On March 2, 1989, the Development Review Committee approved
Review of Plans No. 89-3, subject to conditions and standard
requirements.
On May 3, 1989, the Planning Commission voted to deny the appeal
of certain conditions of approval by a 5 to 0 vote.
Recommended motion: That the hearing be closed; that the appeal be upheld and Review of Plans
No. 89-3 approved subject to the driveway street improvement being deferred
until the property to the north is developed; that a cash bond be posted in the
amount of the deferred improvements; that the project is subject to all other

We are proposing to refurbish an old existing building and site
that has been vacant for some time at the northwest corner of
Rancho and Rialto Avenues and wish to appeal certain Conditions
made by the Design Review Committee. as they are~onditions imposed
that were not fully discussed at the review lIeetillg.

These Conditions or Requirements are:
1) Street Improvements required for Rancho AVlmUe:
There. are existing improvements aeross'a portion of
this frontage already (curbs, sutters and driveway)
but the committee wants to relocate the driveway, install
sidewalk and extend the curb and gutter to the north.
The existing driveway and facilities served this property
when it was used as a restaurant and had considerable IDOre
usage than what is now proposed. To move the driveway.
add sidewalk and extend the curb and gutter approximately
12 feet would also require moving a large telephone pole
that is no~ in the proposed street section.
It would be far more feasible and reasonable to move the
pole back and put in the curb and gutter when the property
to ,the north is developed. (By the way, we also own this
piece of property.) We would be willing to put up a cash
Bond for the road improvements until the property to the
north is developed.

In response to your memo dated Apri 1 21. 1989, regarding an
appeal. by Elliot Precision Block Company. of Engineering
Conditions of Approval for the subject project. we have the
following comments:
1. The proposal to run trucks through the si te makes the
project sigificantly different from the previous
restaurant use.
o
2. In order to safely accommodate trucks heading Southbound
and turning right into the site. Rancho Avenue needs to be
wi dened, curb and gutter constructed and the power pol e
relocated to 2' behind the new curb and 5' clear of the
driveway apron. A transition to meet the existing
pavement North is also needed.
3. A portion of the existing driveway apron is located across
the South property line which is not normally allowed.
The apron needs to be centered on the proposed drive aisle
and a flared type apron provided for better ingress/egress
for the trucks.
The Engineering Division recommends that the requirement
along Rancho Avenue for widening, transition, curb and gutter,
power pole relocation. and removal and reconstruction of the
driveway apron to provide a 24'-wide flared and centered
approach be affirmed so as to assure improved traffic safety
due to ingressing/egressing trucks.

GENERAL PLAN CONFORMANCE
The proposed project is consistent with the Municipal Code
and in conformity with the Interim Policy Document as shown
in Attachment "A". Under the Draft General Plan, the site is
designated as CH, Commercial Heavy. The use is consistent
with the proposed General Plan.
4 . BACKGROUND

The application for Conditional Use Permit 86-19 to re-open
an existing bar and grill restaurant to permit. on-site
consumption of alcoholic beverages was approved by the
Planning Commission on June 17, 1986. An extension of time
for Conditional Use Permit 86-19 was subsequently approved by
the Planning Commission at its May 19, 1987 meeting.
According to Building and Safety Department's records, a
Certificate of Occupancy was never issued to re-open the bar
and grill restaurant.

Under Review of Plans 89-3, Elliott Precision Block Company,
the applicant, will be intensifying the use of the project
site by converting the 3,009 square feet bar and grill
restaurant and a storage shed into two (2) office buildings.
Once converted, the office building will serve as a retail
sales and display area for concrete blocks.

APPLICANT'S CONCERNS

The applicant states that the street improvements should be
deferred until the property to the north of project site is
developed and then, all improvements can occur simultane-
ously. The adjacent property of the project site is also
owned by Elliott Precision Block Company. The applicant is
willing to post a cash bond in lieu of the immediate
improvements, until the north property is developed (see
Appeal letter, Attachment "B").

ENGINEERING'S CONCERNS
Planning staff met with the Engineerinq staff to d~scuss the
applicant's appeal. The following comments were made:
The relocation of the existing utility pole approximately 2
feet behind the new curb is necessary in that the proposed
office and display area will generate trailer trucks with
three or more axles delivering concrete blocks to the project
site. A trailer truck will not have the proper turning
radius, causing a health and safety danger.
Engineering is also requesting the applicant to relocate the
driveway to be centered on the proposed drive isle for
alignment of the driveway. The existing driveway is across
the property line, which is only allowed if there is a need
for common access. This is not the case of the applicant.
The relocation of the utility pole behind the proposed curb,
installation of 36 feet (Type 2) flair type driveway and 40
feet center gate will enable trailer trucks to safely enter
and leave the project site.
Written comments have been requested from Engineering Depart-
ment regarding the required improvements. The attached
letter from the City Engineering Department is in support of
the standard condition for the street improvements
requirement. (See Engineering Department letter, Attachment
"0". )
BOND ANALYSIS
The applicant requests to post a cash bond in lieu of com-
pleting the required improvements until the adjacent pro-
perty, which is also owned by Elliott precision Block
Company, is developed. The owner has been contacted several
times on the specifics of posting the bond and has not
returned Planning staff's calls to date.
The Engineering staff is opposed to the applicant posting a
cash bond in lieu of improvements in that the City will be
compromising the health and safety of its residents. Also,
there have been no development plans submitted for the area
north of the project site. To defer these improvements will
not guarantee development of the adjacent parcel. If the
property is sold, the applicant can withdraw the bond leaving
the city without any leverage in assuring that the necessary
development guidelines are met.

MUNICIPAL BOND
Resolution No.8J-48, section 12 (B) allows discretion by the
Planning commission for applying standard requirements. The

applicant, Elliott precision Block Company, does not have any
particular circumstances to warrant a waiver of the standard
requirements.
7. CONCLUSION
The improvements to the project site are necessary in order
to insure the health and public safety of the City's resi-
dents. Without these improvements a dangerous situation at
the project site will exist due to the location of the
utility pole and the turning radius required for large
trucks. Also, the existing entry gate and driveway are too
narrow for trailer trucks to enter the project site.
Improvement to the project site should not be deferred until
the adjacent property to the north is developed, nor shOUld a
cash bond be permitted to be posted in lieu of required
improvements. There have been no development plan submitted
for the area north of the project site. To defer these
improvements will not guarantee development of the adjacent
parcel.

RECOMMENDATION
Staff recommends that the Planning Commission deny the appeal
and uphold the decision of the Development Review Committee
to approve the Review of Plans 89-3 subject to all Conditions
and Standard Requirements imposed, including street improve-
ments and relocation of the utility pole.

In reviewing your case file, it has come to my attention that
the standard requirements from the Planning Department should
have been included as part of the March 8th approval letter.
However, this item was inadvertently excluded. I have
attached the Planning Department's Standard Requirements
which shall be complied with in meeting the City's
development quidelines.
The site plan submitted for Review of Plans No. 89-3 shows
that there will be an outdoor storage areas located on the
project site. Municipal Code 19.36.020 (F) requires: "that a
six-foot high chain link fence with a solid screen or masonry
wall be installed around the storage area." Compliance with
all standard requirements shall be mandatory before a certi-
ficate of Occupancy can be issued,

Lighting levels on the exterior of building is to provide a minimum of one
(1) foot candle of "maintained" illumination on the parking . surface from
dusk until the termination of business each operating day.
All exterior doors to building shall be equipped with an illumination
device capable of providing a minimum of one (1) foot candle of maintained
illumination at ground level during hours of darkness.
All exterior lighting devices are to be inaccessible to common reach or
climbing shall be protected by weather and vandalism-resistant and be
valdal .resi stant. All exterior lighting shall be projected so as not to
cast light onto adjoining properties.
All roof openings giving access to the building shall be secured with
either iron bars, metal gates, stamped metal or shall be alarmed and meet

DOORS, LOCKS, AND WINDOWS
Swinging exterior glass doors, wood or metal doors with glass panels, solid
wood or metal doors shall be constructed or protected as follows:
a. Wood doors shall be of solid core construction with a minimum thickness
of 1 3/4 inches.
b. Hollow metal doors shall be constructed of a minimum equivalent to six-
teen U. S. guage steel and have sufficient reenforcement to maintain
the designed thickness of the door when any locking device is installed
suCh as reenforcement being able to restrict collapsing of the door
around the locking device.

c. Except when double cylinder dead bolts are utilized, any glazing uti-
lized within 40'. of any door locking mechanism shall be constructed or
protected as follows: Fully tempered glass or rated burglary resistant

a. A single or double door shall be equipped with a double or single
cylinder dead bolt. The bolt shall have a minimum projection of 1" and
be constructed so as to repel cutting tool attack. .
b. The dead bolt shall have an embedment of at least 3/4" into the strike
receiving the projected bolt. The Cylinder shall have a cylinder
guard, a minimum of five pin tumblers and shall be connected to the
inner portion of the lock by connecting screws of at least 1/4" in
diameter. The recommendation does not apply when panic hardware is
required or an equivalent device is approved by the Building Code.

Double doors shall be equipped as follows:
a. The active leaf of double doors shall be equipped with metal flush
bolts having a minimum embedment of 5/8" into the head and threshhold
of the door frame. Double doors shall have an astragal constructed of
steel, a minimum of .125" thick which will cover the opening between
the doors. This astragal shall be a minimum of 2" wide and extended a
minimum of 1" beyond the edge of the door to which it is attached. The
astragal shall be attached to the outside of the active door by means
of welding or with nonremovable bolts spaced apart on not more than 10"
centers. Hinges for outswinging doors shall be equipped with nonremo-
vable hinge pins .or a mechanical inner lock to preclude removal of the
door from the exterior by removing the hinge pins. Strike plates shall
be a mi ni mum of 3i" in length and secured to the jamb wi th screws a
minimum of 2i" in length.
Windows:

a. All moveable windows shall be equipped with a locking device and shall
be constructed in a fashion to restrict them from being lifted out of
its track when in closed position.

a. The above-described doors shall conform to the following standards:
(1) Wood doors shall have panels a minimum of five-sixteenths (5/16)
inch in thickness with the locking hardware being attached to the

riveted together a minimum of eighteen (18) inches on center along
the outside seams. There shall be a full width horizontal beam
attached to the main door structure which shall meet the pi lot, or
pedestrian access, door framing within three (3) inches of the
strike area of the pilot or pedestrian access door.

(1) Slide bolt assemblies shall have a frame a minimum of .120 inches
in thickness, a bolt diameter a minimum of one-half (i) inch and
protrude at least one and one-half (Ii) inches into the receiving
guide. A bolt diameter of three-eights (3/8) inch may be used in a
residential building.
(2) S I ide bo lt assemb lies shall be attached to the door wi th bolts
which are nonremovable from the exterior. Rivets shall not be used
to attach such assemblies.
e. Padlocks used with exterior mounted slide bolts shall have a hardened
steel shackle a minimum of nine-thirty-seconds (9/3~) inch in diameter
with heel and toe locking and a minimum five (5) pin tumbler operation.
The key shall be nonremovable when in an unlocked operation.
f. Doors utilizing a cylinder lock shall have a minimum five (5) pin
tumbler operation with the bolt or locking bar extending into the
receiving guide a minimum of one inch.

A. Landscape Pl an
Four (4) copies of a master landscape plan shall be submitted to the
Public Works/Engineering Department for review and approval by the
Planning Department and Parks, Recreation and Community Services De-
partment staff. Plans shall meet the Procedure and Policy Guidelines
established in the Standard Re uirements for Landsca in and Irri ation.
The plan shall include, but not be imited to, the 0 owing:
1. Size, type, and location of plant material proposed.
2. Irrigation plan.
3. Such other alternate plants, materials and design concepts as may
be proposed.
4. Name and address of owner, address of property, name, address and
phone number of plan preparer.
5. Erosion control plans (where necessary or specified) will be reviewed
by all departments with the primary responsibility with Public Works/
Eng i neer; ng.
B. Trees
Tree varieties and exact locations will be determined prior to planting
by the Director of Parks, Recreation and Community Services Department
or his/her designee. A minimum number of 1 inch calioer/15 gallon (24"
box specimen preferred), multibranched trees shall be planted within the
public parkway right-of-way at a minimum of 30 feet on center. Varieties
and exact location shall be determined by the Director of Parks, Recreation
and Community Services. Consideration to be given to site, access,
utilities, etc.
C. Plant Material
Landscaped areas shall have plant material selected and planting methods
used which are suitable for the soil and climatic conditions of the San
Bernardino Arid Area. Sizes of the plant materials shall conform to the
following mix:
Trees 20%, 24" boxes, 50:, 15 gallon, 30:, 5 gallon.
Shrubs 20:;, 5 gallon, 80%, 1 gallon.

I. PURPOSE
The intent and purpose of these guidelines is to provide:
1. Guidance in the required submittal of landscape and irrigation
plans.
2. Guidance in meeting street tree requirements.
3. Guidance in selection of plant material.
4. Guidance in what the plans (landscape and irrigation) shall show.
I!. SUBMITTALS
A. NUMBER OF P~';S ~"D SUBMITTAL PROCEDURE
~~ (1) copies each of landscape and irrigation plans shall be sub-
mitted to the Public Works/Engineering Department along with payment
of the appropriate Landscape Plan Review Fee.
B. LAXDSCAPE PL~~S
1. Shall be drawn by one of the following:
A. A registered landscape architect.
B. A licensed landscape contractor Who installs the actual
landscape.
C. A nursery.
D. The owner.
XOTE: The name, address, telephone number, along with signature of the
person(s) who do the design shall be on the plans. Registered
landscape architects and licensed landscape contractors shall
include their registration numbers and/or license numbers.
2. Plans shall be legibly drawn to scale on paper no smaller than
18" x 24" and no larger than ~4" x 36t1.
3. Plans shall show location of the property by vicinity :nap and
nearest cross streets and give the property address or assessor's
parcel number.
4. Plans shall show location of existing and proposed utilities - above
ground and underground.
S. Plans shall show type of zoning, the scale, and northerly directional
arrow.
6. Plans shall contain plant legends for all existing and proposed
plant material. The legend shall be as follows:

C. IRRIGATION PLANS
1. All required landscaping shall be provided with an automatic
irrigation system.
2. Plans shall be submitted with, attached to, and the same size as
landscape plans.
3. Plans shall address conservation of water and energy.
A. Components - low gallonage and low precipitation heads,
drip systems and other sub-surface techniques, mini jet
heads, moisture sensing devices, controllers with ability
of variable programming.
B. Efficiency - velocity shall be close as possible to 5 feet
per second. Plant material with different water requirements
shall be on separate valves. Slopes shall be on separate
valves. System design shall eliminate costly, wasteful,
overthrow and runoff.
4. Plans shall show:

A. Static P.S.I.
B. Service ~in - type, size and length.
C. Water ~eter - location and size.
D. Approved Backflow Prevention Device - location and size.
E. All locations of pipe, valves and heads, (includes e~itters. etc.)
5. Slopes required to be planted shall be provided with efficient and
water conserving irrigation systems.
NOTE: Actual water application rates shall be applied, as soil
absorption rates dictate. Over watering shall be avoided.
6. All sprinklers shall be installed with approved swing joints.
7. All above ground sprinklers shall be the pop up type, installed
flushed with the soil. Exposed sprinklers on risers above ground
are acceptable in limited areaS with "bubbler" type sprinklers
and do not border side~alks, walkways, or areas subject to
pedestrian traffic.
8. Separate water meter for landscape irrigation is optional at owners
request and expense.

reation and Comcunity Services Depart~ent shall mark locations and
inspect plant =aterial on site, prior to planting. Sidewalks, curb
and gutter, must be clean of debris prior to marking. A 24 hour
notice is required for inspection (see attached specifications for
Street ~ree planting and Street Iree list). The size of the Street
Trees shall be: 1. All 24 inch box speeimans, or 2. 25% or the total
amount of trees. The 24 inch box trees shall be planted as street
trees within the ?ublic park~ay or City property.

In response to your memo dated Apri 1 21, 19B9, regardi ng an
appeal, by Elliot Precision Block Company, of Engineering
Conditions of Approval for the subject project, we have the
following comments:

wi dened, curb and gutter constructed and the power pol e
relocated to 2' behind the new curb and 5' clear of the
driveway apron. A transition to meet the existing
pavement North is also needed.
3. A portion of the existing driveway apron is located across
the South property line which is not normally allowed.
The apron needs to be centered on the proposed drive aisle
and a flared type apron provided for better ingress/egress
for the trucks.
The Engineering Division recommends that the requirement
along Rancho Avenue for widening, transition, curb and 9utter,
power pole relocation, and removal and reconstruction of the
driveway apron to provide a 24'-wide flared and centered
approach be affirmed so as to assure improved traffic safety
due to ingressing/egressing trucks.

RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING A
PROCEDURE FOR REVIEW AND APPROVAL OF PLANS.
BE IT RESOLVED. BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Review of Plans Required. Prior to any
development or improvement of any parcel of land intenced for
commercial, industrial or multi-family residential development
intended for occupancy by more than t~o families, a for~al rev~e~
of plans shall be i~stituted. and approval of such plans shall be
required.
SECTION 2. Plannin:;1; Deoartment to Conduct. The revie\v of
plans shall be conducted by the Planning Department in
conjunction with other departments to determine whether the pla~s
and proposals comply with the affected department's provisions
and development standards prescribed in the San Bernardino
Municipal Code, the provisions of this and other resolutions of
the ~ayor and Common Council, and standard procedures estab:ish~=
by the de?art~ent with the approval of the Mayor and Common
Counc i 1 .

traffic flow.
SECTION 9. Action - Aooeal. The Planning Department shall
approve or reject the plans submitted for review, and the
decision shall be final unless an appeal to the Planning
Commission is filed, in writing, by the applicant within ten day;
of the decision.
SSC7ION 10. Si~~in~ and Datin~. Approved plans with the
standards at:ached ~hereto. if any. shall be da:ed and sig~ed on
behalf of the Planni~g Department of the :i~y by an au:horizec
official thereof.
SEC:ION 11. Com':lletion - Time Umi: - Ex':e!\sion. w"here
work on the development is not begun and diligently pursued
within one year after approval of the si:e ?la~ pertaining
thereto, or within eighteen months when a?proval is mace in
