Staff Report
SUBJECT:
Resolution detennining the amount of property tax revenues to be exchanged between the City of
San Bernardino and the City of Highland relative to the reorganization of a 3.62-acre parcel
located at the northerly tenninus of Applewood Street in the City of San Bernardino.
BACKGROUND:
On September 17,2007, Resolution No. 2007-381 was adopted, consenting to a reorganization
consisting of the detachment of a certain parcel of land from the City of San Bernardino sphere
of influence and city boundary and attachment to the sphere of influence and lmnexation to the
City of Highland generally located at the northerly terminus of Applewood Street in the City of
San Bernardino.
The proposed development for this property consists of five (5) residential parcels all
approximately Y.-acre each. Currently, the only way to access this property is through the City
of Highland. Various City of San Bernardino Departments have reviewed this request and
detennined that because of access, the City of Highland may be better suited for providing
service to this area (i.e. refuse, street and sidewalk maintenance, safety, etc.). A vicinity map and
a map depicting the present and proposed boundary change is attached.
Pursuant to Section 99 of the Revenue and Taxation Code, agencies affected by a change of
Jurisdictional boundaries must negotiate the re-distribution of property taxes of property within
the affected area and respond with a resolution. This must be accomplished within 60 days of
receiving a response from the Auditor-Controller relative to the existing distribution, which was'
received on April 29, 2008. A resolution making a determination of the amount of property tax
revenues to be exchanged is attached for yoUr action. This parcel generated $759 in tax revenues
to the City of San Bernardino for the 2007-08 fiscal year; As shown on the Exhibit" A" of the
resolution, this amount of$759 will be transferred to the City of Highland.
FINANCIAL IMPACT:
The City will no longer receive property tax revenues of$759. However, the City will no longer
be responsible for any services to the area being detached.

3 RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THE
AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND

RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFCO 3096
5 FOR THE AREA GENERALLY LOCATED AT THE NORTHERLY TERMINUS OF
APPLEWOOD STREET IN THE CITY OF SAN BERNARDINO.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council of the City of San Bernardino
10 hereby find and determine that:
A. Pursuant to Section 99 of the Revenue and Taxation Code, prior to the
issuance of a certificate of filing by the Local Agency Formation Commission Executive Officer,
the governing bodies of all local agencies whose service area or service responsibilities will be
altered by a proposed jurisdictional change shall negotiate and determine by resolution the
amount of property tax revenues to be exchanged between and among such local agencies.
B. The Mayor and Common Council of the City of San Bernardino and the
Mayor and Council of the City of Highland have determined the amount of property tax revenues
to be exchanged as a result of jurisdictional change described by LAFCO 3096, reorganization
between the City of San Bernardino and the City of Highland, generally located at the northern
terminus of Applewood Street and Church Street.
SECTION 2. The amount of tax revenue to be exchanged between the City of San
Bernardino and the City of Highland resulting from the above jurisdictional change is shown on
Exhibit "A", attached hereto and incorporated herein by reference and is hereby approved and

SECTION 3. The annual tax increment generated in the areas subject to the jurisdictional
change and attributable to the local agencies whose service area or service responsibilities will be
altered by the proposed jurisdictional change shall be allocated in the future years pursuant to the
provisions of Section 98 of the Revenue and Taxation Code.
SECTION 4. The City Clerk of the City of San Bernardino is hereby directed to certify
to the passage of this resolution and to cause a certified copy to be filed with the Executive
Officer of the Local Agency Formation Commission of the County of San Bernardino.
