Set forth service to be rendered, amount to be paid, manner of payment, time for performance or completion, determination of satisfactory performance and CDUse for termination, other terms and conditions, and attach plans, specifications, and addenda, if any.) WHEREAS the City and the County are desirous of sharing an electricl generator currently owned by the County for emergency purposes: IT IS AGREED AS FOLLOWS: 1. The City move the 15 KW generator, 120/208V, AC, Single or 3 phase, with Cable Set, currently being stored at the Needles Police Department, to the Fire Station located at 200 East Third Street, San Bernardino, CA. 2. City will restore this unit to operation and mount it on a trailer provided by the City to facilitate its location. 3. City will assume total responsibility for the costs of restoration, maintenance and upkeep for the unit. The unit will be operated only for inspection, maintenance, or emergency purpose. 4. The City will be authorized to operate or dispatch the unit for mutual aid on a day-to-day basis for an emergency deemed necessary by the City Manager or his designee. City will maintain a record of such use for the generator and make it available for review by the County. Contents of such records shall include, but not limited to: date of emergency operation of the unit, total time of operation, and the reason for operation. EXHIBIT "A" 02.1231l~00 Rev. 11/80 Pege_ 01_ " 5. The City will store unit at the Fire Department, 200 East Third Street, San Bernardino, CA. 6. City will release this unit to San Bernardino County Public Health Department upon request (written or verbal) from the County Director of Public Health or his designee for emergency use only. 7. This agreement shall be effective February 1, 1989, and shall remain in effect through July 31, 1992. This agreement may be terminated at any time with or without cause by City or by County on written notice given to the other at least 60 days before the specified date for such termination. 8. Upon termination of this agreement custody of the generator reverts to San Bernardino County Public Health Department. All alterations, modifications and improvements to the unit are the property of the San Bernardino County Public Health Department. 9. The City will indemnify, defend, and hold the County harmless from loss, costs, or expenses caused by the negligent or wrongful acts or omissions of City officers, agents, and employees occurring in the performance of this contract to the extent that such liability is imposed on the County by the Provisions of Government Code Section 895.2. 10 The County will indemnify, defend, and hold the City harmless from loss, costs, or expenses caused by the negligent or wrongful acts or omissions of County officers, agents, and employees occurring in the performance of this contract to the extent that such liability is imposed on the City by the Provisions of Government Code Section 895.2.
