STAFF REPORT
On November 18, 1988, President Reagan signed the Drug-Free
Workplace Act of 1988 into law. The act provides that, as.a
condition of doing business with the federal government, a
contractor seeking a contract for goods or services with a
value of $25,000 or more must certify to the contracting
agency.that the contractor will provide and maintain a drug-
free workplace. ~ince the city plans to apply for such
contracts in the future, it is obligated to comply with this
Act.
The Director of Personnel and Acting Director of Risk Manage-
ment compiled the attached resolution which establishes a
City policy in conf9rmance with this Act and the federal
regulatipnsgoverninq it. The Act only requires that City
employees "directly engaged in the performance of work under
a Government Contract" comply with its provisions. However,
Mayor Wilcox requested that the policy cover all City
employees.

RESOWTION OF THE CITY OF SAN BERNARDINO ADOPTING POLICY
IMPLEMENTING DRUG FREE WORKPLACE ACT OF 1988.
WHEREAS, the Drug Free Workplace Act of 1988 (PL100-690)
requires the city of San Bernardino to certify the City will
provide a drug-free workplace before the City can obtain
federal contracts of $25,000 or more; and
WHEREAS, the City is a recipient of said federal con-
tracts;
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO that the attached policy
(exhibit A) regarding the Drug Free Workplace Act Implementa-
13 tion, is adopted effective June 6, 1989.

1. The unlawful manufacture,
or use
work is prohibited. As a condition of employment, each
City employee is required to abide by this statement. In
addition, any employee who is convicted of any "criminal
drug statute" occurring in the workplace is required to
notify the Director of Personnel no later than 5 days
after such conviction. Any employee who violates these
requirements shall be subject to disciplinary action up
to and including dismissal in accordance with city policy
governing disciplinary action.
2. Drug abuse in the workplace may lead to serious safety
concerns for the abuser, fellow employees, and the
general public being served by the abuser. specifically,
drug users may be causing irreparable damage to their
bodies which can lead to serious illness and even death;
and, endangering the lives and property of others because
of their impaired mental and physical condition.
3. The City of San Bernardino has established this policy
of maintaining a drug-free workplace. Any employee or
citizen who becomes aware of any violations of this
policy should report them to the Personnel Department at
384-5161.

4. The City contracts with "The Counseling Team" to
provide a comprehensive employee assistance and
counseling program. The Counseling Program is designed to
help employees and their family members find direction in
solving personal or emotional problems. Drugs and alcohol
are two problem areas in which "The Counseling Team"
provides assistance. All employees are encouraged to
contact one of their trained counselors when faced with
such personal problems. Their confidential telephone
number is (714) 884-0133. The supervisor of an employee
using this service will not be notified unless requested
by the employee.
