RESOLUTION MODIFYING FEES FOR STAFF REPORT
USE OF BUILDINGS, SPORTS
FACILITIES, PARK AND RECREATION
FACILITIES, ALCOHOL USE PERMITS,
PARKS AND PARKING LOTS, EQUIPMENT
AND SERVICES, AND STURGES AUDITORIUM.
This office has been advised by the City Clerk that Resolu-
tion 91-8 should be rescinded and another resolution
introduced in its place to delete two of the resolution
numbers which were repealed erroneously and to enter the
correct resolution number.
Resolution 91-8 erroneously repealed Resolutions 86-408 and
88-480. These numbers were inadvertently typed in when the
actual resolution number should have been 86-480. A correct-
ed resolution is attached for approval and adoption.
Resolution 86-408 refers to an agreement between the City and
settlement of litigation and Resolution 88-480 refers to a
Joint Powers Agreement between City and Lema Linda. (See
attached Memo from City Clerk, dated January 15, 1991.)
Therefore, it is recommended that Resolution 91-8 be
rescinded and the new resolution with the corrections be
adopted.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1.
hereby find:
A. Hearing has been held by the Mayor and Common
Council pursuant to the provisions of Government Code section
54990, et seq., to consider the levy of new and additional
fees and service charges for various services provided by the
Parks, Recreation and community Services Department, and for
uses of certain buildings, facilities, and equipment, which
hearing was held following public notice published in a

services which are not completely paid for by the proposed
fees, the additional expense to the city of providing the

SECTION 2.
Policy
Public parks and recreation
buildings and swimming pools, under the jurisdiction of the
Parks, Recreation and Community Services Department, are
public property and as such are available for use by any
person

accordance with

SECTION 3. Procedure
The facilities and equipment
shall be used only for those meetings and activities pursuant
to city Municipal Code 12.80. Any person, persons, or groups
of persons desiring the use of any facilities or equipment
shall make application on forms provided by the Parks,
Recreation and Community Services Department and shall provide
such additional information as may be required to assure
compliance with city Municipal Code 12.80.
SECTION 4. Cancellations. Cancellations of meetings
and activities may occur twenty-four (24) hours prior to
scheduled use of facilities or equipment without forfeiting
any fees and/or deposits collected by the Department. In the
event of cancellation by the Department, notice will be given
as far in advance of the scheduled use as is possible under
the circumstances.

5. Civic and social groups (non-resident or
commercial).
F. Groups in Category I and 2 shall pay no fee.
G. Non-profit, youth-serving organizations located
permanently in and serving the City of San Bernardino are
those organizations whose principal purpose is to provide a
service or program to participants, generally under the age
of 18, of which at least fifty-one percent (51%) reside in
the City of San Bernardino. Groups in this classification
shall pay no fee for use of outdoor athletic facilities.
H. A non-residency surcharge of ten percent (10%)
for all facility or equipment rentals, class registration
fees and excursion fees (not to exceed $10.00 on excursions)
and a five dollar ($5.00) per non-resident surcharge for
adults sports programs and art display programs shall be
charged.
I. The Mayor and Common Council may exempt non-
profit associations and corporations organized primarily for
patriotic, civic betterment or charitable purposes or any
local civic or charitable organization from the foregoing
rates and fee schedule for the use of park and recreation
buildings and facilities upon a finding that the rental fee

would create a financial hardship jeopardizing the activity
or event planned for such use and that the activity or event
will be of unusual benefit to the residents of the City and
should be supported with public funds. The word 'local' as
used herein is defined to mean an
organization whose
membership is comprised of fifty one percent (51%) of City
residents.
J. As a condition of exemption, the Mayor and Common
Council may require that
the association, corporation,
organization or group seeking exemption perform services or
provide labor beneficial to the city or its residents.
SECTION 6. Refundable Deposit. Refundable deposits
held pursuant to this resolution may be refunded in full or
in part within fourteen (14) days after completion of the use
period. No refund shall be made until the using party or
group has secured a signed inspection and release form from
the appropriate facility manager, and delivered this executed
release form to the Parks, Recreation and Community Services
Department.
Deductions for any damages to the facility or
for clean up and repairs shall be made from the said deposit
by City.

SECTION 7. Utilization of City Employees
During
any event when a City employee or employees are required to
be present for the purposes of clean up, monitoring, etc., a
fee shall be paid equivalent to the total cost of said
employees.
SECTION 8.
Trust Fund Account
There is hereby
established a trust fund account to be designated the
"Sturges Auditorium Replacement Account."
Of the fees
established for sturges Auditorium in section 5. of this
resolution, $150.00 of the first hour operational cost, and
$28.00 of each additional hour operational cost shall be
deposited into the Sturges Auditorium Replacement Account.
SECTION 9. Repeal and Amendment of Prior Resolution
Resolutions 80-441, 86-316, 86-480, 87-111, 88-307, 89-500

Following up on our telephone conversation of this morning, I
wish to bring to your attention that action is needed to rescind
the above-referenced Resolution and introduce another Resolution
in its place.
Resolution 91-8, entitled "RESOLUTION .... MODIFYING FEES FOR USE
OF BUILDINGS, SPORTS FACILITIES, PARK AND RECREATION FACILITIES,
ALCOHOL USE PERMITS, PARKS AND PARKING LOTS, EQUIPMENT AND
SEltVICES, AND STURGES AUDITORIUM AND ESTABLISHING A TRUST FUND
ACCOUNT TO BE DESIGNATED THE ' STURGES AUDITORIUM REPLACEMENT
ACCOUNT', AND REPEALING RESOLUTIONS 80-441, 86-316, ~~l 87-
111, 88-307, 88-486 AND 89-500, AND AMENDING RESOLUTiON'il'r-201"
was adopted at the Council meeting of January 7, 1991. In the
process of updating our index of Resolutions, we have found that
Resolution 91-8 erroneously repealed Resolutions 86-408 and 88-
480.
Resolution 86-408 refers to an Agreement between the City of San
Bernardino, County of San Bernardino, Carolyn Richard, The San
Manuel Band of Mission Indians and Western Entertainment Corp.
regarding the settlement of litigation.
Resolution 88-480 refers to the Second Amendment to the Joint
powers Agreement of 1965 between the City and Loma Linda
Sanitation District.
It appears to me that these two resolutions should not have been
repealed by Resolution 91-8 and I bring this to your attention so
that action can be initiated to correct the matter. I have
discussed this with Mr. Penman and he concurs with the action
which has to be initiated by your department.
