STAFF REPORT
This action is the result of a request submitted by GWRE Property Manageaent for
an assess.ent district to finance the costs of security patrol, additional street
lighting energy costs and one additional street sweeping per month. This petition
was a result of a city initiated action to reduce the crime and blight common to
this area.
On 03-13-89, authorization was given to proceed with the formation of an
assessment district.
The purpose of the action is to preliminarily determine that the public
convenience and necessity require the formation of. a security and
lMintenance district; declaring the intention to proceed to order work within
the district to be known as the "Highland and Arden Security and Maintenance
District" .
The petitioner represents 6lS of the property owners to be assessed within the
proposed district. Since less than 100S of the owners have petitioned for the
district, a public hearing must be held, as set forth in the attached . Resolution
of Intention. A copy of the Engineer's Report is also attached.
It is reco.ended that the resolution be adopted.

ASSESSMENT DISTRICT NO. 990
PETITION -- On January 25, 1989, this office received a petition from GWRE
Property Management for the establishment of an assessment district for
security, 'street light maintenance and additional monthly street
sweeping for the Arden Guthrie Apartments as delineated on the attached
vicinity map. This petition was the result of the City, working
with a property owner of a large portion of the apartments, to
reduce crime and blight that has become common to this area.
AUTHORIZATION TO PROCEED -- On March 13, 1989, the City Engineer
were authorized to initiate proceedings under the
Chapter 12.90 of the San Bernardino Municipal Code
Engineer was directed to prepare this report.

ADVANCE OF ESTIMATED COSTS -- Since this petition is a result of a City
initiated action,in conjunction with a property owner, no advance costs
are required.
EASEKENTS -- All security, street light maintenance and street sweeping will 'be
carried out in the public right of way and no additional easements will
be necessary.
DESCRIPTION OF WORK -- The work that is to be carried out within the proposed
district includes nightly security patrol on an eight hour shift,
energy and maintenance costs of additional street lighting and one
addi Uona 1 day of street sweeping per month. The area is currently
using a Security Patrol Service, for which the petitioner is paying. An
Annual contract will have to be securer! for the securit~f, through the
regular bid process. Additional street lights have been installed by
Edison, through a request of the petitioner. The petitioner is
currently paying the energy and maintenance costs. These costs would
now be paid by the district. Appurtenant to street sweeping, "No
Parking" signs will also be installed along all right of way,
prohibiting parking on days of street sweeping. This is necessary due
to the fact that numerous cars are parked along the streets, which
diminish effective street sweeping. Maintenance and/or replacement of
the signs, as necessar'y, would also be included in the assessment,
together with all administrative costs.
SPECIFICATIONS Specifications for the work to be performed will be prepared
by the Department of Public Works and will provide for separate billing
for security, additional lighting and street sweeping.

DESCRIPTION OF BOUNDARIES -- On February 24, 1989, the boundaries of the proposed.
district were determined and are delineated on the attached Proposed
Boundary Map of Assessment District No. 990. The proposed district
boundaries include the area bounded on the North by the centerline of
outer Highland Avenue, between Guthrie Street and Arden Avenue, on the
South by the centerline of the alley South of 20th Street, between
Guthrie Street and Arden Avenue, on the East by the centerline of Arden
Avenue, between outer Highland Avenue and said alley South of 20th
Street, and on the West by the centerline of Guthrie Street, between
outer Highland Avenue and said alley South of 20th Street.
The boundaries also include a portion of State property, which will not
be assessed.
VICINITY MAP -- The vicinity map is attached as Exhibit 1.
DISTRICT BOUNDARY MAP -- A reduced copy of the District Boundary ~ap is attached
as Exhibit 2.

METHOD OF ASSESSMENT Security patrol, additional street lighting and
additional street sweeping will help to reduce the crime and blight
that has been common to this area for many years. The benefit received
by ownel'S of the properties in the area is determined to be eqUally
shdl'ed by the number of households receiving the services.
Hence, each residential unit, be it a single family residence, d
condominium or an apartment will be assessed an eqUal share in the
cost of services provided. (1 residential unit - 1 assessment).

RESOLUTION OF THE CITY OF SAN BERNARDINO PRELIMINARILY
DETERHINING TIlAT PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE FORMATION OF
A SECURITY AND HAINTENANCE ASSESSMENT DISTRICT; DECLARING ITS INTENTION
TO PROCEED TO ORDER WORK WITRIN THE DISTRICT, TO BE KNOWN AS ASSESSMENT
DISTRICT NO. 990; AND SETTING AND DIRECTING PUBLICATION OF NOTICE OF A
TIME AND DATE OF A PUBLIC HEARING.
WHEREAS, the City of San Bernardino (hereinafter called "City")
7 as an exercise of its municipal affairs powers has enacted an
8 Assessment District Ordinance (Municipal
Code Chapter 12.90) to
9 provide for the procedure for the formation of assessment districts within
10 the City; and
11 WHEREAS, it has now become necessary to consider the formation
12 of a security and maintenance assessment district within the City, to be
13 known as Assessment District No. 990; and
14
WHEREAS, as a further exercise of the powers vested in the City
15 by virtue of Section 19, Article XVI, California Constitution, the
16 City intends to conduct a hearing and hear protests, if any, as to why

the district should not be formed and the acquisitions and improvements
completed, without compliance with the Special Assessment Investigation,
Limitation and Majority Protest Act of 1931;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Pursuant to Chapter 12.90 of the San Bernardino
Municipal Code, the Mayor and Co_on CouncU of said City
hereby
preliminarily find and determine that the public convenience and necessity
require, and it is the intention of the Mayor and Common Council to form
Assessment District No. 990, the boundaries of which are generally
as follows: bounded on the North by the centerline of Highland Avenue, on

centerline of Guthrie Street.
Reference is hereby made to the Engineer's Report on file in
the office of the City. Clerk of said City for a map of the boundaries of
said district, a description of the type of improveaent, an estimated cost
of the improvement and a proposed assessment roll which Report and
Assessment District Hap are hereby approved.
SECTION 2. It is the intention of said Hayor and Co.on
Council to order improvements within the district which improvements
consist of, but are not limited to, security patrol, additional
street lighting energy and maintenance costs, additional monthly street
sweeping, and installation and maintenance of "No Parking" signs relative to
street sweeping dates. All improvements, with the exception of street
sweeping, will be carried out within all streets and alleys within the
district. The street sweeping will be limited to the streets only.
The estimated cost of said security and maintenance, including
incidental costs is $45,460.00 for the first year.
SECTION 3. Said contemplated work and improvements is of more
than local or ordinary public benefit, and that said Kayor and Co.on
Council do hereby make the expense of such work and improvement chargeable
upon the district, which district is hereby declared to be the district
benefited by said proposed work and improvement, and to be assessed to
pay the cost and expense thereof. All public streets or alleys, or
portions thereof, are hereby excepted from said assessment.
SECTION 4. The assessment benefit procedure to be followed
and the amount to be assessed against each particular parcel will be a
proportion. of the total sum of the cost of the security and maintenance and
incidentals within the area in relation to the number of single family units
within each parcel within the district. Reference is hereby ....de to.

detailed estimated individual assessment.
SECTION 5. The assessment financing alternative to be followed
shall be as follows, to-wit:
The costs shall be pre-funded by the City and the
assessment levied. collected and enforced in the same manner, at the same
time, and with the same penalties and interest as in the case of taxes
levied for the City for the repayment to the City of said pre-funding.
The City shall recover interest on each year's pre-
funding of cost of security, maintenance and incidentals. Said interest
shall be at the average rate as the City is receiving on other City funds
during the period of expenditure.

otherwise terminated by the City.
SECTION 6. That notice is hereby given that on July 17, 1989, at
the hour of 10:00 a.m., in the Council Chambers, in the City Hall of said

26 and show cause. if any they have, why the Mayor and Co.on Council

the Special Assessaent Investigation, Limitation and Majority Protest
Act of 1931; on the question of estiaated cost, and the intention of the
Mayor and Co.on Council to proceed to order work within the
district.
SECTION 7. At said public hearing, all persons. will be heard,
any holder of title to taxable real property within the boundaries of the
proposed district may file a protest in writing with the City Clerk,
not later than the hour hereinabove set for hearing, containing
therein a description of the property in which the signer thereof is
interested sufficient to identity the same, and, if the signers are not
shown on the last equalized assessment roll as the owners of such
property, must contain or be accoapanied by written evidence that
such signers are the owners of such property. The basis for determining
the existence of a majority protest shall be based on the number of
single family units on respective lots or parcels involved in proportion
to the total number of single family units within the entire district.
SECTION 8. The City Clerk is authorized and directed to cause
a copy of this resolution to be published in a newspaper of general
circulation published in the City, and that said Clerk shall cause a
notice of the adoption of this resolution to be posted and mailed as
required by Section 12.90.04OC of the Municipal Code of the City of San
Bernardino.
SECTION 9. A copy of this resolution and a _p showing the
exterior boundaries of the proposed i~rove.ent district with relation to
the territory immediately contiguous thereto and to the proposed
improvement will be on file with the City Clerk and will be available for
inspection by any person or persons interested. This map shall govern
for all details as to the extent of the proposed i~rove.ent district.
