Bids for the maintenance of landscaping in portions of
Piedmont Drive and Citrus Street were opened at 2:00 p.m., on
Thursday, 5-18-89.
A total of two bids were received, in the amounts of
$4,370.00 and $6,755.62, for the Basic Bid and the Supplemental
Items of work. The low bid of $4,370.00 is 76.5% over the
Engineer's Estimate of $2,476.00.
The bid documents were prepared to include the. routine
maintenance of groundcover, shrubs and trees in accordance with
a specified schedule, . while replacement of plant materials and
irrigation components were included as supplemental items of
work. Quantities for the items in the Basic Bid arc definitive,
but are indeterminate for those items incluqed as supplemental.
Listed below is an estimate of the total estimated cost
of providing these landscape maintenance services, from 7-1-89
to 6-30-90, based upon the actual low bid price.

The Notice to Proceed will be effective as of 7-1-89.
The contract will be in effect until 6-30-90. subject to two one
year extensions, by mutual consent. In view of the low bid
price being considerably over the Engineer's Estimate, we do not
anticipate granting an extension.
Funding of the costs incurred for maintenance of the
landscaping will be provided pursuant to Resolution No. 87-114,
adopted on 4-6-87, which orders the maintenance of the
landscaping installed by the subdivider. Formation of an
assessment district for maintenance of landscaping was a
condition of approval for Tract No. 13329. This district was
expanded by Resolution No. 89-81, adopted on 3-20-89, to. include
Tract No. 13470.

~ The landscaping was maintained by the subdivider for a
period of one year as required by the co.nditions of approval.
This time has elapsed, and the maintenance will be assumed by
the Contractor.
Costs for maintenance of this landscaping will be
upfronted by the City, as set forth in the Resolution of In-
tention (87-139) . These costs will be reimbursed, with
interest, through assessments levied on all parcels within the
area of benefit.

Supervision of the Contractor's work will be provided by
the Department of Parks, Recreation and Community services.
The low bid is considerably over the estimated cost.
This appears to be a result of the estimate not fully taking
into account the remoteness of the~lIj.ti.~g required travel
.time. Since the. landscaping ~maintained, i.Mr
the required year by the subdivider, we recommend that a
contract be awarded to the low bidder. We anticipate that this
work will be re-advertised next year, in an attempt to secure a
more competitive bid.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO MACKENZIE LANDSCAPE FOR MAINTENANCE OF LANDSCAPING IN
3 PORTIONS OF PIEDMONT DRIVE AND CITRUS STREET, IN ASSESSMENT
D!STR!CT NO. 982.

BE !T RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. MacKenzie Landscape is ~he lowest responsible
7 bidder for Landscaping in portions of Piedmont Drive and Citrus
8 Street in Assessment District No. 982, in accordance with, plan
9 No. 7384 (1989-90), for the total amount of $4,370.00, and a
10 contract for the Basic Bid and Supplemental Items, is awarded to
11 said bidder accordingly, but such award shall be effective only
12 upon the contract being fully executed by the parties: all other
13 bids therefore are hereby rejected: and the Mayor is hereby

14 authorized and directed to execute said contract on behalf of the
15 City: a copy of the contract is attached hereto, marked Exhibit
16 "A" and incorporated herein by reference as fuI"ly as though set
17 forth at length.
18 SECTION 2. This contract and any amenchUent or modifica-
19 tions thereto shall not take effect or become operative until
20 fUlly signed and executed by the parties . and no party shall be
21 obligated hereunder until the time of such full execution. No
22 oral agreements, amendments, modifications or waivers are
23 intended or authorized and shall not bo implied from any act or
24 course of conduct of any party.
25 SECTION 3. This resolution is rescinded if the parties
26 to the contract fail to execute it within sixty (60) days of the
27 passage of this resolution.
