STAFF REPORT
A request was received by this office to vacate the subject North/South alley.
fro. Dr. J. steve Brodie. Since this alley affects 33 properties in the area a
preU.inary survey was sent to all adjoining property owners. We received 24
responses fra owners wanting the alley vacated. 3 negative responses, 1 letter
was returned and five owners did not respond.
On 12-17-90, authorization was given to proceed with the proposed vacation. and
Plan No. 8339 was approved.
All of the interested City Departaents and utility Co~ies were notified
of the proposal on 04-05-91. with a reply due by 05-03-91. The responses are
attached for your infol'lllltion. No reservations of ease.ents were requested. by
City departments or by public utilities.
On 05-13-91. a Notice of Exemption was filed with the County Board of Supervisors
and a finding of consistency with the General Plan was IIIlde.
The re_ining fee of $375.00 has been paid and it is reco_ended that favorable
consideration be given to the requested vacation. The Resolution of Intention.
which sets a protest date of 07-01-91 has been attached hereto for your action
also.
Upon the approval of said Resolution. all adjacent property owners will be
notified by _il of the hearing date.

RESOLUTION OF TIlE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
TO ORDER TIlE VACATION OF TIlE NORTH/SOUTH ALLEY LYING BETWEEN LYNWOOD DRIVE
AND MARSHALL BOULEVARD AND BETWEEN MOUNTAIN AVENUE AND SANCHEZ STREET.
BE IT RESOLVED BY TIlE MAYOR AND COMMON COUNCIL OF TIlE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Co_on Council of the City of San
Bernardino hereby declare their intention to order the vacation of the
North/South alley lying between Lynwood Drive and Marshall Avenue and
between Mountain Avenue and Sanchez Street. described as follows:
The East 10 feet of the West 150 feet of Lot 4 of Block
20 of the Orange Grove Tract as per plat thereof recorded
in Book 11 of Maps, Page 14. in the office of the San
Bernardino County Recorder.
13 SECTION 2. That the Mayor and Co.on Council of the City of San
14 Bernardi~, in vacating the above described alley, elect to proceed under
15 and in accordance with the provisions of the "Public Streets. Highways
16 and Services Vacation Law", being Division 9, Part 3, of the streets and
17 Highways Code of the State of California.
18 SECTION 3. That the hour of 10:00 A.M. on the 1st day of July,
19 1991. in the Council Chllllber of the City Hall. San Bernardino, California,
20 be. and the slllle hereby is fixed as the tiae and place when and where all
21 persons interested in or objecting to the proposed vacation allY appear
22 before said Kayor and Co.on Council and offer evidence in relation thereto.
23 For further particulars as to the proposed vacation of the hereinbefore
24 described alley, reference is allde to that IIllp aarked "Plan No. 8339"
25 approved Decellber 17. 1990, on file in the office of the City Clerk of said
26 City.

SECTION 4.
That the City Engineer of the City of San Bernardino
28 hereby is directed to cause Notices of Street Vacation to be posted as
