Reed, Di rector Dept: Planning and Building Services Date: January 24, 1991 Subject: Development Code Mayor and Common Council Meeting of February 4, 1991, 2:00 p.m. Synopsis of Previous Council action: On June 20, 1989, the Mayor and Common Council approved Resolution 89-184 to retain the firm of Jacobson and Wack to prepare the Development Code. On February 14, 1990, February 21, 1990, February 28, 1990, March 7, 1990, March 21, 1990, and April II, 1990, the Mayor and Common Council held work- shops on the Preliminary Draft of the Development Code at the Feldheym Library. In December 1990, January 1991 and February 1991, the Mayor and Common Council held workshops on the Final Draft of the Development Code. COUNCIL ACTION STAFF REPORT Subject: Adoption of the Development Code REOUEST It is requested that the Mayor and Common Council: Set the first public hearing on the adoption of the Development Code for Thursday, March 21, 1991. BACKGROUND In June 1989, after adoption of the General Plan, the Mayor and Common Council entered into an agreement with the firm of Jacobson and Wack, Inc., for the preparation of the Development Code to implement the General Plan. By the end of 1989 the City received an Administrative Draft of the Development Code. The Administrative Draft was reviewed by various city Departments and recommendations were incorporated resulting in the Preliminary Draft of the Development Code. The preliminary Draft was the subject of Mayor and Common council workshops from February 14, 1990 to April 11, 1990. Workshop recommendations were incorporated into the preliminary Draft, resulting in the Final Draft of the Development Code. The Final Draft has been reviewed through public hearings conducted by the Planning commission beginning August 28, 1990 and concluding on November 7, 1990 with a recommendation that the Mayor and Common Council adopt the proposed environmental clearance and the Final Draft of the Development Code as redlined. The Redlined Final Draft is dated 10/90. The Mayor and Common council elected to conduct workshops prior to public hearings. The draft Development Code will be further modified as a result of the workshops. That draft will be available prior to the March 21, 1991 hearing date. The staff report which contains planning Commission recommendations and explains the Final Draft will be available as required prior to the public hearing. The environmental information and recommendation will be supplied with the staff report. 75-0264 o o Adoption of the Development Code January 24, 1991 Page 2 ANALYSIS Many changes have occurred between the Administrative and Final Drafts of the Development Code. The Mayor and Common council were actively involved during the workshops held in February, March and April of 1990. Following initial public hearings at the Planning Commission, workshops for the Mayor and Common council were held from December 1990 through February 1991. The changes are the results of workshops with the Mayor and Common council, the Planning commission, the public, and special interest groups. Most changes represent the result of negotiation, compromise and concensus. Other changes include corrections of spelling and typographical errors, corrections to type style and format and additions or deletions to insure consistency among tables, charts and text. It is important to adopt the Development Code prior to the end of April, 1991. When the General Plan was adopted June 2, 1989, it was implemented by an Urgency ordinance which was set to expire June 1, 1990. The Urgency Ordinance was extended to June 1, 1991. The maximum amount of time to operate under an urgency ordinance is 24 months, therefore no further extensions can be adopted. If the Development Code is not adopted by the end of April, 1991, the effective date of the ordinance (30 days following final reading) will be after the expiration of the Urgency Ordinance. Should that occur, development regulations for the city would revert back to Titles 18 and 19 of San Bernardino Municipal Code. Many provisions of those Titles are inconsistent with the General Plan.
