Subject:
Inland Regional Center - Request for Waiver/Refund of Fees.
Background:
On November 5, 2007, the Mayor and Common Council held a Tax and Equity Fiscal
Responsibility Act (TEFRA) for the California Housing Foundation Development (Inland
Regional Center Project) public hearing and adopted Resolution No. 2007-449 approving the
issuance of Revenue Bonds by the California Statewide Communities Development Authority
for the benefit of California Housing Foundation on behalf of the Inland Regional Center.
Inland Regional Center (IRC) proposes to construct a three building, 185,000 square foot office
complex at the Waterman Business Park (the former dairy on South Waterman Avenue). As a
charitable non-profit organization, they are requesting refunds and waivers of approximately
$578,194 in development-related fees. The Ways and Means Committee considered the request
at their meeting of May 7, 2008 and did not support the request. Instead, the Committee referred
the matter to the Redevelopment Committee for consideration. The project may be eligible for
other funding sources available to encourage economic development and job retention. Please
refer to the attached memorandum for a more complete discussion.
Financial Impact:
If the Mayor and Common Council were to support the request for refunds and waivers, there
would be an approximately $377,482 loss of funding collected for local infrastructure, facilities,
and services and an approximately $143,258 loss of funding collected for permit and inspection
servIces.
Recommendation:
That the Mayor and Common Council refer the matter to the Redevelopment Committee.

The Law Offices of Fullerton, Lemann, Schaefer & Dominick, LLP have submitted a request
(Exhibit A) on behalf of California Housing Foundation (CHF) for a waiver and refund of all
City fees applicable to the construction of a new 185,000 square foot office complex within the
Waterman Business Park. CHF is a charitable non-profit organization that provides services to
the developmentally disabled as the Inland Regional Center (IRC). As such, CHF is eligible to
request a fee waiver or refund, pursuant to Municipal Code Section 3.13.030.
The IRC currently leases office space in the Tri-City Corporate Center, and employs
approximately 600 people. CHF recently decided to build and lease three buildings in the
Waterman Business Park as a new headquarters for IRC.
Exhibit A, the refund and waiver request, contains an incomplete accounting of fees totaling
$191,960.70, identified as paid or due to be paid in the future. This total includes $1,926.75 that
was actually paid to San Bernardino County, as well as a double-counting of$15,473.04 in plan
check fees with the original receipts and the engineer's reimbursement invoice. The City cannot
refund fees to IRC that were paid by a second party.
Exhibit B details all fees paid and remaining due for the IRC project. Approximately 50% of all
fees applicable to the IRC project should not be considered for refund or waiver. These include
fees paid to outside consultants for plan checking, fees paid to the County and State for filing of
environmental documents, and the Regional Circulation System development impact fee, which
cannot be waived, pursuant to Municipal Code Section 3.27.170.
Of the $578,194.25 staff identified as eligible for consideration of a refund or waiver,
$377,482.16 would be impact fees for local infrastructure, facilities and services. The remaining
$143,258.31 represents a potential loss of General Fund permit and inspection fee revenue that
would impact the budget and service level of the Development Services Department. Staff does
not recommend granting any fee waiver or refund that would impact General Fund revenues.

A copy of an article published in The Business Press is attached to the fee refund and waiver
request (Exhibit A) to demonstrate the benefits of the IRC project to the City. The primary
benefit cited in the article is the retention of 600 jobs in the City. The benefits of building and
occupying a substantial portion of the Waterman Business Park and ancillary benefits of
maintaining the daytime office population in the area are also noted.
An option the Committee may consider would be to refer the matter to the RDA Committee. The
project may be eligible for other funding sources available to encourage economic development
and job retention.

2. IRS and Franchise Tax Board dctennination letter verifying that CHF is a charitable non-

To date we understand that CHF has paid or will pay in the very near future fees in the approximate
amount of $191.960.70 (attached are copies of invoices and receipts of these charges). We also
believe that there may be more city fees assessed on this project in the future. Therefore, it is
respectfully requested that any applicable city fees that have been paid or any future city fees due be
refunded or waived. These savings will greatly assist the very tight budget constraints of this project.
Please provide this information to the Mayor and Common Council for consideration. Please contact
