RESOLUTION OF THE CITY OF SAN BERNARDINO SUPPORTING THE
IMPOSITION OF ALTERNATE REVENUE SOURCES SUCH AS BUSINESS LICENSE
FEES AND UTILITY USERS TAX BY THE COUNTY OF SAN BERNARDINO IN
LIEU OF IMPLEMENTING BOOKING FEES AUTHORIZED BY SB 2557.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
WHEREAS, the State Legislature balanced its budget in FY
1990-91 by underfunding counties by $800 million, and
WHEREAS, the State Legislature adopted SB 2557 which
authorized counties to enhance their revenue base by charging
cities to book prisoners as well as to administer the collection
of property taxes, and
WHEREAS, SB 2557 also authorized counties to enhance their
revenue base by imposing a utility users tax and business
license fees in unincorporated areas, and
WHEREAS, the Board of Supervisors adopted Ordinance No.
3428 on January 14, 1991, authorizing the collection of booking
fees retroactive to July 1, 1990, and
WHEREAS, the Board of Supervisors' failure to seriously
consider the imposition of a utility users tax or business
license fee in unincorporated areas as an alternative to booking
fees imposes a financial hardship on every city in the County,
and
WHEREAS, the County is providing law enforcement services
to residents in unincorporated areas, and
WHEREAS, these

services
are being

subsidized by the County General Fund, and
receiving
law

the booking fee rate, and
WHEREAS, prolonged litigation
will
only
worsen the
financial plight of San Bernardino County, now
THEREFORE, BE IT RESOLVED, that the City Council of the
City of San Bernardino does hereby urge the San Bernardino
County Board of Supervisors to take immediate steps to enact a
business license fee and utility users tax in unincorporated
areas of San Bernardino County.
BE IT FURTHER RESOLVED that the City Council of the City of
San Bernardino does hereby urge all cities in San Bernardino
County to request the Board of Supervisors to take immediate
steps to enact a business license fee and utility users tax in
unincorporated areas of San Bernardino County.
