This is to recommend approval of the necessary agreements required to initiate
the development of the Norton Economic Expansion Plan (NEEP). Further, to
ensure proper management of the development of the NEEP, it is recommended
that the position of Norton Reuse Coordinator be created in the Agency as
either a temporary employee or as a consultant.
BACKGROUND:
On April 3, 1989 the Commission authorized stsff to initiate all preliminary
steps needed to consider establishing a Redevelopment Survey Area for Norton
Air Force Base (NAPB) and appropriate surrounding areas. These preliminary
steps, among other things, included development of an initial planning budget
and financing plan as well as recommendations for staff services requirements.
to accomplish these tasks, a special staff committee was formed consisting of
the Acting City Administrator, Planning Director and Executive Director of the
Redevelopment Agency. After carefully studying the issues, this committee has
formulated the recommendations contained on Attachment I. In order to
effectuate the committee's suggestions it is recommended that:
1. At a minimum, the County of San Bernardino, City of San Bernardino
and the Redevelopment Agency of the City of San Bernardino should
enter into a Cooperation Agreement governing the development of the
NEEP. A draft of the recommended agreement is attached for your
information. It is, therefore, recommended that the County be
invited to enter into an appropriate cooperation agreement with the
City and the Agency.
2. The Redevelopment Agency and the City approve loan documents which
will capitalize the initial efforts at development of the NEEP at
*300,000. The recommended amount is a very conservative estimate
that the special staff committee feels is sufficient for all
first-year efforts. The Loan Agreements are attached and were
prepared by Special Counsel with input and guidance from the City
Attorney and Agency Counsel. The necessary funding, which will
originate from the Southeast Industrial Park Redevelopment Project,
will flow first through the City then to the Agency for the NEEP
project.
3. The Community Development Commission authorize through June 30, 1990
the creation of a special position or consultancy within the
Redevelopment Agency. The position, to be referred to as the "Norton
Reuse Coordinator", will be responsible for day to day management of
the development of the NEEP. The Coordinator's services will be
provided to the City Administrator with on-going advice from the
other members of the special staff committee noted above. It is
recommended that the position either be established as a limited-term
appointment at an annual salary range of *56,172 to *68,460 (Deputy

Director equivalent) depending upon the qualifications of the
applicant; or alternatively, offered on a consultant contract basis
with total compensation equivalent to the above proposed salary plus
the value of benefits. Further, in consideration of the urgent need,
it is requested that the Executive Director be authorized to recruit
and hire (through temporary employment or contract) the Norton Reuse
Coordinator under the conditions described herein, subject to the
recommendation of the other members of the special staff committee
noted above and the concurrence of both the Commission Chairman and
Redevelopment Committee Chairperson. For your information, it is
anticipated that the services of a professional personnel recruitment
firm will be utilized to identify potential candidates for this
position.
It is important to note that the creation of the coordinator position will not
in itself satisfy all of the Agency's staffing needs relative to accomplishing
the redevelopment planning and implementation activities for the Norton
project. These activities together with those required for the Kt. Vernon
Business Corridor Project will require further staff adjustments. These
changes are anticipated to be recommended as a part of the Agency's Fiscal
Year 1989/90 budget.
Since it is important that above noted actions be initiated immediately, it
was not possible to first submit them to the Redevelopment Committee for
review. However, the matter was discussed with the Committee's Chairperson.
It is, therefore, recommended that the Kayor and Common Council and the
Commission authorize the actions described above.

1. In response to the ImpendIng closure of Norton AIr Force Base (NAFB>,
there Is an urgent need to create a comprehensive Norton EconomIc
ExpansIon Plan (NEEP>.
2. In accordance wIth a multI-jurisdIctional cooperatIon agreement (see No.
4 below>, the CIty of San BernardIno should be the lead agency In
developIng the plan wIth the cooperatIon of the other partIcIpatIng
jurIsdIctIons and the Input and advIce from the Norton EconomIc Expansion
CommIttee (NEEC>. This plan should contaIn the fOllowIng basIc elements:
a. FAA Study - ThIs component of the plan wIll evaluate and
defIne the cIvIlIan aIrport operatIons envelope of opportunIty
for Norton. The study wIll also recommend alternatIves for
airport management and operatIons, whIch could Include some
form of shared or joInt powers authorIty.
b. Reuse Study - Based upon the results of the FAA study, the
reuse plan wIll IdentIfy those portIons of NAFB that wIll be
requIred for dIrect alport uses and whIch portIons wIll be
avaIlable for aIrport-related uses IncludIng recommendatIons
for the most approprIate types of uses. The study wIll be
specIfIc enough to guIde future development plannIng efforts.
c. Redevelopment study - In concert wIth the fIrst two components
of the overall plan, all of the steps legally requIred to be
taken under CalIfornIa Law for adoptIon of a new redevelopment
area wIll be pursued for NAFB and adjacent areas. ThIs could
Include the terrItory of adjacent cItIes as well as
unIncorporated terrItory. The Inclusion of terrItory outsIde
the jurIsdictIon of the City of San BernardIno Is subject to
the wIllIngness of the affected entItIes to joint-venture or
act cooperatIvely wIth the City of San Bernardino. This
joInt-venture or cooperatIve effort could either result in a
combIned redevelopment project (If a joInt powers authorIty
approach were to be consIdered, then CalifornIa Redevelopment
Law changes will probably be needed> or separate ones that are
planned simultaneously and implemented cooperatively. . To
consider ImplementIng thIs approach, each affected
jurIsdictIon should be formally InvIted to consIder thIs type
of partIcIpatIon. If they wIsh to do so, then they wIll be
asked to take approprIate steps consIstent wIth the CIty of
San BernardIno eIther IndIvidually or through a joInt effort.
In consIderatIon of the potentIal lack of redevelopment
expertIse on the part of the other jurisdIctions, especially
the County, the CIty wIll provide assIstance in accomplIshing
the technical requIrements, as needed.

3. The development of the overall plan will be partially financed by both
Federal and State grants. Each participating jurisdiction will be asked
to contribute funds proportionate to their involvement and to cover their
own related expenses.
4. To obtain the Federal and State grants, and at a minimum, the City and
County of San Bernardino and the San Bernardino Redevelopment Agency
should enter into a cooperation agreement for development of the Norton
Economic Expansion Plan. The other potentially affected jurisdictions
should be formally invited to join in this cooperation agreement. Under
the cooperation agreement, the County, together with the City and with
all necessary City assistance, will apply for the available grants. The
County upon receipt of the grants, should then pass through to the City
that portion of the grant funds that the granting agency has designated
for activities which are the responsibility of the City. Other agencies
wishing to participate financially in the plan must first enter into the
cooperative agreement with the City, County and the Agency. Any
subsequently received grant funds designated for activities which are the
responsibility of these jurisdictions should be passed through to them by
the County.
5. Subsequent to the approval of the cooperation agreement and the Agency's
initial staffing plan for management of the development of the NEEP, the
Agency will acquire and provide project management services to the City
and cooperate in drafting and issuing the necessary consultant RFQ(s) to
begin the formal development of the NEEP.

COOPERATION AGREEMENT
FOR DEVELOPMENT OF THE NORTON ECONOMIC EXPANSION PLAN
THIS COOPERATION AGREEMENT is entered into this day
of , 1989, by and between THE COUNTY OF SAN BERNARDINO, a
political subdivision of the State of California, ("County"), the City of San
Bernardino, a municipal corporation and a Charter City, ("City") and the
Redevelopment Agency of the City of San Bernardino, a public agency
established and existing under the laws of the State of California ("Agency">.
WITNESSETH:
WHEREAS, the federal government has decided to essentially close Norton
Air Force Base ("NAFB") located in the City of San Bernardino, and
WHEREAS, such closure could have a severe, adverse economic impact on the
City of San Bernardino and surrounding areas unless strong steps are taken to
turn such a closure into an economic benefit, and
WHEREAS, there Is an urgent need to create a comprehensive Norton
Economic Expansion Plan ("NEEP"), and
WHEREAS, to properly prepare the NEEP it is In the best Interests of the
parties to this agreement to cooperate fully with all public jurisdictions
that may be affected by the closure of NAFB, and
WHEREAS, to encourage regional participation on the preparation of the
NEEP, the parties to this agreement should formally Invite the public
jurisdiction members of the Norton Economic Expansion Committee to also enter
Into this Agreement by later amendment, and
WHEREAS, with the full cooperation of the parties to this Agreement. the
NEEP should be developed under the guidance of the parties with the City of
San Bernardino as the lead agency with Input and advice from the Norton
Economic Expansion Committee as well as other interested groups and agencies,
and
WHEREAS, such a plan should evaluate and define the civilian airport
operations envelope of opportunity for the Norton area as well as options for
airport management and operations ("FAA Study"), and
WHEREAS, based on the FAA study, a reuse plan should be developed which
will identIfy those portions of the Norton area that will be required for
direct airport uses and which portions will be available for airport related
uses, ("Reuse Study") and
WHEREAS, in concert with the FAA Study and the Reuse Study portions of
the NEEP, all of the steps legally required to be taken under California law
for adoption of a new Redevelopment project area or areas through either
multi-jurisdictional cooperation or joint effort should be considered for the
Norton area, and

WHEREAS, the development of the overall plan should be financed
to the maximum extent feasible by both Federal and State grants,
NOW THEREFORE, the parties hereto agree as follows:
1. County, City and Agency hereby agree to cooperate In the
development of the Norton Economic Expansion Plan.
2. County shall, at the mutal request, assistance and
cooperation of the parties, apply for appropriate available grants to
offset some of the costs associated with the development of said plan.
3. County, upon receipt of said grants, shall pass through to
the appropriate parties that portion of the grant funds that the granting
agency has designated for activities which are their responsibility.
4. County, City and Agency shall together formally Invite the
other public jurisdictions that may be affected by the closure of NAFB to
consider entering Into this Agreement by written amendment.
5. None of the parties to this Agreement shall be considered as
agents or employees of the other parties, but for all Intents and
purposes shall be considered as Independent contractors, unless such
agency status Is necessary for the qualification for any specific grant.
6. The term of this Agreement shall be three (3) years from the
date first above shown unless extended by written agreement of the
parties.

WHEREAS, the City proposes to loan and the Agency proposes
to borrow Three Hundred Thousand Dollars ($300,000.00) pursuant

Exhibit "A" and is incorporated herein by reference;

to invest any money held in reserves or sinking funds, or any
money not required for immediate disbursement, in property or
securities; and
B. WHEREAS, there are presently available to the Agency
funds generated by the Southeast Industrial Park Redevelopment
Project (the .Project.), which may be invested; and
D. WHEREAS, the City desires to borrow funds from the
Agency;
NOW, THEREFORE, the City and Agency agree as follows:

1. The Agency agrees to loan Three Hundred Thousand
Dollars ($300,000.00) to the City. The City shall, in
c:; consideration of such investment, be obligated to pay to the
Agency within the current fiscal year the amount of Three
Hundred Thousand Dollars ($300,000.00) (the "Loan Amount"),
plus interest accruing at the lesser of (i) twelve percent
(12\) or (ii) the maximum interest rate that may lawfully be
paid by a City. The Agency shall consider but is not obligated
to extend the time for repayment for an additional year.
2. This Agreement shall be effective as of the day

Area"); and
WHEREAS, the Agency is authorized to invest funds not
immediately necessary for the implementation of the

feasibility of the redevelopment of a potential redevelopment
survey area including the Norton Air Force Base and its
environs (the "Potential Survey Area"); and
WHEREAS, the redevelopment of the Potential Survey Area
would address blighting influences within the vicinity of the
Project Area and would substantially benefit the Project Area
and the community; and

WHEREAS, in order to effectuate the provisions of the
Redevelopment Plan, the Agency proposes to loan and the City

Plan and provisions of the Community Redevelopment Law (Health
& Safety Code Section 33000, et seq.) is authorized to' borrow
funds to facilitate redevelopment; and
F. WHEREAS, no other reasonable means of financing such
administrative expense~ is available;
NOW THEREFORE, the City and the Agency agree as follows:
1. The City agrees to loan Three Hundred Thousand
Dollars ($300,000.00) to the Agency. The Agency shall, in
consideration of such loan, be obligated to pay to the City the
amount of Three Hundred Thousand Dollars ($300,000.00) (the
-Loan Amount-), plus interest accruing at the lesser of (i)
twelve percent (12\) or (ii) the maximum interest rate that may
lawfully be paid by a redevelopment agency; provided that the
City agrees and aCknowledges that such Loan Amount shall be

paid only from (i) tax allocation revenues of the Project and
<:) (ii) such tax allocation revenues as may hereafter be generated
within the Potential Survey Area and received by the Agency.
The Agency shall have no obligation to make payment from any
other revenues.
2. The obligations of the Agency pursuant to Section
1 of this Agreement shall constitute the indebtedness of the
Project and such additional redevelopment project as may
hereafter include the Potential Survey Area. The obligation of
the Agency to make payments pursuant to this Agreement shall be
subordinate and subject to Section 33334.2 of the Health &
Safety Code and to the right of the Agency to pledge or commit
tax allocations from the Potential Survey Area to repay bonds
c:J or other indebtedness incurred by the Agency in carrying out
the Redevelopment Plan (and such redevelopment plan as may
hereafter become applicable to the Potential Survey Area). The
Agency agrees to file statements of indebtedness setting forth
such obligation until such time as the Loan Amount (together
with accrued interest) has been paid in full.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION
OF A LOAN AGREEMENT WITH THE COMMUNITY DEVLOPMENT
COMMISSION OF THE CITY OF SAN BERNARDINO
WHEREAS, pursuant to the Community Development Law of the
State of California, (Health & Safety Code Section 33000, et
seq.), the Redevelopment Agency of the City of San Bernardino
(the .Agency.) is carrying out the Redevelopment Plan for the
Southeast Industrial Park Redevelopment Project (the .Project
Area.); and
WHEREAS, the Agency is authorized to invest funds not
immediately necessary for the implementation of the
Redevlopment Plan; and
WHEREAS, the Agency and the City desire to study the
feasibility of the redevelopment of a potential redevelopment
survey area including the Norton Air Force Base and its
environs (the .potential Survey Area.); and
WHEREAS, the redevelopment of the Potential Survey Area
would address blighting influences within the vicinity of the
Project Area and would sUbstantially benefit the Project Area
and the community; and

WHEREAS, in order to effectuate the provisions of the
<:) Redevelopment Plan, the Agency proposes to loan and the City
proposes to borrow Three Hundred Thousand Dollars ($300,000.00)
pursuant to that "Loan Agreement", a copy of which is attached
hereto as Exhibit "A" and is incorporated herein by reference;
NOW THEREFORE, the City of San Bernardino hereby resolves
as follows:
Section 1:
The loan of funds pursuant to the Loan Agreement is in the
best interest of the City and will promote the pUblic health,
safety and welfare.

Section 2:
The Mayor is hereby authorized to execute the Loan
Agreement on behalf of the City.
