We are proposing to refurbish an old existing building and site that has been vacant for some time at the northwest corner of Rancho and Rialto Avenues and wish to appeal certain Conditions made by the Design Review Committee. as they are~onditions imposed that were not fully discussed at the review lIeetillg. o These Conditions or Requirements are: 1) Street Improvements required for Rancho AVlmUe: There. are existing improvements aeross'a portion of this frontage already (curbs, sutters and driveway) but the committee wants to relocate the driveway, install sidewalk and extend the curb and gutter to the north. The existing driveway and facilities served this property when it was used as a restaurant and had considerable IDOre usage than what is now proposed. To move the driveway. add sidewalk and extend the curb and gutter approximately 12 feet would also require moving a large telephone pole that is no~ in the proposed street section. It would be far more feasible and reasonable to move the pole back and put in the curb and gutter when the property to ,the north is developed. (By the way, we also own this piece of property.) We would be willing to put up a cash Bond for the road improvements until the property to the north is developed. The proposal to run trucks through the si te makes the project sigificantly different from the previous restaurant use. o 2. In order to safely accommodate trucks heading Southbound and turning right into the site. Rancho Avenue needs to be wi dened, curb and gutter constructed and the power pol e relocated to 2' behind the new curb and 5' clear of the driveway apron. A transition to meet the existing pavement North is also needed. 3. A portion of the existing driveway apron is located across the South property line which is not normally allowed. The apron needs to be centered on the proposed drive aisle and a flared type apron provided for better ingress/egress for the trucks. The Engineering Division recommends that the requirement along Rancho Avenue for widening, transition, curb and gutter, power pole relocation. and removal and reconstruction of the driveway apron to provide a 24'-wide flared and centered approach be affirmed so as to assure improved traffic safety due to ingressing/egressing trucks. REQUEST The applicant, Elliott precision Block Company, is appealing a Development Review Committee Standard Condition of Approval requiring Improvement Dedications of Review of Plans 89-3. The applicant requests that Planning Commission waive street improvement requirements (See Appeal letter, Attachment "B"). o 2 . LOCATION The 1.6 acre site is located Rancho and Rialto Avenues at location map, Attachment "G") on the northwest corner of 110 Rancho Avenue. (See 3. MUNICIPAL CODE, INTERIM POLICY DOCUMENT AND DRAFT GENERAL PLAN CONFORMANCE The proposed project is consistent with the Municipal Code and in conformity with the Interim Policy Document as shown in Attachment "A". Under the Draft General Plan, the site is designated as CH, Commercial Heavy. The use is consistent with the proposed General Plan. 4 . BACKGROUND o The application for Conditional Use Permit 86-19 to re-open an existing bar and grill restaurant to permit. on-site consumption of alcoholic beverages was approved by the Planning Commission on June 17, 1986. An extension of time for Conditional Use Permit 86-19 was subsequently approved by the Planning Commission at its May 19, 1987 meeting. According to Building and Safety Department's records, a Certificate of Occupancy was never issued to re-open the bar and grill restaurant. ~ - - & - 21. . o 0 MEMORANDUM TO PLANNING COMMISSION - REVIEW OF PLANS NO. 89-3 MAY 3, 1989 PAGE 2 o Under Review of Plans 89-3, Elliott Precision Block Company, the applicant, will be intensifying the use of the project site by converting the 3,009 square feet bar and grill restaurant and a storage shed into two (2) office buildings. Once converted, the office building will serve as a retail sales and display area for concrete blocks. APPLICANT'S CONCERNS o The applicant states that the street improvements should be deferred until the property to the north of project site is developed and then, all improvements can occur simultane- ously. The adjacent property of the project site is also owned by Elliott Precision Block Company. The applicant is willing to post a cash bond in lieu of the immediate improvements, until the north property is developed (see Appeal letter, Attachment "B"). o o c .... -. -- L . ~ il o o MEMORANDUM TO PLANNING COMMISSION - REVIEW OF PLANS NO. 89-3 MAY J, 1989 PAGE J ENGINEERING'S CONCERNS Planning staff met with the Engineerinq staff to d~scuss the applicant's appeal. The following comments were made: The relocation of the existing utility pole approximately 2 feet behind the new curb is necessary in that the proposed office and display area will generate trailer trucks with three or more axles delivering concrete blocks to the project site. A trailer truck will not have the proper turning radius, causing a health and safety danger. Engineering is also requesting the applicant to relocate the driveway to be centered on the proposed drive isle for alignment of the driveway. The existing driveway is across the property line, which is only allowed if there is a need for common access. This is not the case of the applicant. The relocation of the utility pole behind the proposed curb, installation of 36 feet (Type 2) flair type driveway and 40 feet center gate will enable trailer trucks to safely enter and leave the project site. Written comments have been requested from Engineering Depart- ment regarding the required improvements. The attached letter from the City Engineering Department is in support of the standard condition for the street improvements requirement. (See Engineering Department letter, Attachment "0". ) BOND ANALYSIS The applicant requests to post a cash bond in lieu of com- pleting the required improvements until the adjacent pro- perty, which is also owned by Elliott precision Block Company, is developed. The owner has been contacted several times on the specifics of posting the bond and has not returned Planning staff's calls to date. The Engineering staff is opposed to the applicant posting a cash bond in lieu of improvements in that the City will be compromising the health and safety of its residents. Also, there have been no development plans submitted for the area north of the project site. To defer these improvements will not guarantee development of the adjacent parcel. If the property is sold, the applicant can withdraw the bond leaving the city without any leverage in assuring that the necessary development guidelines are met. ! 6. MUNICIPAL BOND Resolution No.8J-48, section 12 (B) allows discretion by the Planning commission for applying standard requirements. CONCLUSION The improvements to the project site are necessary in order to insure the health and public safety of the City's resi- dents. Without these improvements a dangerous situation at the project site will exist due to the location of the utility pole and the turning radius required for large trucks. Also, the existing entry gate and driveway are too narrow for trailer trucks to enter the project site. Improvement to the project site should not be deferred until the adjacent property to the north is developed, nor shOUld a cash bond be permitted to be posted in lieu of required improvements. There have been no development plan submitted for the area north of the project site. To defer these improvements will not guarantee development of the adjacent parcel. o RECOMMENDATION Staff recommends that the Planning Commission deny the appeal and uphold the decision of the Development Review Committee to approve the Review of Plans 89-3 subject to all Conditions and Standard Requirements imposed, including street improve- ments and relocation of the utility pole. However, this item was inadvertently excluded. I have attached the Planning Department's Standard Requirements which shall be complied with in meeting the City's development quidelines. The site plan submitted for Review of Plans No. 89-3 shows that there will be an outdoor storage areas located on the project site. Municipal Code 19.36.020 (F) requires: "that a six-foot high chain link fence with a solid screen or masonry wall be installed around the storage area." Components - low gallonage and low precipitation heads, drip systems and other sub-surface techniques, mini jet heads, moisture sensing devices, controllers with ability of variable programming. B. Efficiency - velocity shall be close as possible to 5 feet per second. Plant material with different water requirements shall be on separate valves. Slopes shall be on separate valves. System design shall eliminate costly, wasteful, overthrow and runoff. 4. Plans shall show: o A. Static P.S.I. B. Service ~in - type, size and length. C. Water ~eter - location and size. D. Approved Backflow Prevention Device - location and size. E. All locations of pipe, valves and heads, (includes e~itters. etc.) 5. Slopes required to be planted shall be provided with efficient and water conserving irrigation systems. NOTE: Actual water application rates shall be applied, as soil absorption rates dictate. Over watering shall be avoided. 6. All sprinklers shall be installed with approved swing joints. 7. All above ground sprinklers shall be the pop up type, installed flushed with the soil. The proposal to run trucks through the project sigificantly different from restaurant use. si te makes the the previous 2. In order to safel y accommodate trucks headi ng Southbound and turning right into the site, Rancho Avenue needs to be wi dened, curb and gutter constructed and the power pol e relocated to 2' behind the new curb and 5' clear of the driveway apron. A transition to meet the existing pavement North is also needed. 3. A portion of the existing driveway apron is located across the South property line which is not normally allowed. The apron needs to be centered on the proposed drive aisle and a flared type apron provided for better ingress/egress for the trucks. The Engineering Division recommends that the requirement along Rancho Avenue for widening, transition, curb and 9utter, power pole relocation, and removal and reconstruction of the driveway apron to provide a 24'-wide flared and centered approach be affirmed so as to assure improved traffic safety due to ingressing/egressing trucks. BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Review of Plans Required. Prior to any development or improvement of any parcel of land intenced for commercial, industrial or multi-family residential development intended for occupancy by more than t~o families, a for~al rev~e~ of plans shall be i~stituted. and approval of such plans shall be required. SECTION 2. Plannin:;1; Deoartment to Conduct. The revie\v of plans shall be conducted by the Planning Department in conjunction with other departments to determine whether the pla~s and proposals comply with the affected department's provisions and development standards prescribed in the San Bernardino Municipal Code, the provisions of this and other resolutions of the ~ayor and Common Council, and standard procedures estab:ish~= by the de?art~ent with the approval of the Mayor and Common Counc i 1 . Suitability of the site for the proposed use or development with the General Plan. Consideration shall be given to the ef~ect of proposed developments on neighboring properties and traffic circulation, in order to protect the public health, sarety and ge~eral welfare of the community. C. Compliance of the proposed development with each or the findiqngs required under this resolution. SECTION 8. Aooroval - Findin~s. The Planning Department shall approve or reject the plans submitted for review, and the decision shall be final unless an appeal to the Planning Commission is filed, in writing, by the applicant within ten day; of the decision.
