Synopsis of Previous Council action:
09-22-86 --- Central City South Overlay District and Change of Zone No. 86-22
considered.
02-02-87 --- City Engineer and City Clerk authorized to proceed with the
establishment of an assessment district.
Recommended motion:
That the appeal by S & A Properties, of the requirement for undergrounding
util ities within the SIMA Project at Mill Street and "G" Street, Parcel Map No.
9506, be set for hearing before the Mayor and Common Council on Tuesday, September
8, 1987, at 10:00 a.m.

STAFF REPORT
Parcel Map No. 9506 was approved by the Planning Commission on
11-05-85. The following standard requirement was included in the Conditions
of Approval:
"6. All utility lines shall be installed underground subject to
exceptions approved by the Planning Department and the City
Engineer."
The developers were requested to defer processing this project, until
a determination was made on the Central City South Project. They agreed to
this request. After a decision had been made to pursue the Central City South
Project, the developers submitted a revised parcel map. This revised map was
based upon "G" Street being re-aligned, in accordance with the conceptual plan
for Central City South.
At the Planning Commission meeting of 7-22-86, the application for
revised Parcel Map No. 9506 was approved. Included in the Conditions of
Approval were the following items:
"5. All utilities, including the transmission lines less than 66 kv
and all distribution 1 ines, shall be underground."
"8. All conditions and standard requirements contained in the origi-
nal approval of Parcel Map No. 9506 shall be applicable."
A letter of appeal, dated 8-05-87 has been submitted by S & A
Properties. This appeal is based upon their impression that undergrounding
of utilities was not required. A copy of this letter is attached for refer-
ence.
The developers secured an estimate of about $9,000 for relocating the
poles, while the estimate for undergrounding is $413,000. Since this cost is
considered sufficient to render the project economically unfeasible, the
developers are requesting a temporary exemption of the undergrounding require-
ment. The overhead facilities would be undergrounded under an assessment
district established by the City. Participation in the district will be
required by CC & R's on each parcel.
Time is of the essence, since construction of the buildings is nearing
completion and will be ready for Certificates of Occupancy in the near future.
We recommend that the appeal be referred to the Legislative Review
Committee for a recommendation.
URGENCY CLAUSE:
A decision needs to be reached as soon as possible, since the
buildings are nearing completion.
