Construction Fund under account no. 250-670-57478
01-23-91 Resolution 91-30 adopted authorizing execution of agreement with
County for development of final construction plans.
03-18-91 Resolution 91-96 adopted creating Underground Utility District No.
20. along 40th Street, from Kendall Drive to Palm Drive.
05-20-91 Plan No. 8433 was approved and authorization given to advertise for bids.
Authorization to transfer $21.500 from Account No. 250-670-57483
(Tippecanoe Ave. - Redlands Blvd. to Victoria Ave.) to 250-670-
57478 (40th Street fill in)

STAFF REPORT
Plan No. 8433, for the widening the South side of 40th Street, between Third
Avenue and Cottage Drive was prepared by the Engineering Division and approved on May
20, 1991. Authorization was given to advertise for bids for the proposed project.
On 3-18-91, Underground Utility District 20 was created for undergrounding the
various overhead utilities along 40th Street from Kendall Drive to Palm Drive. The
majority of the overhead facilities are located along the North side of 40th Street.
The City and County have entered into a Cooperative Agreement relative to the
preparation of plans and acquisition of the necessary additional right-of-way for the
wideneing of 40th Street. Acquisition of the additional right-of-way is expected to
take up to a year.
The full widening of 40th Street, between Third Avenue and Acre Lane will be
delayed for at least a year to allow for the necessary acquisitions and removal of
overhead utilities. However, the South side of 40th Street, from Third Avenue to
Cottage can be widened at this time.
Tbe owners of two parcels have dedicated the necessary right-of-way on the
South side of 40th Street, and the acquisition of property from the Flood Control
District will complete the necessary acquisition for this phase of the widening
project.
The portion to be acquired from the Flood Control District is a 22 foot
strip of land located along the South 'side of 40th Street, West of Acre Lane,
the Flood Control District property. Tbey have indicated to us that they would
the property to the City for $4,000, and a purchase contract for that amount has
prepared by the County and submitted to the City for execution after which they
submitted to the Board of Supervisors for finalization.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING AND DIRECTING
THE EXECUTION OF A PURCHASE CONTRACT FOR THAT CERTAIN REAL PROPERTY LOCATED
ALONG THE SOUTH SIDE OF 40TH STREET, WEST OF ACRE LANE.
WHEREAS, the City of San Bernardino desires to acquire certain
real property located along the South side of 40th Street, West of Acre
Lane, for street and highway purposes; and
WHEREAS, the herein mentioned real property is described more
fully in Exhibit "A" attached hereto and incorporated by reference as fully
as though set forth in length herein; and
WHEREAS, title to said real property is vested in the County of
San Bernardino.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor of the City of San Bernardino is hereby
authorized and directed to execute on behalf of said City, an Offer to
Purchase Real Property, a copy of which is attached hereto as Exhibit. "B"
and incorporated by reference as fully as though set forth in length herein,
for the purchase of that certain real property herein described.
19 SECTION 2. That payment in the amount of $4,000.00 (Four Thousand
20 Dollars) is hereby authorized as payment in full for the herein mentioned
21 real property.
SECTION 3. That the City Clerk is directed to cause the executed
23 Offer to Purchase Real Property, along with a certified copy of this
24 Resolution and herein mentioned payment of $4,000.00 (Four Thousand Dollars)
25 to be transmitted to the County of San Bernardino, Real Estate Services
