VARIANCE 89-1, A PROPOSAL FOR A 33-LOT SINGLE FAMILY
SUBDIVISION WITH ONE STANDARD MEANS OF ACCESS AND ONE
NON-STANDARD MEANS OF ACCESS, AND A CUL DE. SAC LONGER
THAN 500 FEET

REOUEST
The applicant requests approval of a 33 lot single family
subdivision with a minimum lot side of 7,200 square feet. The
applicant also requests a variance from Code Section 18.40.130
to permit a cuI de sac longer than 500 feet. The end of the
cuI de sac will be connected to Kendall Drive by a paved
easement 20 feet in width with crash gates to provide a non-
standard second access for emergency vehicles. (See Tract Map,
Attachment "G".)

The subject property is an irregularly-shaped parcel en-
compassing approximately 11.1 acres and located at the
southeast corner of Kendall Drive and Shandin Hills Circle. The
southerly portion of the site includes a large area of steep
slopes. (See Location Map, Attachment "H".)
BACKGROUND
TWO MEANS OF INGRESS AND EGRESS REQUIRED:
o
section 18.40.160 of the city's subdivision Design Standards
requires all tentative maps to provide two routes for ingress
and egress. Outside of the high fire hazard areas of one of
the two required means of access may be non-standard subject to
the recommendations of the Fire Chief and the Planning
commission and approval of the Mayor and Council.
l&/The first version of the Tentative Tract 14252 proposed a
->t regular street connecting the easterly end of the Street "B"
and Kendall Drive in addition to the access taken from Shandin
Hills Circle. Due to the volume and speed of traffic on
Kendall Drive and the proximity of the proposed street to a
portion of Kendall Drive which curves and goes over a hill, the
City Traffic Engineer and the California Department. of
Transportation opposed any new direct access from the site to
Kendall Drive.j The applicant revised to the Tentative Map by
replacing the proposed direct access to Kendall Drive with a
paved easement 200 feet in width with locked crash gates to
provide a second means of access for emergency vehicles. The
Fire Department has provided a statement in writing that the 20

foot easement for emergency access is acceptable. (See
Attachment "F".)
CUL DE SAC LONGER THAN 500 FEET:
Section 18.40.130 of the City's Subdivision Design Standards
stipulates a maximum length of 500 feet for cul de sacs and
provides that the Mayor and Council may approve cul de sacs
which vary from the stipulated requirements provided that
variance findings can be made that support permitting such a
cul de sac. (See Findings of Fact, Attachment "C".)
The required deletion of the proposed direct access to Kendall
Drive discussed above makes the proposed Street "B" a cul de
sac 980 feet in length measured from the entrance to the site
from Shandin Hills Circle. The reasons for prohibiting a new
standard means of access from the site to Kendall Drive were
discussed in the previous section of the analysis. The City
Engineer also opposed a second access taken from Shandin Hills
Circle. The site's frontage on Shandin Hills Circle is too
small to allow adequate separation between two streets on that
side of the site. The southerly side of the site is composed
of slopes too steep to accommodate a street providing access to
the future Ridgeline Drive south of the site.
[Due to the constraints posed by the location, shape, and
topography of the site, the applicant requests a variance from
the stipulated maximum length of 500 feet for cul de sacs.

site either undevelopable or developable only on lots far in
excess of the required minimum lot size. The required variance
findings can be made as shown in Attachment "B". The Fire
Department has stated, in writing, that the proposed tract map
is acceptable subject to the provision of an easement providing
emergency access directly from Kendall Drive. (See Attachment
"F".)
MUNICIPAL CODE AND PLAN CONSISTENCY
Except for the requested variance, the proposed project is
consistent with the Municipal Code and in conformance with the
Interim Policy Document as shown in Attachment A. The proposed
project is also consistent with the General Plan Use Desig-
nation of RS, Surburban Residential.
PREVIOUS ACTIONS
On April 20, 1989, the Environmental Review Committee recom-
mended a Negative Declaration for Tentative Tract 14252 and
Variance 89-1.

Tentative Subdivision Map Findings
5. The proposed map is consistent with the General Plan and
the zoning code in that it conforms to the Interim
Policy designation of Residential Suburban, 3.1 - 4.5
dwelling units per acre and meets subdivision design
standards except for the requested variance.
6. The site is physically suitable for the type of develop-
ment or density of development in that it is large
enough to accommodate the proposed number of parcels in
compliance with applicable zoning and subdivision
standards, and all environmental impacts can be ade-
quately mitigated.
7.
The design of the subdivision or the proposed improve-
ment are not likely to cause substantial environmental
damage or substantitally and avoidably injure fish or
wildlife or their habitat in that grading will involve
shifting 13,100 cubic yards of soil on the site, and the
site is not a known habitat of any endangered species.

8.
The design of the subdivision or the proposed improve-
ment is not likely to cause public health problems in
that adequate drainage will be provided and ambient
noise levels can be adequately mitigated.
9. The design of the subdivision or the type of improvement
will not conflict with easements acquired by the public
at large for access through or use of the property
within the proposed subdivision.
10. The discharge of waste from the proposed subdivision
into the existing community sewer system will not result
in violation of existing requirements prescribed by the
California Regional Water Quality Control Board, pur-
suant to Division 7 (commencing with section 13000) in
that adequate sewage treatment capacity exists to handle
the waste from the proposed subdivision.

2. SITE LOCATION
The subject property is an irrequarly-shaped parcel en-
compassinq approximately 11.1 acres and located at the
southeast corner of Kendall Drive and Shand in Hills Circle.
The southerly portion of the site includes a larqe area of
steep slopes. The site is located in the Hiqh Wind Hazard
Area (See attachment H).
3. MUNICIPAL CODE AND INTERIM POLICY DOCUMENT CONFORMANCE

and in conformance with the Interim Policy Document as shown
in Attachment A.
4. CEOA STATUS
At its regularly scheduled meetinq of April 20, 1989, the
Environmental Review Committee proposed a Neqative Declar-
ation for Tentative Tract 14252 and Variance 89-1. The
proposed Negative Declaration was advertised and ,was avail-
able for public review throuqh May 10, 1989. No comments
were received from the public.
5. BACKGROUND
The property in question was formerly zoned Planned Resi-
dential Development 14 du/ac and was the subject of Tentative
Tract 12956, a 48 lot planned residential development, in
1985. The Planning commission approved.Tentative Tract 12956
on May 15, 1985. The Planninq Commission's decision was the

DRAINAGE AND SOIL EROSION:
The southerly portion of the site contains a large area of
steep slopes. Adequate provision must be made to convey
storm runoff from these slopes to storm drains in a manner
not detrimental to the proposed subdivision.

There is an existing system of concrete lined bench drains on
the slope. The bench drains and existing storm drains were
designed to handle the anticipated runoff from the site area
and the City Engineer states they are adequate to fulfill
their function. The Preliminary Grading Report submitted
with the proposed tract map recommends that a plan should be
established and responsibility assigned for the . lifetime of
the project for maintaining the subsurface and surface outlet
pipes emplaced in the fill for delivery of subsurface water
from the slopes to existing storm drains. This shall be a.
condition of approval.
o
In order to prevent soil erosion an Assessment District shall
be formed and legally documented with the specific
responsibility for providing perpetual maintenance and Upkeep
thorough landscaping methods of all slopes. Landscaping
shall be in place prior to issuance of Certificate of Occu-
pancy. The developer shall be responsible for landscape
maintenance for the first year of the project's existence.
All proposed landscaping, including street trees, shall
comply with established standards for. landscape Assessment
District #959 as well as the established landscape master
plan for Shandin Hills.
NOISE:
Existing noise levels from traffic on Kendall Drive are
between 62 and 64 dB. Due to the site's proximity to traffic
on Kendall Drive, the project could eventually. result in
exposure of some residents to exterior noise levels over 65
dB and interior noise levels above 45 dB. The following
mitigations for this potential noise impact shall be
conditions of approval for Tentative Tract 14252.

1. A perimeter wall shall~. required along Kendall
Drive.
2. Prior to recordation of the final tract map, an
acoustical analysis shall be submitted to the city
Engineer describing in detail the exterior noise
environment and any mitigation measures in addition
to the perimeter wall (e.g. berming) which might be
required to maintain an exterior noise level not
exceeding 65. dB.
Prior to the issuance of any building permits, an
Acoustical Analysis Report describing the acousti-
cal design features of the structures required to
satisfy the exterior and interior noise standards
shall be submitted to Building and safety Depart-
ment along with satisfactory evidence which indi-
cates that the sound attenuation measures specified
in the approved acoustical report (s) have been'
incorporated into the design of the project.
3.
HIGH WIND HAZARD:
The proposed subdivision is located in an area subject to
high wind hazards. standard mitigations for high wind
hazards include construction capable withstanding 20 pounds
wind loads and tile roofs. These requirements will be
included in the Building and safety Department's Standard
Requirements.
FLAG LOT:
The proposed tract includes one flag lot, Parcel No. 25.
Flag lots are. not prohibited by the Municipal Code. DrivewaYs
of flag lots may not exceed 150 feet in length without Fire
Department approval. The access portion of parcel No. 25 is
110 feet long.

BLOCK WALL REQUIRED
Code Section 18.40.230 states that wher.e lots back up to a
street or highway and where it is intended that there be no
direct access from the lot to said street or highway, a six
foot decorative masonry wall shall be erected on the rear
property line to provide a physical separation between the
lot and the street or highway. The tentative map shows a
block wall for all parcels backing up to Shand!n Hills Circle
and Kendall Drive. The Commission may require an ~ight foot
wall to mitigate noise as deemed necessary.
TRAFFIC:
The City Traffic Engineer reviewed the proposed subdivision
and found that the additional project-generated trips are not
sufficient to cause a significant impact on the adjacent
street system.

INITIAL STUDY
The proposal is to estaDlish a 33-lot single family subdivi-
sion on a site encompassing 11.1 acres in the Residential
SUDurDan land use designation. The applicant requests a
variance from Code Section 18.40.130 to allow a cul de sac
approximately 980 feet in length. The applicant proposes to
provide a 20-foot wide easement with a crash gate connecting
the end of the cul de sac with Kendall Drive in order to
provide access for emergency vehicles.
The irregularly-shaped project site is located at the south-
easterly corner of Kendall Drive and Shandin Circle Drive and
is an undeveloped parcel of land with commercial structures
north and west of the site and vacant land east and south of
the site. Most of the property in question is relatively
flat, DUt there is a large area of steep slopes on the south-
ernly portion of the site. The property is located in the
High Wind Hazard zone.

3.a POTENTIAL IMPACT:
Grading of the site and the construction of houses and
streets will alter absorption rates and the rate and patterns
of surface runoff on the site.

Mitigations:
1. All runoff will be directed to approved drainage
facilities which are adequate to handle the
anticipated volume of runoff. Existing drainage
facilities were designed to accommodate the anti-
cipated volume of runoff from the project area.

s.b.POTENTIAL IMPACT
Due to the site's proximity to traffic on Kendall Drive, the
project could result in exposure of residents to exterior
noise levels over 65 dB and interior noise levels above 45
dB.
Mitigation:
1. A perimeter wall shall be required along Kendall
Drive.
2. Prior to recordation of the final tract map, an
acoustical analysis shall be submitted to the city
Engineer describing in detail the exterior noise
environment and any mitigation measures in addition
to the perimeter wall (e.g. berming) which might be
required to maintain an exterior noise level not
exceeding 65 dB.
3. Prior to the issuance of any building permits, an
Acoustical Analysis Report describing the acousti-
cal design features of the structures required to
satisfy the exterior and interior noise standards
shall be submitted to Building and Safety Depart-
ment along with satisfactory evidence which in-
dicates that the sound attenuation measures spec-
ified in the approved acoustical report (s) have
been incorporated into the design of the project.

hazard in that a 20 foot easement with crash gates will
