Synopsis of Previous Council action:
11-19-79 Planning Commission's recommendation for denial of
Tentative Tract No. IlllB rejected.
05-05-B2 Final Map for Tract No. IlllB approved.
OB-15-BB ---Finding made' that the encroachment of private facilities
in street right-of-way is in violation of City standards
and property owners directed to remove said encroachments.
11-07-BB -- Hearing to reconsider order to remove all encroachments
closed; directed that encroachments be reviewed to
determine if they constitute either a hazard or hindrance,
and continued to 12-19-BB.
Recommended motion:
That the report on encroachments in street right-of-way,
within Tract No. IlllB, be received and filed, and that
the matter be referred to the Legislative Review Com-
mittee for a recommendation.

STAFF REPORT
At the Council Meeting of November 7, 1988, the Mayor and
Council directed staff to review each individual encroachment
onto city property and indicate which is either a hindrance
or hazard and then to report back.
On Thursday, November 17, 1988, John Wilson and Henry Empeno
of the City Attorney's Office~ Mr. Roger G. Hardgrave -
Director of Public Works~ Anwar Wagdy, city Traffic Engineer~
and Gene R. Klatt, Assistant city Engineer, made a field
review of the subject properties.
None of the properties were considered to be a hazard to
traffic, the public or to safety. Therefore, all were found
to be a hindrance only. Given only the two choices, this is
the only response the group could find to make. All of the
encroachments appear to be done in a good workmanlike manner
and do not present an unsightly appearance. Sight lines and
distances were checked and compared with adopted standards
for safety with no infractions found.
Observation during the field review indicated a limited
amount of local traffic only and pedestrian traffic in the
roadway does not seem to be a hazardous condition.
It is recommended that this item be referred to the LegiSla-
tive Review Committee for further consideration and develop-
ment of a proposal on the disposition of these encroachments.

In a lette~ dated Decembe~ 8, 1988, Doug Cla~y,
Assistant Administ~ato~, St. Be~na~dine's Medical Cente~,
~equested authorization to file fo~ plan check of a p~oposed
parking st~uctu~e to be p~ocessed concu~~ently with a
~equi~ed conditional Use Pe~mit (C.U.P.). The ~equest is
made to avoid substantial delays on p~oviding seve~ely
needed community se~vices. (4)
Phil A~vizo, Executive Assistant to the Council,
explained that Vince Bautista, p~incipal Planne~, had stated
that the ~equested p~ocedu~e had been done in the past and
a waive~ has to be signed.
Council Member ~ille~ made a motion, seconded by Council
Membe~ Est~ada and unanimously ca~~ied, that a public
hea~ing be set fo~ Janua~y 3, 1989, at 19:99 a.m., fo~ the
pu~pose of discussing the request of St. Be~nardine's
Medical Cente~ fo~ concu~~ent p~ocessing of a building

MEYERS ROAD
In a memorandum dated Novembe~ 28, 1988, Roge~
Ha~dg~ave, Di~ecto~ of public wo~ks/City Enginee~, p~esented
a ~epo~t regarding whether o~ not ce~tain prope~ties on

Engineering Offices. He stated that none of the properties

Roger Hardgrave, Director of Public Works/City Engineer,
presented background information on the encroachment problem
on Meyers Road.

Bill Nilsson, 7035 Meyers Ct., stated that Mr.
a neighbor, was in contempt of Court, as he had not
his fence, and claimed it was a hazard.
Council Member Minor made a motion, seconded by Council
Member Maudsley and unanimously carried, that the report on
encroachments in street right-of-way, within Tract No.
11118, be received and filed, and that the matter be
referred to the Legislative Review Committee for a
recommendation.
Roger Hardgrave, Director of Bublic Works/City Engineer,
agreed to notify all interested parties of the time and
place of the Legislative Review Committee.
PUBLIC HEARING - CLOSURE OF TIPPECANOE & MILL
STREET - BOUNDARIES. OF BALLISTIC MISSILE
OPERATIONS COMPLEX
This is the time and place set for a public hearing to
consider the closure of portions of Tippecanoe Avenue, from
the south boundary of the Ballistic Missile Operation
Complex to Mill Street, and from the west boundary of the
Ballistic Missile Operations Complex to Tippecanoe Avenue.

Roger Hardgrave, Director of Public Works/City Engineer,
stated that Norton Air Force Base had requested the vacation
of portions of Tippecanoe Avenue and Mill Street adjacent to
the Ballistic Missile Operation (BMO), so it could be
included within the base perimeter. He advised them that
the City would be willing to consider this if the Air Force
would get funds to construct a permanent by-pass around
Norton Air Force Base for through traffic.
Mr. Hardgrave stated that the Air Force officials are
concerned about lack of security of the BMO, which is a
sensitive facility, being outside the base perimeter.
Mr. Hardgrave stated that notices regarding this hearing
were sent to abutting property owners, and a notice had been
published in the newspaper. He also stated there are
utilities in both streets, so the City would require a
guarantee that personnel would be allowed to do maintenance
work, as well as maintenance on traffic signals at
Tippecanoe and Mill.
