SUBJECT:
Authorization to proceed and Resolution setting a Public Hearing to create Underground Utility District No. 27,
40Th Street
BACKGROUND:
The proposed formation of Underground Utility District No. 27, located along portions of 40Th Street between
Electric Avenue and Waterman Avenue, was recommended by the Underground Utility District Committee at the
September 3,1998 meeting.
Southern California Edison Company is required by rule 20 of the Public Utilities Commission to set aside certain
portion of its revenues to finance the cost of undergrounding overhead facilities within districts established by
local agencies. Each agency is allocated a certain amount of funds based upon the total number of overhead
services within the agency's boundaries. The Underground Utility Committee reviews and designates areas
proposed for the establishment of a district.
Underground utilities improve the appearance of a street by removing a clutter of overhead utility poles and lines.
It also eliminates the hazard from lines falling to the ground, which is a result from windstorms and earthquakes
and thunderstorms.
Property owners within the district will be required to complete the undergrounding from their property lines to the
service points at their own cost. No City funds will be required for this project. A public Hearing will be
scheduled December 21, 1998 at 10:00 a.m., in the Council Chambers and all property owners within the proposed
district will be notified by mail of the proposal. There are approximately two parcels that will need to convert
their utility service from overhead to underground.

None
RECOMMENDATION:
We recommend authorization to proceed be granted and the Resolution setting public hearing be adopted.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO SETTING A PUBLIC
3 HEARING RELATIVE TO THE FORMATION OF UNDERGROUND UTILITY
DISTRICT NO. 27, GENERALLY LOCATED ALONG PORTIONS OF 40TH STREET,

WHEREAS, Chapter 13.36 of the San Bernardino Municipal Code of the City of San
6
Bernardino provides for the establishment of an underground utility district within said City
7
upon a finding by the Mayor and Common Council after a public hearing that the public
8
necessity, health, safety or welfare requires the underground installation of utilities within said
9

district; and
WHEREAS, the Underground Utilities Committee of said City has recommended the
formation of an underground utility district to include the real property described in this
resolution.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY

SECTION 1. Notice is hereby given that a public hearing will be held before the Mayor
and Common Council of the City of San Bernardino on Monday, December 21, 1998, at the
formation of Underground Utility District No. 27, located along portions of 40Th Street between
Electric Avenue and Waterman Avenue, more particularly shown on Drawing No.9893, on file
23 in the office of the City Clerk, a copy of which is attached hereto as Exhibit "A" and made a part

of this Resolution.
