2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AMENDMENT TO CONTRACT WITH THE COUNTY OF SAN
3 BERNARDINO ACTING AS THE AREA AGENCY ON AGING APPROVING A REVISED
BUDGET FOR THE SENIOR NUTRITION PROGRAM TO INCLUDE AN ADDITIONAL
4 ONE-TIME GRANT SUM OF $20,320 FOR THE PURCHASE OF EQUIPMENT AND
HIRING OF ADDITIONAL STAFF NECESSARY TO IMPROVE THE MEAL SERVICE
5 FOR THE BUDGET YEAR 1988-89, AND AUTHORIZING THE EXECUTION OF
ASSURANCE OF COMPLIANCE WITH THE DEPARTMENT OF HEALTH AND HUMAN
6 SERVICES REGULATIONS UNDER TITLE VI OF THE CIVIL RIGHTS ACT OF
1964.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE

CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1.
The Mayor of the City of San Bernardino is

hereby authorized and directed to execute an amendment to the
11

contract with the County of San Bernardino acting as the Area
13
Agency on Aging approving a revised budget for the Senior
Nutrition Program in the amount of $20,320 for the purchase of
equipment and hiring of additional staff necessary to improve the
meal service for the budget year 1988-1989, a copy of which is
attached hereto marked Exhibit "A" and incorporated herein by
reference as fully as though set forth at length.
SECTION 2.
The Mayor of the City of San Bernardino is
hereby authorized and directed to execute an Assurance of
Compliance with the Department of Health and Human Services
Regulations under Title VI of the Civil Rights Act of 1964, a
copy of which is attached hereto marked Exhibit "B" and
incorporated herein by reference as fully as though set forth at
length.

AMENDMENT NUMBER 1 TO COUNTY AGREEMENT NUMBER 88-763 BETWEEN OFFICE
ON AGING AND THE CITY OF SAN BERNARDINO FOR FY 1988/89 (OoA).
RECOMMENDA TION:
Approve Amendment Number 1 to County Agree~~nt Number 88-763 between Office
on Aging and the City of San Bernardino for the administration of a senior
nutri tion program increasing the agreement amount by $21,853 from $169,480
to $191,333 for a period of July 1, 1988 thru June 30, 1989.
BACKGROUND:
On July 18, 1988, the Board of Supervisors approved Agreement Number 88-763
wi th the City of San Bernardino to provide nutrition services for seniors
in FY 1988-89.
Unallocated Office on Aging funds in the amount of $21,853 have recently
become available and the Office on Aging wishes to allocate this amount
to the City of San Bernardino.
This action will allow the contractor to purchase food production equipment
and hire additional food service personnel which would enhance the
contractor's meal delivery system.
REVIEW BY ADVISORY BOARD/OTHER DEPARTMENTS:
The Senior Affairs Commission approved this amendment on December 8, 1988.
This contract has been reviewed and approved by Contract Compliance, Risk
Management and Deputy County Counsel W. Andrew Hartzell.
FINANCIAL DATA:
Adequate appropriations and revenue have been included in the Department's
FY 1988/89 budget to meet the cost of this contract. There is no local
cost to the County.

AMENDMENT Nq. 1
WHEREAS, the County and City of San Bernardino
entered into a contract on July 18, 1988 designated in County
records as Contract No. 88-763; and
WHEREAS, the parties now desire to amend said Contract
to provide for an increase in funds for services provided
thereunder:
NOW, THEREFORE, it is mutually agreed that Contract
No. 88-763 is amended as follows:
1 ) The maximum amount of CDA funds awarded under
the contract, as specified in Paragraph 5 thereof, is hereby
increased to $191,333;
2) The matching share contributed by the Contractor
as specified in Paragraph 6 is increased to $14,921 of which
-0- shall be in cash and $14,921 shall be in kind;
3) Exhibits "A-I"; "B"; "B-1" are hereby deleted
from the contl':act and new exhibits so designated and marked
"REVISED" are hereby added to the contract and incorporated
therein by reference;
4) Except as modified by this amendment, all
provisions of Contract No. 88-763 remain in full force and
effect.

ASSURANCE 'OF COMPLIANCE WITH THE DEPARTMENT OF
HEALTH AND IIUMAN SERVICES REGULATIONS UNDER
TITLE VI OF ~BE CIVIL RIGHTS ACT OF 1964
CITY OF SAN BERNARDINO
(Name of Grantee or Contractor)
(herein after called the "Recipient of Award"), HEREBY AGREES that
it will comply with Title VI of the Civil Rights Act of 1964 (P.L.
33-352) and all requirements imposed by or pursuant to the Regulations
of the Department of Health and Human Services (45CFR, Part 80) issued
pursuant to that title, to the end that, in accordance wi th Ti tIe
VI of that Act and the regulation, no person in the United states
shall, on the ground of race, color, sex, age, or national origin,
be excluded from participation in, be denied the benefits of or be
otherwise subjected to discrimination under any program or acti vi ty
for which the Recipient of Award received federal financial assistance
from the San Bernardino County Office on Aging: a recipient of federal
financial assistance from the Department; and HEREBY GIVES ASSURANCE
that it will immediately take any measures necessary to effectuate
this agreement.
If any real property or structure thereon is provided or improved
with the aid of federal financial assistance extended to the Recipient
of Award by the Area Agency on Aging, this assurance shall obligate
the Recipient of Award or in the case of any transfer of such property,
any transferree, for the period during which the real property or
structure is used for a purpose for which the federal financial
assistance is extended or for another purpose involved in the provision
of similar services or benefits. If any personal property is so
provided, this assurance shall obligate the Recipient of Award for
the period during which the federal financial assistance is extended
to it by the Area Agency on Aging.
THIS ASSURANCE is given in consideration of and for the purpose of
obtaining all federal grants, loans, contracts, property, discounts
or other federal financial assistance extended after the date hereof
to the Recipient of Award by the Area Agency on Aging, including
installment payments after such data on account of applications for
federal financial assistance which were approved before such date.
The Recipient of Award recognizes and agrees that such federal financial
assistance will be extended in reliance on the representations and
agreements made in this assurance. This assurance is binding on the
Recipient of Award, its successors, transferrees and assfgnees, and
the perso or persons whose signature appear below are authorized
to sign a uranc~ 11-1:>ehalf of the Recipient of Award.
