No.1 IAcct.Descriotionl Finance: ~ncil Notes: A___-'_ .&_ ,. po ~lTY'OF SAN BER&DINO - REQUEST .QR COUNCIL ACTION t . , STAFF REPORT The proposed increase in the residential and commercial refuse collection fees have been recommended to offset the 24% increase in tipping (dumping) fees which was approved by the County Board of Supervisors effective 7/1/91. The Department of Public Services has budgeted $4,700,000 for County dumping charges for both the commercial and residential refuse sections. This represents an increase of 39% over last year's budget. The tipping fees are a pass through payment to the County for the estimated 161,000 tons of solid waste which are projected to be dumped at County landfill sites during the next fiscal year. The proposed increase also reflects increased tonnage taken to the landfills, which is a result of residential and business growth within the City. As noted on the attached fund balance statement, the estimated revenues using the existing refuse fee structure as a base will generate approximately $10,300,000 in fiscal year 91-92. Estimated expenditures are $12,267.919. Assuming no refuse rate increase, the estimated deficit fund balance as of June 30, 1992 will be $1,492,623. The proposed refuse rate increase of 18.1% for all single- family collection, multiple dwelling and mobile home parks, as well as a commercial rate increase of $ .70 per cubic yard will collectively generate- approximately $1,596,000 in additional revenue. This will offset the projected deficit fund balance of $1,492,623 assuming collection projections remain constant. The estimated fund balance on June 30, 1992 with the rate increase will be $103,377. RESOLUTION OF THE CITY OF SAN BERNARDINO FIXING AND DETERMINING THE FEES AND CHARGES TO BE CHARGED FROM THE COLLEC- TION AND DISPOSAL OF REFUSE, AND REPEALING RESOLUTION NO. 90-244 AND AMENDMENTS THERETO, AND PROVISIONS FOR AUTOMATED RESIDENTIAL REFUSE COLLECTION. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The fees and charges set forth herein shall apply to refuse collection services provided by the City. SECTION 2. A minimum fifty dollar ($50.00) deposit shall be required for each new commercial refuse account. Said deposit must be paid prior to the City commencing refuse collection service. This deposit shall be retained by the City and applied to any closing bill upon termination of service. Any excess amount shall be refunded. SECTION 3. ~gU~ctj.9!Ul!l~__Pj!l'pQUl of Refuse Sinqle Familv Residences. For collection and disposal of refuse, the owner or authorized agent, of any single-family residential premises, or portions, thereof, located within the territorial limits of the City of San Bernardino, shall pay the fOllowing fee: $13.00 per month for regular twice per week curbside or alley service. $13.00 per month for two (2) times per week automated refuse service plus $9.00 per month for each additional ninety (90) gallon automated container requested. City is to provide each residence with one (1) ninety (90) gallon container for automated collection only. Service is implemented for approximately 12,000 single-family dwellings within the incorporated limits of the City of San Bernardino. The specific routes are on file in the Department of Public Services. SECTION 4. Colj~~!jon and DisPQ~~j_Qf Refuse - Multiple P~~lljD9~~__~p~rtments, Etc. (a) When the refuse collection is performed by means of bins and City automatic loading equipment the monthly fee shall be as follows for each collection per week. A monthly rental fee shall be Charged for the use of City-owned bins and shall be in addition to the collection and disposal fee. (b) All fees pursuant to this Section shall be reviewed periodically and, on the basis of findings, monthly fees shall be adjusted to maintain conformance with the fee schedule set forth in Subsection (a) above, except that monthly fees shall not be adjusted in relation to temporary variations of refuse due to seasonal factors, where such variations from the average do not extend beyond a three-month period. 5-30-90 3 J 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 o o (c) When a City-owned bin is requested for use on a temporary basis a special delivery charge of fifteen dollars ($15.00) shall be made for each such bin, in addition to the regular monthly bin rental feel said monthly rental fee shall be prorated for the period of such use, in increments of not less than one (1) week. A service fee equal to twenty-five percent (25%) of the regular monthly collection and disposal fee for the size of bins so-utilized shall be charged for each time the bin is serviced. SECTION 7. (b) In the event the City is required to pay a tipping charge for weight in excess of the above tonnage schedule, that charge shall be a debt of the customer based on a tipping fee at the rate of twenty-nine and twenty-one cents ($29.21) per ton and shall be added to the base fee due the City. (c) Removal of tires shall be at the rate of seventy-eight dollars and six cents ($78.06) per ton Disposal Fee plus forty dollars ($40.00) Service Charge. SECTION 9. The Director of Public Services, upon request, may provide for the special collection and removal of refuse from any place or premises at any time (.Specials.), in addition to or beyond the regular collection service schedule, or in a manner different from normal collection practice and procedures. All fees and charges set forth in this resolu- tion shall be collected monthly. SECTION 11. Any service for the collection and disposal of refuse as set forth in this resolution may be discontinued by the Director of Public Services if any fees or charges, as levied herein, are not paid within ninety (90) days from the date said assessment is billed. SECTION 12. The Mayor and Cornmon Council may exempt from the fee provisions and charges of this resolution certain non- profit events in the public interest. The exemption shall be subject to any conditions imposed by the Director of Public Services. SECTION 13. The Director of Public Services may provide collection and disposal service without charge in emergency situations and when, in the opinion of the Director, such action is necessary to correct fire hazards, or other conditions which present an imminent threat to health and safety. SECTION 14.
