REOUEST
The applicant, Mr. Basem Bashir, is appealing the denial of
Conditional Use Permit No. 91-09 by the Planning Commission.
The applicant requests that the Mayor and Council reconsider
the denial and approve Conditional Use Permit No. 91-09.
BACKGROUND
Conditional Use Permit No. 91-09 is a request to sell beer,
wine and distilled spirits for off-site consumption in
Jimmy's Market located at 1620 West Baseline. The applica-
tion for the Conditional Use Permit was denied by the Plan-
ning Commission by a 5 to 3 vote on May 8, 1991. The appli-
cation is exempt from the provisions of CEQA.
The applicant, Mr. Basem Bashir, was displaced from 1598 West
Baseline, due to the Development Department's project located
on the northwest corner of Baseline Avenue and Medical Center
Drive. Mr. Bashir has entered into an agreement to purchase
Jimmy's Market and transfer his Type 21 ABC license to this
location. The present owner of Jimmy's Market has agreed to
surrender his Type 20 ABC license upon the transfer.
During the Planning Commission hearing, public opposition to
the Conditional Use Permit was heard. Due to this opposition
and the fact of Jimmy's Market being located directly adja-
cent to Martin Luther King Elementary School, (separated only
by a slated chain link fence), were the reasons for the
Conditional Use Permit denial by the Planning Commission by a
5 to 3 vote. Staff had recommended approval.

--1. The proposed market use is in conformance with the objectives
of the City's General Plan, in that food markets with off-site
beer, wine and distilled spirits are permitted in the CG-2,
Commercial General, land use designation subject to the
approval of a Conditional Use Permit.
--2. The proposed use will adversely affect the adjoining land
uses and the growth and development of the area in which it is
to be located. There is a high concentration of alcohol
outlets in the surrounding area. The vicinity has experienced
a crime rate which is higher than the average for the City.
It can be reasonably expected that these incidents, as well as
calls for Police service, will increase with an increase in the
variety of alcoholic beverage products available in the same
vicinity.

Applicant requests approval of a Conditional Use Permit under the
authority of Code Section 19.83.500, to upqrade sales of beer and
wine to general liquor for off-site consumption from an existing
market in a mUlti-tenant, retail center in the CG-2, Commercial
General, General Plan land use district.
SITE LOCATION
The proposed sales of beer, wine and distilled spirits will be
from an existing convenience market on a rectanqulary-shaped
parcel of land consisting of approximately .75 acres located on
the north side of Baseline and further described as 1620 West
Baseline.
MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE
The proposed project is consistent with the Municipal Code and is
in conformity with the General Plan as shown in Attachment "A".

On January 22, 1991, C.U.P. was filed with the City of San
Bernardino. The Development Review Committee reviewed the site
plan, floor plan and elevations for clearance to the Planning
Commission on April 4, 1991 .

present owner of Jimmy's Market has agreed to surrender his Type
20 ABC license upon the transfer. Mr. Basem Bashir would be the
sole owner and manager of the business and would maintain the same
business name of Jimmy's Food Store.

CRIME
The site of the existing market is located within census tract 43,
and according to crime statistics from 1987, the crime reporting
district was 13 per cent above the average for the city.
In 1987 there were 134 Part I crimes and 55 Part II arrests, with
12, or 22 per cent which were alcohol related. During the past 90
days (6/1/90 - 9/30/90) 28 Part I crimes and 23 Part II arrests
were reported. Of these crimes reported 17 per cent were alcohol
related.
CONCENTRATION OF ALCOHOL ESTABLISHMENTS
There are 12 existing outlets for alcohol sales intended for
off-site consumption. This exceeds census tract saturation level
of 8 as determined by the Police Department.
This census tract has 11 existing outlets for on-site alcohol
consumption, with 9 approved.

As noted in the Police Department Investigative report, ABC
Investigator Barbara Lyons, informed Detective Diaz that she had
not received any letters of protest regarding the application and
also that she has spoken to the school Principal Edwin Dean at
Martin Luther King Elementary School, who did not have any
opposition to the proposed business.

CONCLUSION
Conditional Use Permit 91 - 09 requests to upgrade a Type 20
license, for beer and wine sales, to a Type 21 license for beer,
wine and distilled spirits. The applicant proposes to transfer
this license to an existing food store, Jimmy'S Market at 1620
West Baseline.
In summary, the applicant's request is consistent with the General
Plan. Further, the proposed improvements to the site, as shown
on the project plans reviewed by the Development Review Committee,
will upgrade the appearance of the center, provide for a safer and
more efficient utilization of the existing development and benefit
the surrounding neighborhood.
Staff holds that, if the attached Conditions of Approval
(Attachments C and D) are adopted, the proposed business would be
compatible with the surrounding commercial and residential land
use.

FINDINGS OF FACT
1. The proposed market use is in conformance with the objectives
of the city's General Plan, in that food markets with off-site
beer, wine and distilled spirits are permitted in the CG-2,
Commercial General, land use designation subject to the
approval of a Conditional Use Permit.
2. The proposed use will not adversely affect the adjoining land
uses and the growth and development of the area in which it is
to be located. The intensification of land use will be
addressed by the proposed site improvements and the Conditions
of approval which will mitigate potential negative impacts to
the surrounding properties.
3. The size and shape of the site proposed for the use is adequate
to allow the full development of the proposed use in a manner
not detrimental to the partiCUlar area nor to the peace, health
and general welfare in that the proposed improvements to the
site will provide for a safer and more efficient utilization of
the existing development.
4. The traffic generated by the proposed use will not impose an
undue burden upon the streets and highways designed and
improved to carry the traffic in the area, in that the
commercial development on the site is existing.
s. Based on the above noted Findings, and under the mitigating
conditions imposed, the granting of Conditional Use Permit No.
91-09 will not be detrimental to the peace, health and safety
and general welfare of the citizens of the City of San
Bernardino.

period of 12 months from the date of approval. However, if no
development has been initiated at the end of the 12 month
period, the application shall expire. Additional time may be
approved upon request of the applicant prior to expiration of

Whenever refuse bins are located within or adjacent to a

COMPOSITE DEVELOPMENT PLAN
A Composite Development Plan (COP) shall be filed with the
Engineering, Planning, and Building and Safety Departments
prior to Final or Parcel Map processing by the City pursuant
to Ordinance No. MC-592. The CDP shall provide additional
survey and map information including, but not limited to,
building criteria (e.g. setbacks), flood control criteria,
seismic and geological criteria, environmental criteria and
easements of record. The CDP shall be labeled with the title
"Composite Development Plan", and contain a section entitled
"Composite Development Plan Notes". The applicant shall have
listed under the CDP Notes section the following conditions or
mitigating measures required for the development of the
subject property:
8. The property owner shall sign a covenant running with the land
agreeing that if the required landscaping is not maintained,
the City may enter on the the property and install and main-
tain the required landscapinq and may lien the property for
the costs. The covenant shall be signed and recorded with the

B) Hollow metal doors shall be constructed a minimum
equivalent to sixteen U.S. gauge steel and have suf-
ficient reinforcement to maintain the designed thick-
ness of the door when any locking device is installed
such as reinforcement being able to restrict collapsing

Except when double cylinder deadbolts are utilized, any
glass utilized within 40" of any door locking mechanism
shall consist of laminated glass, tempered glass, wired

All swinging exterior wood and steel doors shall be equipped

A) A single or double door shall be equipped with a double
or single deadbolt. The bolt shall have a minimum pro-
jection of I" and be constructed so as to repel cutting
tool attack. No double cylinder deadbolt locks shall

B) The deadbolt shall have an embedment of at least I"
into the strike receivin, the projected bolt. The
cylinder shall have a cylinder guard, a minimum of five
pin tumblers, and shall be connected to the inner por-
tion of the lock by connecting screws of at least 1/4"
in diameter. The recommendation does not apply when
panic hardware is required or an equivalent device is
approved by the Building Code.
C) The strike plate shall be a minimum of 3" in height and
shall be secured to the jamb with a minimum of four
2-1/2" screws.

NOTE TO APPLICANT: Where separate Engineering plans are required,
the applicant is responsible for submitting the Engineering plans
directly to the Engineering Division. They may be submitted prior
to submittal of Building Plans.
Drainage and Flood Control
All necessary drainage and flood control measures shall be
subject to requirements of the City Engineer; which may be based
in part on the recommendations of the San Bernardino Flood
Control District. The developer's Engineer shall furnish all
necessary data relating to drainage and flood control.
A local drainage study will be required for the prOject. Any
drainage improvements, structures or storm drains needed to
mitigate downstream impacts or protect the development shall be
designed and constructed at the developer's expense, and
right-of-way dedicated as necessary.
- The development is located within Zone A on the Federal Insurance
Rate Maps; therefore, a Special' Flood Hazard Area Permit issued

shall be erected and maintained within the setback along the above

INVESTIGATION:
On 2/1191. I. Det. Diaz. received the investigation for a Conditional
Use Permit (CUP #91-09) which had been submitted by Basem Bashir
for a premise to premise transfer of a Type 21 off-sale general ABC
license from the WC Villa Market. located at 1598 W. Baseline to
Jimmy's Food Store. located at 1620 W. Baseline. San Bernardino.
Basem Bashir was asked by the City of San Bernardino to relocate
his business from 1598 W. Baseline. due to a City of San Bernardino
Development Department project planned for that site.
Mr. Bashir made an agreement with his brother. Subhy Bashir. who
owned Jimmy's Food Store. 1620 W. Baseline. to purchase the business
from him and transfer his Type 21. ABC License to that location.
at which time Subhy Bashir would surrender his Type 20 ABC license
which is currently in effect at that location. Basem Bashir would
be the sole owner and manager of the business and would maintain
the same business name of Jimmy's Food Store. The nature of this
business will be an existing grocery store, located in a existing
retail center. The proposed business will sell groceries. food items.
beverages and will include the off site sale of beer. wine and
distilled spirits.
The business will have two part time and one full time employee in
addition to the applicant who will operate the business. The proposed
business hours are 0800 to 2300 hours. 7 days a week. Mr. Bashir
advised that the business operation will remain the same except for
the added sales of distilled spirits.
On 3/6/91. I spoke to ABC Investigator Barbara Lyons. who advised
me that she has not received any letters of protest regarding the
application and has spoke to the school Principal Edwin Dean at Martin
Luther King Elementary School. which is located adjacent to the retail
center regarding the business. She advised me that Mr. Dean did
not have any opposition to the proposed business.

On 2/4/91, a notification form regarding the proposed business was
sent to Area Commander Lt. R. Curtis. I later received a response
from Lt. Curtis, indicating that he had no opposition to the proposed
business.
POLICE DEPARTMENT RECOMMENDATIONS:
The premise to premise transfer of a Type 21 off-sale general ABC
License from 1598 W. Baseline across the street to an existing retail
center at 1620 W. Baseline, was necessary to allow for the development
of a large shopping center project by the City of San Bernardino,
on the northeast corner of Baseline and Medical Center Drive. This
change of license location to an existing grocery market will not
adversely change or have an adverse effect on the surrounding
community. Based on the aforementioned investigation the San Bernar-
dino Police Department recommends approval of Conditional Use Permit
#91-09.

Dear Mayor Holcomb & Council Members:
This letter is addressed to you concerning the sale of all forms
of alcohol for off-site consumption if the business is located with-
in lrOOO feet of a public school.
On May 18, 1991 the Official Board of St. Paul A.M.E. Churchr
address listed above, voted in opposition to the proposed Conditional
Use Permit #91-09. This permit would allow the sale of beer, wine,
and distilleaspTrits from an existing market that is located in the
proximity (10 - 15 Feet) of Martin Luther King, Jr. Middle School.
As we look forward in 1991 to the growth of our community, the
church must make sure that the best interest of the community, and
especially our school children, is the prime issue of the city.

Dear Mayor Holcomb:
In the near future a hearing for an awlkation for an alcoholic beverage license
for a store located at 1620 W. Baseline street, San Bernardino, will be coming
before you am the city Council m=mbers by awlicant Basem Basair. 'Ihe site is
inunediately adjacent to Dr. Martin Illther King, Jr., Middle School. We have
successfully owosed the expansion of the lioensing in the past am need to
repeat our opposition to this awlication. Unfortunately, the school district
was never properly informed by the Department of Alcoholic Beverage Control or
by any other agency regarding this awlication.
In order to make krIcMn our concerns about alcoholic beverage licensing am
consumption, the Board of Education, at its May 21, 1991, meeting adopted the
attached policy. We are respectfully requesting that the city of San Bernardino
deny the W. Baseline street applicant's appeal am in addition, provide
infonnation about future applications for alcoholic beverage licenses.
We strongly believe that, for the protection of our students am to continue to
provide a wholesane erwironmental corrlition near schools, that we need to
actively solicit your assistance.

Policy
Alcoholic Beveraqe Licensinq and Consumption
with increasing evidence that consumption of alcoholic beverages
is a significant health hazard and that business establishments
which sell alcoholic beverages near a school create special
problems for the District's schools and children, it shall be the
policy of the Board of Education of the San Bernardino city
Unified School District to:
1. diligently teach students about the health hazards of
alcoholic beverage consumption;
2. fully enforce the laws that prohibit the possession
and/or consumption of alcoholic beverages on School
District property (Business and Professional Code
25608); and
3. vigorously convey, to all approving authorities of
liquor licenses, the District's opposition to the
issuance of any alcoholic beverage license to business
establishments that are located less than one thousand
(1,000) feet from an existing District school or from a
District-owned site that is proposed for a future
school.
