CHICKEN ADDITION AT 477 SOUTH "E" STREET
REOUEST
The applicant, Carlson Design and Construction Company
representing Collins Food International, requests-that the
Mayor and Council reconsider and approve the application for
the construction of an addition to an existing drive-through
restaurant (Kentucky Fired Chicken) with a variance regarding
the required parking.
BACKGROUND
Conditional Use Permit No. 89-16 is an application to con-
struct a 418 square foot addition to an existing 1,500 square
foot drive-through restaurant and approval of a variance from
Code sections 19.56.020 regarding required parking.
The restaurant is located on the east side of "E" Street
north of Mill Street at 477 South "E" Street.
The proposal is consistent with the General Plan adopted on
June 2, 1989, in that the use of a drive-through restaurant
is allowed in the CG-1, General commercial-One Land Use
Designation. The proposed addition is exempt from the
provisions of the California Environmental Quality Act
(CEQA) .

The site is located on "E" Street about 100 feet north of
Mill Street. These are both well traveled streets with "E"
Street having over 18,000 trips per day and Mill Street
having over 21,000 trips per day. There is nothing ex-
ceptional about the size, shape, topography or circumstances
of the site which is not applicable to other parcels in the
vicinity. At the Development Review Committee meeting of May
4, 1989, there was discussion of the potential for on-sight
traffic congestion resulting from inadequate parking. The
proposal provides the 29 spaces which is three short of the
required minimum.

City's parking requirements for drive-through restaurants is
too high. Their evidence is a sampling of other cities
requirements in Southern California, which generally have a
requirement of one parking space for every 100 square feet of
gross floor area. The City of San Bernardino's requirement
is one space for every 60 square feet of gross floor area. In
addition, they have provided evidence that the peak parking
needs of the Kentucky Fried Chicken with the new addition
would only be around seven spaces.
The general policy behind parking standard requirements is to
provide a sufficient number of parking spaces to accommodate
the number of vehicles that ordinarily are likely to be
attracted to the development in question. It is not desired
to have a development with inadequate parking area or parking
area far in excess of its needs. The former situation may
lead to traffic congestion or parking violations on adjacent
streets. The latter situation wastes money as well as space
that could more desirably be used for valuable development or
landscaping. In this case evidence has been presented to
indicate that the City's standard is erroneous, and that the
intent of the standard has been achieved. This evidence was
not available to the Planning commission on June 6, 1989,
when they voted 5 to 0 to deny the Conditional Use Permit
and variance request.
MAYOR AND COUNCIL OPTIONS:
The Mayor and Council may deny the appeal and deny
Conditional Use Permit 89-16 with variance as per Planning
commission's recommendation; or uphold the appeal and approve
Conditional Use Permit 89-16 with variance, subject to the
appropriate revisions of Findings of Fact, Conditional Use
Permit findings and variance findings.

We hereby appeal the decision of the Planning Commission rendered on 6/6/89 for
the above-referenced project. Our check for the amount of $75 is enclosed. Our
appeal is based upon the following:
1. Parking requirements for the project are 1 space per 60 sq.ft. of gross floor area
(1882 T 60 = 31.36 or 32 spaces). This code has been in place prior to the pro-
liferation of drive-thru restaurants. The code was originally created for drive-
in restaurants where customers park and are served food in their cars for con-
sumption on the premises. Cars could be on the premises from 30-60 minutes or
longer and, as such, parking requirements were high. Drive-thru restaurants are a
different type of business. They are a convenience for customers who do not
wish or are unable to leave their cars to purchase food for consumption off
premises.
We have enclosed a random sampling of parking requirements for other cities
located in Southern California. This sampling suggests that many other cities
have updated their requirements for drive-thru restaurants to reflect the fact that
. restaurants with drive-thru facilities derive approximately 50% of their total sales
from the drive-thru, and, as such, their onsite parking needs are far less than
that of a conventional restaurant without a drive-thru.
2. We have enclosed a letter from Collins Foods International who is the operator of
this store and three other KFC units in the city of San Bernardino. This letter
provides information on this store and the KFC operation in general. The exhibits
at the end of the letter indicate current sales per day, projected sales per day,
and the incremental increase per day. Sales are indicated on an hourly basis and
the type of sale. The sales charts clearly indicate that with the anticipated 16%
increase in revenue, a total of 123 cars per day would park onsite over a 10-
hour period--assuming that all customers arrive in an automobile. During the
busiest single hour of the day (5-6 pm), the maximum number of cars on the lot
at anyone time would be 7. .
3. The primary purpose of the proposed remodel is to upgrade a facili ty which has
operated for 11 years since its last facelift. The intent is to upgrade the
exterior of the building with a new color theme, add a considerable amount of
landscaping, and renew the customer areas of the interior including the addition
of new rest rooms which meet all handicap requirements.

Referencing to the random sampling of various cities' parking requirements, we feel
that the city of San Bernardino's code is too stringent--especially as applies to a
KFC. Based upon actual studies conducted by CFI and KFC of more than 200
KFC's in Southern California, we submit that we have a minimum of twice the
number of parking spaces that will be utilized for the projected increase in business..
We would ask that the Mayor and City Council give this project and analysis consid-

Dear Mr. Merriam:
I -
This letter is provided to share some of the knowledge which has been
accumulated by Collins Foods International, Inc. (CFI) concerning the
parking circulation impact for its Kentucky Fried Chicken (KFC)
restaurant concept. CPI is the largest international franchisee for
the Kentucky Fried ~~icken concept with 207 KFC restaurants. With over
twenty years of experience, CPI has gathered a significant amount of data
on all aspects of its restaurant concepts. This information specifically
pertains to the parking issu.s you appear concerned with as voiced to our
construction department.
We expect the information contained herein will allow you to more properly
understand the on-site circulation and parking issues for the proposed re-
build of our KFC restaurant at the property located at 477 S. 'E' Street
in So. San Bernardino, California.
KFC, monitoring the sales statistics of its restaurants through the use
of computers, is able to assemble data establishing actual parking require-
ments, number of carson the property, and average time spent on site by
each customer. Each sale is recorded at the time of the transaction,
indicating when the customer ate at the restaurant, used the drive-thru
facility, or carried the product out.
This data indicates that the average service time to receive an order,
either going into the restaurant or through the drive-thru, is approxi-
mately 2.5 minutes. In servicing a drive-thru customer the time spent
looking at the menu and deciding on their order averages closer to 3.5
minutes, thiS indicates that 17.14 drive-thru custOMers can be processed
per hour with no more than one or two car stackinq occurinq at any time,
and the maxiMum amount of time a drive-thru customer will be on the site
should be nO more,than 6 minutes. Customers who walk in and carry meals
out should not spend more than 10 minutes On our site. Our experience
shows that the typical dine in customer consists ot a party of 2 or more
patrons and the average time spent on site as a sit-down customer is 24
minutes.

The restau~ant is located on South 'E' Street. As the typical traveller
frequentinq KFC is on their way home, he or she. will enter the site off
of South 'E' Street, either qo through the drive-thru, or into restau~ant
and exit.
To determine the potential traffic impact at this site it is important to
consider the information on our existing restaurant prior to a rebuild.
This current data establishes the existing t~affic impact. The existing
KFC restaurant is a free-standing pad having 29 parking spaces, drive-thru
and 22 seating. The existing store has a sales volume of a!most a half
million dollars annually.
Using the existing store as a base indicator and our twenty year plus
experience with the Kentucky Fried Chicken restaurant concept, we have
projected an increase in weekly transactions of 220 or a 16\ increase in
aales. We have projected aa shown in Exhibit I the amount of incremental
t~affic to be generated when the new KFC restaurant is completed. The
ratio of customer types are divided by the following properations: 45'
for drive-thru, 26' for ca~ry-out, and 29' for dine-in customer. This
equates to 99 drive-thru, 57 carry-out, and 64 dine-in customers daily.
Exhibit I pertains to the rebuilt restaurant with respect to the increase
in traffic ci~culation while on the site. What's significant is the total
projected cars du~ing the peak hours of service occupying the site at any
one time. Exhibit I shows a maximum of 7 cars frOD 5:00 to 6:00 p.m.
What is important to keep in mind about KFC is that our customers are
predominantly adults who frequent the drive-thru facility to purchase a
feast for their family or acquaintances. Most transactions are purchased
for groups of four or more, thus, ~he reason for less parking needs when
compared ~o other fast food concepts due to our hiqhe~ ~icket per cus~omer
averages. Additionally, the KFC concept itself does not cater to teenagers
who are more inclined to linger on the site fraternizing with one another.
Due to this, KFC enjoys a low ~equirement for parking and the. resulting
traffic impact is light while generating a s~st.ntial sales volume. Con-
sequently, ~he KPC concept is attractive for most developers and communities
alike.

FINDINGS OF FACT
1. There are no exceptional or extraordinary circumstances
applicable to the property involved which do not aPply
to other property in the same district and neighborhood
in that the 0.42 acre parcel is flat and rectangularly
shaped rather than irregularly shaped.
2. The variance is not necessary for the preservation of a
substantial property right of the applicant in that the
property may still be used in a manner which is on a par
with uses allowed to other property owners in the
vicinity.
3. The granting of the requested variance could be detri-
mental to the public welfare in that it could cause
circulation problems and traffic hazards.
4. The granting of the variance would be contrary to the
General Plan objective of ensuring that developments
provide adequate parking, either on-site or in con-
solidated parking facilities.

The applicant requests approval under the authority of Code
Section 19.26.020(8.9) to construct a 418 square foot
addition to an existing 1,500 s~are foot drive through
restaurant and approval of a var~ance from Code Section
19.56.020 (F) regarding required parking. The Municipal Code
requires 32 parking spaces for the proposed total square
footage. The site plan provides 29 spaces (See Attachment
C) .

3. MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE
Except for the requested variance, the proposed project is
consistent with the Municipal Code and in conformance with
the General Plan as shown in Attachment A. The proposed
addition does not meet the required setback of 20 feet from
curb face of the Central City South Redevelopment Project
Area, but it is a continuation of an existing building
frontage.

number of parking spaces was 25. The parking requirement for
drive-through restaurants was the same at that time as it is
now: 1 space per 60 square feet of gross floor area.

6. ANALYSIS
Traffic Volumes on "E" street and Mill Street
The existing traffic volume on the portion of "E" Street
where the site is located is 18,000 trips per day. The
traffic volume on the nearby portion of Mill Street is 21,000
trips per day. (Source: Technical Backqround Reoort:
February, 1988.)
At the Development Review Committee meeting of May 4, 1989,
the Police Department expressed a concern that a tight
parking situation at this site could cause on-site traffic
congestion and traffic backing up at the entrance from "E"
street. There are four (4) parallel parking spaces beside a
one-way drive aisle 16 feet and 7 inches in width at the rear
(east) side of the site. Cars pulling into these spaces
could contribute to on-site traffic congestion. Traffic
backing up on to a heavily traveled street 115 feet from a
busy intersection has the potential to cause serious
problems.

There is nothing exceptional about size, shape, topography,
or circumstances of the site which is not applicable to other
parcels in the vicinity.

The "E" street curb in front of the site is not straight.
Eventually, the street will be widened in order to provide a
uniform distaQPe from the curb to the street centerline. The
proposed site plan accounts for the eventual street widening.

CONCLUSION
The site is located on south "E" street approximately 100
feet north of the intersection of "E" and Mill streets, a
very busy intersection of two well traveled streets. Approval
of the proposed site plan and the requested parking variance
could cause on-site traffic congestion during peak use hours,
leading to traffic backing up onto "E" street and, thereby,
constituting a traffic hazard. There is nothing exceptional
about the size, shape, topography or circumstances of the
property in question to support approving the requested
variance.

CONDITIONS OF APPROVAL
If Building Permits for the project described by this
approval have not been issued prior to adoption of the
General Plan, and the project described by this approval
is. inconsistent with the adopted General Plan, then the
approval of this project shall be null and void.
Minor amendments to the plan shall be subject to
approval by the Director of Planning. An increase of
more than 10 percent of the square footage or a signi-
ficant change in the approved concept shall be subject
to (Planning Commission) (Development Review Committee)
review and approval. Construction shall be in sub-
stantial conformance with the plans approved by the
Development Review Committee, Planning Commission or
Director of Planning.
Four sets of Landscape Plans, along with the appropriate
fee, shall be submitted to the Enaineerina Decartment
for processing. No grading permits will be issued prior
to approval of landscape plans.
At all times the business will be operated in a manner
which does not produce obnoxious noise, vibration, odor,
dust, smoke, glare, or other nuisance.
Subject to the Conditions of the Department of Parks and
Recreation (attached).
In the event that this approval is legally challenged,
the City will promptly notify the applicant of any claim
or action and will cooperate fully in the defense of the
matter. Once notified, the applicant agrees to defend,
indemnify, and hold harmless the City its officers,
agents and employees from any claim, action, or
proceeding against the City of San Bernardino. The
applicant further agrees to reimburse the City of any
costs and attorneys' fees which the City may be required
by a court to pay as a result of such action, but such
participation shall not relieve applicant of his
obligation under this condition.

VARIANCE FINDINGS:
1. There are no exceptional or extraordinary circumstances
applicable to the property involved which do not apply
to other property in the same district and neighborhood
in that the 0.42 acre parcel is flat and rectangularly
shaped rather than irregularly shaped.
2. The variance is not necessary for the preservation of a
substantial property right of the applicant in that the
property may still be used in a manner which is on a par
with uses allowed to other property owners in the
vicinity.
3. The granting of the requested variance could be detri-

a. A single or double door shall be equipped ~th a double or single
cylinder dead bolt. The bolt shall have a minimum projection of 1" and
be constructed so as to repel cutting tool attack. .
b. The dead bolt shall have an embedment of at least 3/4" into the strike
receiving the projected bolt. The Cylinder shall have a cylinder
guard, a minimum of five pin tumblers and shall be connected to the
inner portion of the lock by connecting screws of at least 1/4" in
diameter. The recommendation does not apply when panic hardware is
required or an equivalent device is approved by the Building Code.

Double doors shall be equipped as follows:
a. The acti ve leaf of double doors shall be equipped wi th metal flush
. bolts having a minimum embedment of 5/8" into the head and threshhold
of the door frame. Double doors shall have an astragal constructed of
steel, a minimum of .125" thick which ~ll cover the opening between
the doors. Thi s astraga 1 sh all be a mi ni mum of 2" ~ de and extended a
mi ni mum of 1" beyond the edge of the door to whi ch it is attached. The
astraga I shall be attached to the outsi de of the acti ve door by means
of welding or ~ th nonremovable bolts spaced apart on not more than 10"
centers. Hinges for outswinging doors shall be equipped with nonremo-
vable hinge pins or a mechanical inner lock to preclude removal of the
door from the exterior by removing the hinge pins. Strike plates shall
be a mi nimum of 3i" in length and secured to the jamb ~ th screws a
minimum of 2t" in length.

a. All moveable windows shall be equipped with a locking device and shall
be constructed in a fashion to restrict them from being lifted out of
its track when in closed pOSition.

a. The above-descri bed doors shall conform to the followi ng standards:
(ll Wood doors shall have panels a minimum of five-sixteenths (5/16l
inch in thickness with the locking hardware being attached to the
support framing.
(2 l A I umi num daors shall be a mi ni mum thi ckness of .0215 inches and
riveted together a minimum of eighteen (18) inches on center along
the outside seams. There shall be a full width horizontal beam
attached to the main door structure which shall meet the pilot, or
pedestrian access, door framing within three (3) inches of the
strike area of the pilot or pedestrian access door.

Draina e and Flood Control
All necessary drainage and flood control measures shall be
subject to requirements of the City Engineer; which may be based
in part on the recommendations of the San Bernardino Flood
Control District. The developer's Engineer shall furnish all
necessary data relating to drainage and flood control.
A local drainage study will be required for the project. Any
drainage improvements, structures or storm drains needed to
mitigate downstream impacts or protect the development shall be
desi gned and constructed at the developer's expense, and
right-of-way dedicated as necessary.

Grading
41. X--If more than l' of fill or 2' of cut is proposed, the site/plot/
grading and drainage plan shall be signed by a Registered Civil
Engineer and a grading permit will be required. The grading plan
shall be prepared in strict accordance with the City's "Grading
policies and Procedures" and the City's "Standard Drawings",
unless otherwise approved by the City Engineer in advance.
If more than 5,000 cubic yards of earthwork is proposed, a grading

Each parcel shall be provided with separate water and sewer
