Allen. The notices were not returned by the Post Office. 8-24/25-88: City crews cleaned the lot, as it had not been done by Allen. 9-88: Allen was billed for abatanent. A letter was included, advising him that he could protest the assessnent at the 12-2-88 meeting of the Board of Building Coomissioners. 10-19-88: Allen requested copies of Notices lIRiled July 29, 1988. Denise lIRiled them to him the same day. 11-9-88: Allen requested copies of dtmp tickets. Denise mailed than to him. 11-16-88: Protest received by City Clerk's office. 11-30-89: Allen notified by lIRil that DecaIi:ler BOC meeting had been cancelled and that his protest \\Quld be heard at the 1-6-89 meeting. 1-6-89: Protest heard and assessment upheld by the BOC. Allen was not present at the meeting. 4-7-89: Appeal of BOC decision received by City Clerk's office. Appeal was placed on the 6-5-89 agenda of the Mayor and CaIIron Council. 54-89: Council Action/ Staff Report. canpleted and subni tted to Aaninistration. 6-5-89: Appeal heard by Mayor and CaIIron Council. Allen was present. Upon viewing Department photographs, Allen stated the abatanent was not done on his property. Council continued issue to 6-19-89 meeting. 6-7-89: Manuel Ortiz, Jon Roberts(Engineering) and I met at 4th/Kendall. John and I measured the parcel and I took a photo of the east boundary line. facing south. The photo was placed in the Department file. We confi:rmad and agreed that the abatanent had been done on Allen's property. DescriDtionl Fin.,.: QmCil Notes: AII.to....~G '.Arn.l\J", ~7 CITY OF SAN B.RNA~DINO - RI!QU.ST F~ COUNCIL ACTION c STAFF REPORT On July 29, 1988, a "Notice to Clean Premises" was mailed to Michael P. and Brenda Allen, 208 South "D" Street, San Bernardino, CA 92401, regarding property Parcel No: 0151 201 09 and, No. 0151 201 10, located at 4th and Kendall Streets. A copy of the notices are attached as Exhibits "A" and "B". o The above parcels were not cleaned within ten. (10) days of the noti ces. Therefore, the Ci ty on or about August 21, 1988, abated the weeds and debris at the above parcels. . Extensive cleanup was necessary. Copies of the solid waste dump tickets are attached "Cn, "D", and "E". In September, 1988, along with their bill, the All ens were sent a notice of hearing before the Board of Building Commissioners$cheduled for December 2, 1988, regarding the assessment costs for the abatement of their parcels. The hearing in December was postponed by the Board until January 6, 1989, and the Allens were .notified of the change of date. In October, 1988, Mrs. Allen called the Public Services Department, complaining about the bill and requested copies of the "Notice to Clean Premises". Later she requested copies. of the dump tickets, all of which were provided by the Department. The heari ng on the assessments on the All en's property, Parcel No. 0151 201 09 and No. 0151 201 10, was held January 6. 1989. Evidence was presented to the Board of Building Commissioners regarding the Allen's abatement and assessment costs. The Allen's were not present at this hearing. Based on the evidence presented, the Board unanimously adopted the sum of $1,667.26 to be assessed against the Allens and ordered that a lien be placed on their property, if the assessments. were not paid. A copy of the Board of Building Commissioners resolution is attac1!ed as Exhi bi t "F". A reso 1 uti on adopti ng the assessments for abatement of the A Hen's parcels was adopted by the Mayor and City Council on February 2, 1989. T,he Allens were also not in attendance at the Council meeting. . A copy qf the resolution is attached, and marked as Exhibit "G", along with a copy of the Board of Building Conmissioners resolution (Exhibit "F"l. In March 1989, Mr. Allen contacted both the City Clerk's office r.equesting an appeal of the assessment costs. At that time the City Cl erk 's off; ce advi sed Mr. A 11 en to send in a written request for an appeal giving the reasons for appealing and the relief or a~tion sought from the Council.
