Home My WebLink About2008-096 .'t RESOLUTION NO. 2008-96 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AMENDMENT AND ISSUANCE OF A PURCHASE ORDER IN THE AMOUNT OF $90,500 BY EXERCISING THE FINAL YEAR RENEWAL OPTION WITH GUZMAN CONSTRUCTION COMPANY FOR THE REPAIR OF SIDEWALKS, CURBS, GUTTERS, AND CROSS GUTTERS AT VARIOUS LOCATIONS THROUGHOUT THE CITY OF SAN BERNARDINO. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The City Manager of the City of San Bernardino is hereby authorized to execute on behalf of said City an Amendment between the City of San Bernardino and Guzman Construction Company, which is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. SECTION 2. This purchase is exempt from the formal contract procedures of Section 3.04.010 of the Municipal Code, pursuant to Section 3.04.010 B-3 of said Code "Purchases approved by the Mayor and Common Council". SECTION 3. Pursuant to this determination the Finance Director or his/her designee is hereby authorized to issue a purchase order to Guzman Construction Company for a total amount of $90,500. SECTION 4. The Purchase Order shall reference this Resolution No. 2008- 96 and shall read, "Guzman Construction Company for the repair to sidewalks, curbs, gutters, and cross gutters at various locations throughout the City, P.O. not-to- exceed $90,500" and shall incorporate the terms and conditions of the Agreement. 24 25 Order and agreement is rescinded if it is not issued within sixty (60) days of the 26 27 28 SECTION 5. Penman ity Attorney 008-96 EXHIBIT "A" 1 2 3 -4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 AMENDMENT NO.1 TO VENDOR SERVICE AGREEMENT GUZMAN CONSTRUCTION COMPANY This Agreement is entered into this 7th day of April 2008, by and between Guzman Construction Company ("VENDOR") and the City of San Bernardino ("CITY" or "San Bernardino"). RECIT ALS A. On April 2, 2007, Guzman Construction Company and the City of San Bernardino entered into a Vendor Service Agreement for the repair of sidewalks, curbs, gutters, and cross gutters at various locations throughout the City in the amount of $199,200 as set for in Attachment 1, attached hereto and incorporated by reference. B. The CITY and VENDOR now desire to alter the Agreement to increase the amount of the Agreement by $90,500 for a total not-to-exceed purchase price of $289,700. AGREEMENT In consideration of the mutual promises contained In the Vendor Services Agreement, the parties agree as follows: 1. The total Agreement price shall be increased by $90,500 for a not-to-exceed the amount of $289,700, for the services set forth in Attachment 1. 2. The term of this Agreement shall be for a period of one year. 3. The other provisions of the written contract are reaffirmed as originally stated.
