Synopsis of Previous Councilection:
4/3/89 The Mayor and Common Council approved a motion that the City Attorney be
directed to file a Petition for Intervention with the Federal Energy
Regulatory Commission concerning the Second Afterbay at Devil's Canyon
Power Plant.

STAFF REPORT
At the April 3, 1989 meetinq of the Mayor and Co_on Co\U\cil,
the status of the Second Afterbay project by the state
Department of Water Resources (DWR) was reviewed. The city
Attorney was directed to file a Petition for Intervention
with the Federal Enerqy Requlatory co_ission (FERC)
concerninq this project. Contact was made with FERC and the
state DWR was advised of the City of San Bernardino's intent
to file a Petition for Intervention. An official notice of
the FERC amendment application has not been provided to the
city Attorney's Office and in the meantime, the city will
need to pursue neqotiations of economic and environmental
concerns of the project. A follow-up meetinq will be held
between the City and the state DWR for the purPoses of
neqotiatinq on the Second Afterbay project.

Purpose of Facility:
. Provide peaking capacity, spinning reserve, and
operating flexibility, and eliminate risk of spills.
Enlarqed powerplant Capacity: 240 megawatts
Description:
Storage facility constructed entirely below existing
ground surface and lined with impervious membrane.
safety Features:
Below ground construction and ample freeboard
prevent risk of spills caused by earthquakes.
Impervious membrane lining will prevent water
seepage.
Department property will be fenced so the
facility does not become an attractive nuisance.
A second fence, hidden from public view, will
encircle the afterbay.
Intrusion alarms will be installed.

Paving on Ohio Avenue and pine Avenue, reimbursement
for water main costs, dedication of land to city of
San Bernardino for park, landscaping dedicated land to
provide greenbelt area, and improvement of Bailey
Creek drainage channel.

Environmental Mitigation:
A botanical survey was conducted by staff. of the U.C.
Riverside Department of Botany and Plant Science to
identify the plant species in the construction area,
identify the impact of the project, and propose
mitigation measures. Mitigation measures have been
coordinated with the Department of Fish and Game. All
disturbed areas, including the slopes, will be re-
vegetated.

Dear Mr. Penman:
This is in response to your letter of April 13, 1989 regarding the
Devil Canyon Powerp1ant Project. I apo1oqize for any confusion or
misunderstanding that has developed in the course of contacts
between the city and Department of Water Resources personnel.
It is our intent to fully address the impact of the Project and
provide complete information to all interested parties and
entitie.. To this end, we are in the process of deyeloping visual
aids, inCluding a scale model which will enable us to more clearly
explain the scope of the Project. We have tried to minimize
meetings on the Project other than between city and Department
staff until such aids are available. The Department has arranged
a meeting with officials from the San Bernardino area to be held
May 17 at 10 a.m. in the conference room of the San Bernardino
Valley Municipal Water District, 1350 South "E" Street. We plan
to give a briefing on the. Project and will seek advice regarding
subsequent public meetings. A listing of individuals who have been
requested to attend is enclosed. I invite you to join the other
city official. on the list in attending.
The facilities at Devil Canyon powerplant are_ essential in
providing an adequate water supply to the San Bernardino area. I
believe it is important that the City and Department work toqether
in continued discussions on the second afterbay for this plant.
