Synopsis of Previous Council action:
On August 15, 1988 and on November 20, 1988, the Mayor and Council adopted
Resolution No. 88-305 and 89-471 establishing or modifying fees for Planning
Services.
RECOMMENDED MOTION - DIRECTOR OF PLANNING , BUILDING SERVICES

That the Mayor and council close the public hearing, and that
the attached Resolution (Attachment D), establishing and
modifying fees for planning Services, be adopted.

RECOKKENDED MOTION - CITY ADMINISTRATOR
That the matter of establishing and modifying fees for
Planning services be referred to the Director of Finance in
order that an appropriate cost accounting system may be
created.

SUBJECT: Planning Division Fee schedule
Modification Resolution
REOUEST
To adopt a resolution modifying the planning Division fee
schedule and establishing new fees for planning services as
required by the adoption of the Development Code.
BACKGROUND
On November 20, 1989, the Mayor and Common council adopted
Resolution 89-471 which increased planning Services fees to a
rate that approximated the median fees throughout the Inland
Empire. Those fees will be automatically adjusted on January
1, of each year based on the Consumer Price Index of the
previous year. It is anticipated that, the Mayor and Common
council will adopt the Development Code at the end of 1990.-
The Development Code provides for some Planning services and
processes that are different from, or in addition to, the
services currently provided by the planning Division. It is
necessary to establish fees for those services at this point
in time due to the required 60 day period after adoption for
the fees to become effective.
An example of permits that will be established with the
Development Code are Development Permits. The most similar
permit to the Development Permit is a Review of Plans Permit.
All Review of Plans applications are processed through the
Development Review committee (DRC). Development Permits
differ from Review of Plans in that there will be 3 different
levels of Development permits. A Development Permit could be
approved by the Department Director (small projects), the DRC
(medium projects) or the Planning commission (large
projects). These permits require a range of fees. An
example of a new fee which needs to be established is the
Tree Removal fee. By resolution and subsequent inclusion in
the Development code, the Mayor and Common Council made a
permit mandatory when removing more than 5 trees at a site in
a 36 month period. currently there is no fee for this
permit. It is also necessary to establish processing fees
for Temporary Uses, Director Interpretations, Sign Programs,
Fence/Wall Installations, Recycling Facilities, and Antennas,
(See Table 1 "-Existing, Proposed and New Fees, Attachment B).

In addition to establishing new fees, a fee adjustment to
existing fees is recommended. The existing fee schedule
generates revenue approximately equal to 52% of the cost to
o~erate the Current planning section of the planning Divi-
s~on, (See Table 2-Development Review Service Estimated
Costs/Revenue Sources, Attachment C). The balance of the
CUrrent planning section budget and the cost of Advance
Planning is a General Fund expense. It is proposed to adjust
the fees to an amount approximately equal to the operating
cost of the CUrrent planning section. By adjusting existing
fees to the amount shown in Table 1, Existing, proposed and
New Fees (Attachment B), applicants would pay for the full
cost of Planning services rendered. This would provide
relief to the General Fund of the city. An exception to cost
recovery is proposed for the appeal fee, because it has been
the policy of the Mayor and Common Council to keep the appeal
process affordable to the residents of the city. The
proposed fee will provide about 39% recovery of the cost to
the City to process an appeal, (See Table 2-Development
Review service Estimated Costs/Revenue Sources, Attachment
C) .

RESOLUTION NO. 83-201, AND REPEALING RESOLUTION NO. 89-471,
MODIFYING FEES FOR PLANNING SERVICES AND ESTABLISHING NEW FEES
FOR PLANNING SERVICES.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor and Common Council find:
A. A hearing has been held by the Mayor and Common
council pursuant to the provisions of Government Code Section
54990, et seq., to consider the levy of new additional fees and
services charges for various services provided by the Planning
Division, which hearing was held following public notice
11 published in a newspaper of general circulation in the City of

San Bernardino.
B. None of the proposed increases or new fees exceed
the actual cost of providing such services, and for the service
which is not completely paid for by the proposed fee, the
additional expense, if any, to the City of providing the
services shall be borne by the general fund of the City of San
Bernardino.
C. The proposed fees and charges are reasonable and
necessary to enable the City of San Bernardino to more nearly
meet actual costs of providing such services.
D. The adoption of this resolution is exempt from the
California Environmental Quality Act because it approves fees
for the purpose of meeting a portion of the operating expenses
of the City planning Department, as set forth in Public
Resources Code 21080 (b) (8).

SECTION
4.
"Direct Cost
Recovery"
shall
include all
city

material costs,

direct
indirect,
and
labor
including overhead,
charged against
specific item

processed.
OVerhead
shall be calculated by adding 20 percent
(20%)
of the
total hours spent
by clerical support

received has been expended. Projects shall not be completed or
approved with money due. If additional deposit is not made by
the date specified in the notice, the project shall be deemed
withdrawn on the date specified without further action on the
part of the city of San Bernardino and without refund of any
money deposited for services already performed. Such project
may be reinstated only if the additional deposit is made within
30 days from the date project was deemed withdrawn.
SECTION 7. Refunds shall be made by the City for any
fee which was erroneously paid or collected; for any unused
deposit monies of Direct Cost Recovery Fee of Full Consultant
Cost Fee, after all charges for the project
have been
determined; or, as determined by the Director of Planning and
Building Services.
SECTION 8.
These fees (including the overhead hourly
rate charge) shall be automatically adjusted annually on
21 January 1 of each year, based on the latest available Consumer
22 Price Index increase from the prior year. The required initial
23 deposit may be adjusted as necessary by the Planning Division
24 to more accurately reflect the average mean cost of processing
25 a particular permit in a previous twelve month period.
