Synopsis of Previous Council action:
03/05/90 --- Authorization to proceed was given. and Plan No. 8031 was approved.
04/15/91 --- Negative Declaration was adopted and a finding of consistency with
the General Plan was made.
06/17/91 --- Resolution of Intention No. 91-245 was adopted. which sets a
public hearin~ date of 07/15/91 for the proposed vacation of
that portion of Huff Street lying between Crescent Avenue and "G"
Street. South of Hill Street.
Recommended motion:
1. That the hearing be closed and the Findings of Fact as set forth in the Staff
Report from Ro~er G. Hardgrave. Director of Public Works/City Engineer as to
why that portion of Huff Street lying between Crescent Avenue and "G" Street.
South of Hill Street. is no lon~er necessary for street purposes. be adopted.
2. Adopt Resolution.

STAFF REPORT
staff received a request from Rod Emory. the President of Cove Development. to vacate
that portion of Huff Street lying between Crescent Avenue and "G" Street. South of
Kill Street. in an effort to effectively utilize the two pieces of property lying
North and South of that section of Huff Street. Until that section of Huff Street is
vacated. the building lying to the North is unusable. as it has only 12 parking
spaces. The minimum number of parking spaces required for a building of that size
(approximately 30.000 square feet) is 60. With the vacation of Huff Street this area
could be revitalized and an effective use can be made of an empty building.
Authorization to Proceed was given on 03/05/90. to proceed with the proposed vacation
and Plan No. 8031 was approved.
Utility companies and City departments were notified of the proposed vacation on
05/08/90. with replies due by 06/08/90. The Assistant City Engineer is not convinced
that the proposed vacation is warranted. but no other negative responses were received
regarding the proposed vacation.
On 04/15/91. a Negative Declaration was adopted for the proposed vacation. and a
finding of consistency with the General Plan was made. The Negative Declaration had
been tabled since April of 1990. as the owners of the North and South properties had
not yet come to an agreement about the best use of their properties.
On 06/17/91. Resolution of Intention No. 91-245 was adopted. reserving easements for
the City Water Department. and easements for the existing catch basins on the
Northwest and Southwest corners of Huff Street. Easements were also reserved for
public utilities over the entire area of the vacation. That resolution sets a public
hearing date of 07/15/91. On 06/26/91. the Resolution of Intention was published in a
local newspaper. Notices were posted in the area proposed for vacation. and all
property owners adjacent to the proposed vacation were notified of said hearing.
There appears to be no further necessity for that portion of Huff Street lying between
Crescent Avenue and "G" Street. South of Kill Street. either for present or future
street purposes. Staff recommends the vacation on the basis of the following Findings
of Fact:
1. The above portion of the street has been determined by the Department of Public
Works to be of no further necessity to the general public:
a) Negative Declaration was adopted. and a finding of consistency with the
General Plan was made.
b) Traffic flow does not warrant a street in this area.
2. Both of the adjoining property owners have requested the proceedings and the
required $750.00 fee has been paid.
3. All of the concerned City Departments and Utility Companies were notified of the
proposal and all have had the opportunity to respond. Reservations of easements
for the City Water Department and the existing catch basins and an easement for
Public utilities have been reserved over the entire area of the proposed vacation.
and the same have been provided for in the Resolution of Intention.
No special requirements have been placed upon the proponents relative to the
proceedings which would require an inspection of the area prior to the adoption of the
Resolution Ordering Vacation. Therefore. we have attached the said Resolution Ordering
Vacation for your action.

. RESOLUTION OF THE CITY OF SAN BERNARDINO ORDERING THE VACATION OF
THAT PORTION OF HUFF STREET LYING BETWEEN CRESCENT AVENUE AND "G" STREET. IN
THE CITY OF SAN BERNARDINO AND RESERVING EASEMENTS FOR STORM DRAINS AND
WATER LINES AND APPURTENANT FACILITIES. AN EASEMENT FOR INGRESS AND EGRESS
FOR EMERGENCY VEHICLES. AND A PUBLIC UTILITY EASEMENT THEREIN.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1: The Mayor and Common Council of the City of San
Bernardino. having heard the evidence offered in relation to the proposed
9 vacation of that portion of Huff Street lying between Crescent Avenue and
10 "G" Street and described in City Resolution of Intention No. 91-245. hereby
11 find from all of the evidence submitted that such street proposed to be
12 vacated by said Resolution is unnecessary for present or prospective street
13 purposes.
14 SECTION 2. The Mayor and COlBBlon Council of said City do hereby
15 vacate that portion of Huff Street lying between Crescent and "G" Streets.
in San Bernardino. California. more particularly described as follows:
That portion of Huff Street as conveyed to the City of
San Bernardino by document recorded September 17. 1953.
in Book 3243, Page 59. Official Records. described as
follows:
That portion of Blocks 26 and 29 of Rancho San
Bernardino, as per plat thereof recorded in Book 7 of
Maps. Page 2, Records of the County Recorder of San
Bernardino County. State of California. described as
follows:
Beginning at the intersection of the North line of Huff
Street. 60 feet wide and the East line of Crescent Avenue
(fonaerly "G" Street), 60 feet wide: thence East along
said North line of Huff Street. a distance of 440 feet,
more or less. to the West line of "G" Street. 60 feet
wide: thence South along the prolongation of said West
line. a distance of 60 feet to the South line of said
Huff Street: thence West along said South line. a
distance of 440 feet. more or less. to the East line of
said Crescent Avenue: thence North along the prolongation
of said East line. a distance of 60 feet to the Point of
Beginning.

2 SECTION 3. Nothing in this Resolution shall in any way affect or
3 disturb any existing easements belonging either to the City of San
4 Bernardino or to any public utility and there are hereby specifically
5 reserved for the City of San Bernardino. easements for storm drains. water
6 lines and street light purposes in. over. under. and across the real
7 property hereinabove described. and the right at any time or from time to
8 time. to construct. maintain. operate. replace and renew one or more
9 pipelines and all appurtenances thereto. The easements herein granted shall
10 also include the right to use such area adjacent to the easements as may be
11 reasonably necessary for performing the work and for access to the work
12 during construction and includes rights of ingress and egress. There is
13 hereby specifically reserved for Southern California Edison. an easement
14 over the hereinabove described real property to construct. place. operate.
15 inspect. maintain. repair. replace and remove such aerial and underground
16 electrical transmission structures. as the company may from time to time
17 require. consisting of poles. anchors. wires. cables. conduits, manholes.
18 markers. and necessary fixtures and appurtenances, including the right of
19 ingress and egress thereto. There is also hereby specifically reserved for
20 emergency vehicles. an easement for ingress and egress over the hereinabove
21 described property.
22 SECTION 4. The City Clerk of the City of San Bernardino shall
23 cause a certified copy of this resolution to be recorded in the office of
24 the County Recorder of the County of San Bernardino.
