STAFF REPORT

The Council did previoosly auth::>rize the proceedings to go fo:rward for the fonnation
of a special assessnent district to allow for the public financing of the subdivision
iroprovenents to be ronstructed within City subdivision Tracts 14184 and 14185, in two
phases, i.e., Assessnent District No. 977A and Assessnent District No. 977B. Proceed-
ings for Assessnent District No. 977A have been successfully cx:nq:>leted, and the
attached Resolutions would fonnally allow the initiation of proceedings for the seoond
tilase, i.e., Assessnent District No. 977B.
TtE developer has oonpleted the construction of the second phase of the :iIlprovements
and all ooc:urrentation has been prepared to allow the initiation of the proceedings
and the setting of the tine and place for the public tEaring. The public hearing is
proposed to I:e held on March 4, 1991. Upon the ccnclusion of the public hearing,
tonds can be sold and the prcperty owner would then be reimb.Jrsed for th::>se public
:iIlprovements previously installed in these proceedings.

RESOLUTION OF THE CITY OF SAN BERNARDINO PASSING ON
"REPORT" OF THE ENGINEER, GIVING PRELIM"NARY APPROVAL,
SETTING A TIME AND PLACE FOR PUBLIC HEARING

WHEREAS, the COMMON COUNCIL of the CIT, OF SAN BERNARDINO,
5
CALIFORNIA, has instituted proceedings for the acquisition of
6
certain publ ic works of improvement and appurtenances under
7
provisions of the "Municipal Improvement Act of 1913", being
8
Division 12 of the Streets and Highways Cede of the State of
9
California, in a special assessment district known and desig-
10
nated as ASSESSMENT DISTRICT. NO. 977B (hereinafter referred to
11
as the "Assessment District"); and,
12
WHEREAS, there has been prepared and filed with the legis la-
13
tive body a "Report" provided for in Sections 10203 and 10204 of
14
the Streets and Highways Code of the State of California, and
15
this "Report" has been presented for consideration; and,
16
WHEREAS, a Resolution of Intention for this improvement was
17
previously adopted by the legislative body; and the "Report" as
18
now pres.ented shall stand as the "Report" for the purpose of
19
subsequent proceedings hereunder.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
21
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

That the above recitals are all true and

SECTION 2.
That the "Report" of the Engineer referred to
25

A. That th'e pfans for the "as-built" improve-
mente to be made, contained in said "Report" be, and they are
hereby preliminarily approved and adopted;
B. That the Engineer's estimate of the
itemized and total costs and expenses of said "as-built" acquisi-
ticn and improvements, and of the incidental expenses in connec-
ticn therewith, contained in said "Report", be, and each of them
are hereby preliminarily approved and adopted;
C. That the diagram shoHing the Assessment
District referred to and described in said Resolution of Inten-
ticn, C!-nd also the boundaries and dimensions of the respective
subdivisions of land within said Assessment District, as the
same existed at the time of the passage of said Resolution of
Intention, each of which subdivisions have been given a separate
number upon said diagram, as contained in said "Report". be, and
it is hereby preliminarily approved and adopted;
D. That the proposed assessment upon the
several subdivisions of land in said Assessment District, in
proportion to the estimated benefits to be received by such
subdivisions, respectively, from said acquisition, and of the
incidental expenses thereof, as contained in said "Report", be,
and they are hereby preliminarily approved and adopted;
E. That; the maps and descriptions of the lands

and easements to be acquired, as contained in said "Report" be,

and the same are hereby preliminarily approved;

F.
That said "Report" shall stand as the

Engineer's "Report" for the purpose of all subsequent proceed-
ings had pursuant ~o said Resolution of Intention.

REGULAR MEETING PLACE OF THIS LEGISLATI\'E BODY, BEING THE

COUNCIL CHAMBERS, CITY HALL, ANY AND ALL PERSONS HAVING ANY

OBJECTIONS TO THE PROPOSED ACQUISITION, OR ASSESSMENT, OR EXTENT

THE ENGINEER.
PROTESTS MUST BE IN WRITING AND MUST BE DELIVERED

TO THE CITY CLERK AT OR BEFORE THE TIME SET FOR THE PUBLIC

HEARING.

SECTION 4.
That the City Clerk is hereby directed to give

Intention and of this Resolution, all in accordance with the

provisions of said Division 12.

SECTION 5.
That the City Clerk is hereby directed to give

notice of said Public Hearing and of the passage of the Resolu-
21
tion of Intention and this Resolution by causing such notice to
22
be publishe.d in accordance with Section 6066 of the Government
23
Code, in the newspaper previously designated as the newspaper
24
for all publications as required by law and as necessary for
25
completion of this Assessment District.

SECTION 6.
"hat the City Clerk is hereby directed to mail
27
notice of said Putlic Hearing and the adoption of the Resolution

of Intention and of the filing of the "Repcrt" to all persons
owning real property propos"ed to be assessed, :.:hose names and
addresses appear on the last equalized assessment roll for
county taxes prior thereto, or as known to said city Clerk, and
to all other persons as prescribed in accordance ~ith the provi-
sions of said Division 12.
SECTION 7.
That the City Clerk is hereby further directed
to file a copy of the proposed boundary map in the Office of the
County Recorder within fifteen (15) days of the adoption of the
proposed boundary map; said boundary map to be in the manner and
form as set forth in Division 4.5 of the Streets and Highways
Code of the State of California.
I HEREBY CERTIFY that the foregoing resolution was duly
