STAFF REPORT
Subject:
Authorization to implement a "Residential Parking Permit" Program on the residential streets
located in the residential tract known as the Foothill Villas Estates (Tract No. 10260).
Background:
The City has received numerous complaints from the residents of the Foothill Villas Estates
(Tract No. 10260) relative to parties in their neighborhood that disturb the peace. The Foothill
Villas Estates is a relatively new tract of homes located in the foothills north of Northpark
Boulevard and is located approximately 2 1/2 miles east of California State University San
Bernardino. There are several sorority/fraternity houses located within this neighborhood. The
residents complain that the sorority/fraternity houses are constantly having parties that often
last late into the night disrupting the neighborhood. In addition, the increase in the number of
vehicles parked in this residential neighborhood creates health and safety issues. Driveways are
blocked by parked cars and sight visibility is restricted. The residents feel that implementation
of residential parking permit program will help alleviate the situation.
A "Residential Parking Permit" program basically entails implementing a "No Parking Except
by Permit" zone where residents displaying a permit/placard would be exempt from the
parking prohibition. In this neighborhood, the problem is only during the nighttime hours.
Consequently, the residents requested that the parking prohibition only apply between the
hours of 10:00 p.m. and 6:00 a.m. The program allows for up to four permits to be issued per
residence. However, in order for this type of program to be successful, an overwhelming
amount of support is needed from the affected residents.
A petition requesting a "Residential Parking Permit" program was prepared by staff and
circulated by area residents. There are forty-six properties in this tract. Twenty-nine of the
residents signed the petition supporting the "Residential Parking Permit" program (63 percent).
In view of the support demonstrated for the proposed "Residential Parking Permit" program,
staff recommends that the attached Resolution be approved authorizing the implementation of a
"Residential Parking Permit" program on the following street segments:
• Acacia Avenue between Aries Lane and 200 feet south of Aries Lane.
• Acacia Court between 59" Street and the end of Acacia Court north of 59th Street.
• Aries Lane 59`h Street (western intersection) and 591h Street (eastern intersection).
• 591h Street between Aries Lane (western Intersection) and Aries Lane (eastern intersection).

STAFF REPORT - Continued
For each program, staff determines how many signs will be required so that there is adequate
signage to make people aware of the parking prohibition. Staff determined that 30 signs would
be required for this program.
At the May 19, 2008 Mayor and Common Council meeting, the item was continued to June 16,
2008, and staff was directed to do a noticed public hearing because support for the program by
the residents was not unanimous. A legal notice was published in The Sun and notices mailed to
all property owners and/or tenants in the affected area.
Financial Impact:
The estimated cost of$ 3,000 for the "No Parking" signs will come from Account No. 001-402-
5111 (Street Maintenance).
Recommendation:
Adopt Resolution.

7 SECTION 1: For the purpose of establishing a Residential Parking Permit
8 Program pursuant to San Bernardino Municipal Code Section 10.16.180, on residential streets
9 located within the boundaries of Tract No. 10260, Resolution No. 3985, which prohibits parking
10 upon certain designated streets or portions thereof, Section 2-3/4 is amended by adding the
11 following subsections:

Party Night @ Foothills Estates Community
The parties wo j1d begin at approximately 11:3 Op.m, Numerous cars would start
driving up and down t e street, sometimes at a high rate of speed looking for the "party
house"with loud music, loud mufflers and yelling at pas,:ing cars. This continues until
the party is over at 3:00 a.m. or 4:00 a.m. in the morning. During the party, often times
the party goers block drive ways and fire hydrants. There itre at least 4 or 5 party goers to
a car. Once they park their cars, they remain at their cars consuming beers, other alcohol
beverages, and smoking illicit substances before entering the party. They sometimes sit
on the top of car's hoo and yell at other cars. Never ono+,mindful that this is a family
orientated community. j 3efore heading into the party, beer bottle and cans are disposed of
in neighbor's front yards, and the street, Many party goeri:have relieved them (use the
bathroom)on yards and in the street. By this time the San Bernardino police have been
called and when they ar've, the music is lowered and som a party goers leave only to
return when the police leave and then the music goes up again. Some party goers have
engaged in sex intercoul se in the cars and then return to th,.,party. The very next
morning,the party goers are often found sleeping in their cars,there are massive beers
bottles and cans, along v ith plastic cups in the streets, and m neighbor's yards. Some
neighbors have broken b ers bottles in their drive ways and front yards as a result of the
neglectfiil party goers i ui ap dump their trash wherever they see fit. '
As a result of the above,the neighborhood becomes disruptived,people are
unable to sleep because the noise level which includes car alarms going;off,party
goers yelling and screaming at one another, loud music and car racing up and down the
streets, Also, there have been several fights,broken car wit Bows, and traffic accidents.

Thank you for your letter dated Nov. 16th, we appreciate your concerns and
have very seriously investigated the matter of the noise and disturbances
in the Foothill Estates community. We have spoken with the tenants at the
4 properties which we manage and have subsequently served the
appropriate Notices upon the tenants.
It is our sincere wish that all the residents of the community will be able to
enjoy the neighborhood. In order to achieve that goal, we have spoken to
each of the houses that we manage and clearly expressed the rules
regarding noise and they have all agreed to abide by those rules, which
they signed and agreed to as part of their lease. Each house was also
provided a copy of the city code as pertains to loud noise.
Our tenants have assured us that they are committed to keeping the peace
of the community and we expect to have no further problems regarding this
matter.

DEAR DEBBIE, LAST NIGHT THERE WAS A PARTY AT 477 W. ARIES LANE THAT LASTED LATE INTO
THE NIGHT. IT APPEAR THAT THERE WAS A POSSIBLE SCENIOR OF A RIOT, THERE WAS A GROUP
OF ABOUT 60 PEOPLE MOSTLY GUY THAT WERE SHOUTING , YELLING, AND CUSSING AT EACH
OTHER AT 3:00am . WHAT I FIND HARD TO BELIEVED IS THAT AT 11:OOPM THERE WAS 2 MOTORCLYE
OFFICER IN THE AREA AND THEY WERE GIVING TICKETS TO THESE PEOPLE. AT AROUND 3:30
DAYLIGHT SAVING TIME TWO OTHER OFFICER PASSED BY THIS HOME AND DID NOT DISPRED
THEM. I SAW AROUND 10 PEOPLE RUSH IN THE HOUSE WHEN THEY SAW THE OFFICERS PASSED
BY AND THEM CAME OUT WHEN THEY LEFT. YOU KNOW WHAT I ALSO FIND STRANGE THAT THEY
WHERE IN OUR MEETING LAST TUESDAY AND ARE AWARE OF THE SITUATION ABOUT PARTY. I FEEL
AFTER WHAT I OBSERVE LAST NIGHT THAT IS ONLY A MATTER OF TIME THAT SOMEONE UP HERE
WILL GET HURT OR KILLED. IT WAS THAT BAD LAST NIGHT THE WORSE THAT I"VE SEEN UP HERE. I
BELEIVED THAT THESE PEOPLE DON"T DESERVE TO BE HERE LIVING WITH US BECAUSE THEY ARE
BRING GABBAGE INTO OUR NEIGHBORHOOD. I PERSONALLY HAVE LOST RESPECT FOR THEM AND
THEIR WORD IS MEANINGLESS. THEY CAN'T BE TRUSTED TO KEEP THEIR WORD. I AM NOW
COMMITED IN GETTING OUT OF THIS NEIGHBORHOOD AND IF NEED BE WILL FILED A LAWSUIT
AGAINST THE OWNERS OF THIS HOME.

Folks....
The situation at the above location is becoming untenable for residents. For those of you not familiar with the
issue, there are approx 8 informal"Greek" homes in this small area....occupied by a number of Cal State
students. Parties, trash, grafitti and speeding vehicles have been problematic for the last 4-6 months and joint
meetings with homeowners and students have not been effective. Essentially, the students have not held up the
bargain they made with homeowners to reduce the problems. Call loads at the times these parties have been
occurring have made our response and enforcement less than satisfactory for residents.
Tony and Valerie.....what help do you need from us to establish a parking permit system similar to the one done
around Golden Valley Middle School last year? I believe homeowners in the area would support that(as I have
been told ) and that would give us another enforcement mechanism to address the problem. There are 47 homes

Lance and Brad.....continue extra patrols in the neighborhood Fridays-Sunday to provide greater police visibility.
Be sure to utilize the ExtraOrdinary Law Enforcement Services MUNI CODE to issue warnings and violation
notices. If we have a violation, pis ensure a report is prepared and send all paperwork to Sgt. Williams who will
walk the case through the city attorney and finance.
Henry....we would also like to serve Extraordinary Law Enforecment warnings to the landlords of the homes that
are causing most of the problems. By municipal code, it appears we can do that. Sgt. Williams will follow up with
you later this week on that issue.
Paul....also work on contacting all landlords in that neighborhood this week and explain to them the potiential for
them to be subject to our ExtraOrdinary Law Enforcement Munic Code.
Jarrod....Ofc Acosta has been up in that area writing cites for stop sign violations...mostly to kids visiting the
unofficial sororiety houses in that neighborhood. Can we make that traffic enforcement a daily assignment for the
traffic officers working the north end. for the next 30 days? It would be helpful if they could spend a portion of their
shift in this area each day. Pis let me know.
Chief Miler.....can we get any relief at the University level on this issue. I will forward to you the paperwork
generated from the party this weekend at 477 W. Aires Ln. Is any of this activity at student homes actionable by
Cal State Admin?
The next neighborhood meeting on will be on Tuesday April 3rd at 469 W. 59th street at 7PM. It would be nice to
have some info we can relay that would be helpful to homeowners.....any help that each of you could provide to
reduce these problems would be great. Pis keep me posted as to any other suggestions you may have regarding
these issues.

2006. The program was well attended and it appears that your neighbors are very
concerned about the neighborhood. Thank you also for volunteering to be the Captain of
your group.
Enclosed is the Neighborhood Watch Sign Placement form. Please fill the form out and
return to me in my office. I will forward this on to Tony Lugo from Traffic Engineering who
then makes arrangements to have the signs placed. Please keep me informed if you do not
received these signs within a 2-week period after submitting the form.
Also enclosed is an example of a neighborhood watch street chart. Each neighbor would
start out at Home Sweet Home and then depending on who your neighbors are from left to
right and across the street. Share as much information with your neighbors that you feel
comfortable with but remember the more information the better informed you as neighbors
will be. You can design your neighborhood anyway you want. I have a neighborhood watch
group that just uses the house numbers to identify each other. Example: Frank 415. You
may also want to add Cell Phone Numbers since many seem to use that as an easier means of
communication these days.
After your successful second meeting please contact me so that I can give you a supply of
Neighborhood Watch decals for your windows. These are not a deterrent for suspects, but
do warn that neighbors are looking out for each other. A supply will be given for only the
active members of your group.
As I explained at the meeting, please feel free to contact other agencies to be guest
speakers at your meetings. I would suggest the Mayor, his assistant, Code Enforcement,
Animal Control, Graffiti Task Force, Fire Department,your councilman neighbor, Neil Derry.

On December 4, 2006, a neighborhood watch meeting was conducted in the foothill estate residency of San
Bernardino with the owners of the property, students, and law enforcement agencies from the San Bernardino
Police Dept and the Cal State Police Department. At this meeting, the students were advised that they were to
cease loud noises and disturbances within the neighborhood. They were warned and were verbally notified as
to the consequences if they continued their actions. At this meeting, representatives of the residence of 467 W.
Aries Lane were present. Everyone agreed that there were to be no more disturbances outdoors and if they
were to have guests over in their homes, they were to keep them inside their home. Despite that on December
26, 2006, at approximately 11:30 p.m., a group of young men were playing football in the street,in front of this
property, hollering and yelling at each other. This continued until approximately 12:00 p.m.
Furthermore, cars were lined up and down in the street, people were coming and going in and out of this
property. I observed this from my window. 1 also observed the gentlemen playing football going into this home
as well. This went on until approximately 2:30 in the morning. Cars doors were opening and shutting
throughout the night. Continued nuisance went on throughout the evening. I was finally able to fall asleep at
approximately 2:30 a.m.
As of our telephone conversation yesterday, December 27, 2006, 1 have provided you with enough detail as to
what has transpired since our neighborhood watch meeting on December 4, 2006. This community is a family
community and these actions by these individuals are out of line and can no longer be tolerated. I am
requesting that you take immediate action to do whatever is necessary to resolve this matter. I am looking

Authorization to implement a "Residential Parking Permit" Program on the residential streets
located in the residential tract known as the Foothill Villas Estates (Tract no. 10260).
Background:
The City has received numerous complaints from the residents of the Foothill Villa's Estates
(Tract No. 10260) relative to parties in their neighborhood that disturb the peace. The Foothill
Villa's Estates is a relatively new tract of homes located in the foothills north of Northpark
Boulevard and is located approximately 2 %2 miles east of California State University San
Bernardino. There are several sorority/fraternity houses located within this neighborhood. The
residents complain that the sorority/fraternity houses are constantly having parties that often last
late into the night disrupting the neighborhood. In addition, the increase in the number of
vehicles parked in this residential neighborhood creates health and safety issues. Driveways are
blocked by parked cars and sight visibility is restricted. The residents feel that implementation of
residential parking permit program will help alleviate the situation.
A"Residential Parking Permit"program basically entails implementing a"No Parking Except by
Permit" zone where residents displaying a permit/placard would be exempt from the parking
prohibition. In this neighborhood, the problem is only during the nighttime hours. Consequently,
the residents requested that the parking prohibition only apply between the hours of 10:00 p.m.
and 6:00 a.m. The program allows for up to four permits to be issued per residence. However, in
order for this type of program to be successful, an overwhelming amount of support is needed
from the affected residents.
A petition requesting a "Residential Parking Permit" program was prepared by staff and
circulated by area residents. There are forty-six properties in this tract. Twenty-nine of the
residents signed the petition supporting the"Residential Parking Permit"program (63 percent).
In view of the support demonstrated for the proposed "Residential Parking Permit" program,
staff recommends that the attached Resolution be approved authorizing the implementation of a
"Residential Parking Permit"program on the following street segments:
• Acacia Avenue between Aries Lane and 200 feet south of Aries Lane.

SECTION 1: For the purpose of establishing a Residential Parking Permit

8 Program pursuant to San Bernardino Municipal Code Section 10.16.180, on residential streets
9 located within the boundaries of Tract No. 10260, Resolution No, 3985, which prohibits parking
10 upon certain designated streets or portions thereof, Section 2-3i4.is amended by adding the
