'r~ /j/lf/J; ~-~. /7 ~ "tJ:7 tb~-;P: ~ U?"f-"-/ (Ho0 '. ~~Jl- ~^ U ~~Ci:.-r Ln Bernardino The Mayor and COIDl )f Understanding between the City of S~ >rnia Department of Commerce to provide fc EmplOYment and Economj .' 1 RESOLUTION NO. 89-8 2 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF SAN BERNARDINO AND THE STATE OF CALIFORNIA DEPARTMENT OF COMMERCE FOR THE CITY OF SAN BERNARDINO EMPLOYMENT AND ECONOMIC ENTERPRISE ZONE AREA 3 4 5 6 7 8 9 10 WHEREAS, on June 3, 1988, the U.S. Department of Housing and Urban Development (hereinafter referred to as the "Department") issued regulations for the Enterprise Zone Program in order to implement Title VII, Enterprise Zone Development, of the Housing and Community Development Act of 1987; WHEREAS, the City of San Bernardino has prepared an application for an 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Enterprise Zone designation for the San Bernardino Employment and Economic Enterprise Zone Area; WHEREAS, the State of California Department of Commerce supports said application as required by the Department's final rule published in Volume 53, Number 158 of the Federal Register; and WHEREAS, the Mayor and Common Council of the City of San Bernardino approves the attached Memorandum of Understanding between the City of San Bernardino and the State of California Department of Commerce which supports said application that provides certain incentives to businesses located within the San Bernardino Employment and Economic Zone Area; NOW THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of San Bernardino that: The Mayor and Common Council approves the Memorandum of Understanding between the City of San Bernardino and the State of California Department of Commerce to provide for the economic development of the San Bernardino Employment and Economic Enterprise Zone Area. 1 I HEREBY CERTIFY that the foregoing resolution was duly adopted by the 2 regular Mayor and Common Council of the City of San Bernardino at a 3 4 5 6 7 8 9 10 11 12 13 3rd day of January , 1989, by the meeting thereof, held on the following vote, to wit: Estrada, Reilly, Flores, Maudsley, Council Members AYES: Minor, Pope-Ludlam, Miller NAYS: None ABSENT: None ~:W/1?a~r::fJ;~ /" City Clerk 14 The foregoing resolution is hereby approved this ~A~ day of Januarv 15 16 17 18 19 20 21 22 23 24 1989. form and By: 25 26 27 28 # MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF SAN BERNARDINO AND THE CALIFORNIA DEPARTMENT OF COMMERCE The City of San Bernardino has nominated the area contained in this application for designation as a Federal Enterprise Zone under Title VII of the Housing and Community Development Act of 1987. The California Department of Commerce joins in this nomination as required by the Housing and Urban Development (HUD) final rule published in Volume 53, Number 158 of the Federal Reqister on August 16, 1988. The City of San Bernardino and the California Department of Commerce agree to the following specific provisions of the course of action during the period of designation identified in this application. The State of California will provide the following elements: 1. Provide tax reduction incentives to businesses located in California1s designated enterprise zones and employment incentive areas as called for in California law. 2. Provide technical assistance, job training, financial assistance and marketing assistance through the usual State of California activities and programs. 3. Give special contract preference to minority owned businesses as called for in California law. The City of San Bernardino will provide (but not be limited to) one or more of the following elements and will identify each element in the course of action. 1. A reduction of taxes rates, fees or user charges applied within the enterprise zone. 2. An increase in the level of efficiency of public services within the enterprise zone. 3. Actions to reduce, remove, simplify or streamline paperwork requirements within the enterprise zone. 4. The gift (or sale at below fair market value) of surplus land in the enterprise zone to neighborhood organizations agreeing to operate a business on the land. ... ~________ _t .. __ _ . ..<11. _---.. ; -2- The Ctty of San Bernardtno will assume all responsibility for reporting. monitoring. auditing and evaluating the Federal program. Boundary identification and maintenance outstde of the State designated enterprise zone and employment incentive areas will also be the responsibiltty of the local jurisdiction. ~ In witness whereof, the parties agree to have executed this agreement on the day, month and year indicated.
