Resolution No. 91-30 adopted authorizing execution of
an agreement with County for development of final
construction plans.
Resolution No. 91-96 adopted creating Underground
Utility District No. 20 along 40th Street, from
Kendall Drive to Palm Drive.

Recommended motion:
1) That the plans for widening 40th Street, from Third Avenue to
Cottage Drive, in accordance with Plan No. 8433, be approved: and
the Director of Public Works/City Engineer be authorized to
advertise for bids.
That the transfer of $21,500, from Account No. 250-670-57483,
"Tippecanoe Avenue - Redlands Boulevard to Victoria Avenue," tb
Account No. 250-670-57478, "40th Street - Fill-in Sections of Curb

Plans for widening the south side of 40th Street, from
Third Avenue to Cottage Drive, have been prepared by the Engi-
neering Division, and the project is ready to be advertised for
bids. The project consists of installing curb and gutter, and
in-fill paving, adjacent to two parcels and the Flood Control
Basin, from the west boundary to Cottage Drive, in order to
provide two continuous eastbound traffic lanes.
The owners of the two parcels have dedicated the
necessary additional right-of-way, and the Flood Control
District has verbally indicated that they will sell the 22 feet,
between the existing street right-of-way line and their fence,
for the amount of $4,200. This will provide a parkway of 6
feet, which is proposed to be landscaped under our streetscape
beautification program.
Underground Utility District No. 20 was created on 3-18-
91. The various utility companies that have overhead utilities
along this section of 40th Street are designing their under-
ground structures. Installation of these facilities will not be
completed for at least a year. The major overhead lines are
located on the north side of 40th Street.
The City and County have entered into a Cooperative
Agreement relative to preparation of plans and acquisition of
the necessary additional right-of-way. Acquisition of the
additional right-of-way is expected to take up to a year.
The project for widening 40th Street, between Third
Avenue and Acre Lane, will necessarily be delayed for at least a
year, in order to allow for acquisition of right-of-way and
removal of overhead utility facilities. However, the south side
of 40th Street, from Third Avenue to Cottage Drive, can be
widened at this time.

An amount of $75,000 has been allocated, under Account
No. 250-670-57478, to finance the cost incurred for this
widening. Supplemental funds in the amount of $21,500 will,
therefore, be needed to fully finance the total estimated
project cost. We recommend that $21,500 be transferred from
Account No. 250-670-57483, "Tippecanoe - Redlands Boulevard to
Victoria Avenue," to Account No. 250-670-57478, "40th Street,
Fill-in Sections of Curb and Gutter."
A Notice of Exemption from the provisions of the
California Environmental Quality Act will be filed.
We recommend that the plans be approved and authorization
granted to advertise for bids.
URGENCY CLAUSE:
An application for development has been submitted on one of the
parcels that voluntarily dedicated the additional right-of-way.
Installation of the curbs and gutters adjacent to this parcel
needs to be done as soon as possible, in order to avoid conflict
with the proposed development.
