUTION NO. 89-111
A RESOLUTION OF THE CITY OF SAN BERNARDINO MAKING APPLICATION TO
THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SAN BERNARDINO FOR
THE ANNEXATION OF THE TERRITORY LOCATED SOUTH OF RIALTO AVENUE, WEST OF
TIPPECANOE AVENUE AND REPEALING RESOLUTION NO. 89-70.
WHEREAS, the Mayor and Common Council as the governing body of the
City of San Bernardino desire to initiate proceedings pursuant to the
Cortese-Knox Local Government Reorganization Act of 1985, Division 3,
commencing with Section 56000 of the California Government Code, for the
annexation of the area generally located South of Rialto Avenue, West of
Tippecanoe Avenue; and
WHEREAS, the territory proposed to be annexed is inhabited, and a
description of the boundaries of the territory is set forth in Exhibit "C"
attached hereto and incorporated by reference as fully as though set forth
in length herein; and
WHEREAS, this proposal is consistent with the sphere of influence
of the affected City; and
WHEREAS, the reason for this proposed annexation is as follows:

representing
approximately 50% of the area proposed for annexation
WHEREAS, on March 13, 1989, the Mayor and Common Council adopted
Resolution No. 89-70, making application to the Local Agency
Formation Commission for annexation of this same property; and
WHEREAS, due to recent changes in the requirements of the Local
Agency Formation Commission, Resolution No. 89-70 was in an
incomplete format;

SECTION 1.
Application and a proposal is hereby made to the
4 Local Agency Formation Conooission of the County of San Bernardino to take
5
proceedings for the annexation of inllabi ted territory located
South of
6 Rialto Avenue, West of Tippecanoe Avenue, as outlined in the justification
7 form marked Exhibit "A", and the plan and narrative marked exhibit "B", and
8 a full description of the area proposed for annexation marked Exhibit "C",
9 which are att.ached hereto and incorporated by reference as fully as though
10 set forth in length herein, in the manner provided by the Cortese-Knox Local

11 Government Reorganization Act of 1985.
SECTION 2. The Clerk of the governing body is hereby authorized
13 and directed to file a certified copy of this Resolution with the Executive
14 Officer of the Local Agency Formation Commission of the County of San
15 Bernardino.
16 SECTION 3. That Resolution No. 89-70 is hereby repealed.

NARRATIVE FOR PROVIDING SERVICES FOR A PROPOSED
ANNEXATION TO THE CITY OF SAN BERNARDINO,
LOCATED SOUTH OF RIALTO AVENUE,
WEST OF TIPPECANOE AVENUE
The Mayor and Members of the Common Council of the City of
San Bernardino agree and desire to annex the above described
terri tory to the Ci ty of San Bernardi no, for the foll owi ng
reasons:
1. The territory proposed to be annexed is contiguous to
the corporate limits of said City on three sides.
2. The i ncorporati on of thi s terri tory wi 11 hel p
contribute to an facilitate the orderly growth and development
of the existing City area and the territory proposed to be
annexed. This proposed annexation is within the Sphere of
Influence for the City of San Bernardino.
3. This annexation will also help to provide a uniform
and orderly manner of growth, planning and zoning of lands, and
the subdivision of lands therein in such a manner most
conduct i ve to the we 1 fare of sa i d City and the area proposed
for annexation.
The City of San Bernardino has planned for providing all
typical City services to the area under consideration for
annexation.
The following is an enumeration and description of
servi ces whi ch wi 11 be extended to the affected terri tory,
which describes the level and range of such services that will
be provided, as well as the feasibility of extending such
services and any improvements that will be required by the
City, along with a description of when the service will
commence and the fi nanci ng of such improvements and servi ces
and any condition imposed by the City.
1. Planning, Zoning, Code Enforcement and Building
Inspection The City shall provide these services in
conformance with appropriate Government Codes and City
Ordinances as well as following the City's General Plan for
zoning and subject to the provisions of Land Use Ordinance No.
1991. This function is supported by City taxes and appropriate
zoning, building and permit fees.
2. Parks and Recreati on The area proposed for
annexation will have no impact on park or recreational
facilities or programs, and no additional service will be
required as a result of the annexation. The cost to the
taxpayer within the proposed annexation will be collected

through the City taxes, and by required fees charged to
thoseindividuals who wish to participate in City-sponsored
recreational activities where charges and fees are applicable.
3. Library Serv ice - It is important to note tha t the
resources of the entire library system are readily made
available to the proposed annexation, including the Central
Library 1 oca ted at 6th and II E II Streets. The cos t for these
services are paid through the City taxes, and become available
immediately upon annexation.
4. Public Safety, Police, - The San Bernardino Police
Department is authorized a complement of 244 sworn officers and
approximately 128 ci vi 1 i ans not counti ng 72 school crossi ng
guards.
The Patrol Division maintains 6 beat areas of the City.
The Patrol Division presently averages 24 Police units on
patrol 24 hours a day, counting supervisory and traffic
personnel.
The Detective Division has 30 sworn officers and works
from 8:00 a.m. to 5:00 p.m. daily, Monday through Friday.
The Services Division maintains all records and
identification and provides support services to the other two
divisions on a 24 hour-a-day basis. The cost for these
services are paid through the City taxes, and become available
immediately upon annexation.
5. Public Safety, Fire, Paramedic and Rescue - Fire
protection service will continue upon annexation and the
affected residents will be provided with a Class 3 rated Fire
Department with eleven (11) different fire stations to respond.
A typical structural fire on the first alarm deploys two (2)
engi ne compani es, one (1) 1 adder truck company, a paramedi c
squad and one (1) Battalion Chief. In addition to fire
protect ion, the City a 1 so has a mi n i mum of four (4) paramed i c
units on duty 24 hours a day. Each unit has two (2) paramedics
each, giving a total of eight (8) paramedics on duty at all
times. Also, the City is equipped with helicopter assistance
for rescue and/or excavation service when required. The
closest station is Fire Station No. 10, located at 520 South
Arrowhead Avenue. The cost for these services are paid through
the City taxes, and become available immediately.
6. Public Safety, Ambulance Service - The City of San
Bernardino under Ordinance No. 1987 franchise to Courtesy
Ambulance Company as the only medical transportation carrier
within the City limits. The rates are established by the above
ordinance and said fees are paid by the user.

7. Cardiff Farms Mutual Water Company presently serves
this area.
The treatment, disposal and reclamation of wastewater is
processed by the City of San Bernardino.s Treatment Plant.
8. Chamber Cable Company and Comcast Cable These
companies presently provide services to this area upon property
owner.s request.
9. Public Utilities Electricity, Gas and Telephone
Service - These services are currently provided to the project
area. The City will allow service to continue upon annexation
under the present franchise agreements between the various
utility companies. The rate structure and cost to the property
owners are controll ed by the Publ i c Uti 1 i ti es Commi ssi on and
any expansion of future service will be created by the request
of developer and/or property owners.
10. Solid Waste, Collection and Disposal - When the area
is annexed and developed, the City will provide service at that
time. Also, if upon request, the City will provide refuse
service to the existing customers, or at the end of the 5-year
cancellation period, whichever comes first. The current fee
for twice-a-week pickup (residential) is $7.00 per month.
11. Transit - Upon annexation, the bus service provided
for this area will remain under the control of Omnitrans.
Omnitrans. long range transit plans are at the request of
residents in the area through their Councilman or directly to
Omnitrans. Such change must have approval of the City Council.
The Short Range Transit Plan calls for continuation of the
present service levels on these routes. Service level changes
are made twice yearly, in January and June, and are initiated
at the request of the Ci ty Counci 1 and/or Omni trans pl anni ng
staff.
SPECIAL TAXES:
In addition to the regular property taxes, an 8% utility
tax is collected by the City to offset costs of the general
services provided. This amount is billed and paid through the
respective utility.s billing process.

in Book 7, page 2 of maps, in the office of the County Recorder, County of
San Bernardino, State of California and All of Tract No. 2354, as per map
recorded in Book 33 of Maps, page 86, Records of the County Recorder of said
County, described as follows:
Beginning at the Southwest corner of said Lot 16; thence North, along the
West line of said lot, said line also being the Corporate City Limit line of
the City of San Bernardino as it now exists, and along the West line of said
