Synopsis of Previous Council action:
July 18, 1988 -- Resolution No. 88-272 approved awarding a contract
to Haaker Equipment Company for the furnishing
and delivery of 3 refuse trucks.
Recommended motion:
That the lease/purchase of 4 new refuse trucks be authorized
from Haaker Bquipment Company: utilizing the previous low bid,
and that the City Attorney be directed to prepare the necessary
resolution awarding the contract.

Although the purchasing ordinance has established a formal
contract procedure for purchases greater than $25,000,
Municipal Code Section 3.04.010 (B)2 allows the City to
purchase equipment from a vendor provided the bid award
occurred within one year of the City issuance of a purchase
order.
Formal contract procedures were followed for 3 automated
side-loading refuse trucks which were purchased in July 1988.
The Public Services Director in conjunction with the
Purchasing Agent and the Fleet Manager developed the
appropriate bid specifications (Bid No. F-88-15) and bids
were publicly opened and declared on May 11, 1988. The
successful bidder was the Haaker Equipment Company which bid
$342,129.84 for the 3 refuse trucks. Resolution No. 88-272
dated July 18, 1988 awarded the contract for the furnishing
and delivery of 3 automated refuse trucks. Attached is a
letter from the Haaker Equipment Company indicating that they
will furnish 4 more automated refuse trucks at the same unit
price quoted in bid no. F-89-21. The total contract price
for each of these refuse trucks will be $108,748 plus sales
tax.
As you know, the decision was made at the June 19, 1989
Council meeting to implement twice per week automated refuse
collection. Implementation of this system will require
additional automated refuse trucks. Approval of the purchase
of the 4 automated refuse units at this time will expedite
delivery of these vehicles. The delivery date is anticipated
to be 120 days from notification to proceed.
The Refuse Division budget for fiscal year 1989/90 includes
approximately $160,000 for lease/purchase financing for the
refuse t+ucks. The lease/purchase financing for the refuse
trucks will be coordinated by the Purchasing Agent and
submitted to the Mayor and Council for approval at a later
date.

Dear Mr. Merino:
Haaker Equipment Company is pleased to extend an option to the City of San
Bernardino to purchase four more units on the City Bid No. E-8815. The only
differnce in the unit will be in the model year of the truck chassis, a 1990
peterbuilt. This additional unit option is extended only to the City of San
Bernardino. No additional units can be ordered on this contract from the City
of San Bernardino or any other agency.
The contract price will be per your Purchase Order No. 90327 in the amount of
$107,588.00 per unit plus the additions of the modification from the 33 to the
36 cubic yard tail gate assembly at $535.00 each. The total contract price will
be $108,748.00 per machine plus sales tax.
Again we are pleased to offer this extension to the City of San Bernardino. If

RESOLUTION NO. 88-272
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO HAAKER EQUIPMENT COMPANY FOR THE FURNISHING AND
DELIVERY OF THE AUTOMATED REFUSE TRUCKS (3 EACH), IN ACCORDANCE
WITH SPECIFICATION F-88-15.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
That Haaker Equipment Co. is the lowest and
best bidder for the furnishing and delivering of Automated Refuse
Trucks (3 each), in accordance with specification F-88-15 for a
total amount of $342,129.84 pursuant to this determination, the
Purchasing Agent is hereby authorized and directed to issue a
purchase order for said Automated Refuse Trucks (3 each) to said
lowest and best bidder; such purchase order shall include (1) a
term that the City shall have at least 90 days from the date of
acceptance of the bid to arrange financing for the equipment;
and (2) a term that the purchase order is contingent upon the
City obtaining financing that is adequate in the City's sole
determination; such award shall only be effective upon the
issuance of a purchase order by the Purchasing Agent; and all
other bids therefor are hereby rejected.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a
