STAFF REPORT
Agreements have been entered into with the City of
Colton relative to maintenance of traffic signals at. Barton
Road and Waterman Avenue, and Rancho Avenue and Rialto Avenue.
These Agreements provided, in general, that San Bernardino
would be responsible for performing the necessary maintenance
work, and Colton would pay their proportionate share.
The proposed agreement supercedes all previous
contracts, and adds the new traffic signals at the following
intersections:
1. Hunts Lane at Redlands Boulevard
2. Hunts Lane at Caroline Street
3. Weir Road at Barton Road
This agreement was approved by the City of Colton on
1-17-89.
Approval of this agreement will expand a program, of
long duration, by including the traffic signals that have
recently been constructed.
We would recommend that the agreement be approved.

SECTION 1. The Mayor is hereby authorized and directed
to execute on behalf of said City a Master Agreement with the
City of Colton for Maintenance of Traffic Signals and
Intersection Lightingl which agreement is attached hereto marked
Exhibit "I", and incorporated herein by reference as fully as
though set forth at length.

MASTER AGREEMENT FOR MAINTENANCE
OF
TRAFFIC SIGNALS AND INTERSECTION LIGHTING
THIS MASTER AGREEMENT, MADE AND ENTERED IN THIS 17th
DAY OF Januarv. 1989, BY AND BETWEEN THE CITY OF SAN.
BERNARDINO AND THE CITY OF COLTON,
WITNESSETH
WHEREAS, certain traffic signals and highway lighting
facilities have been installed and are maintained at designated
intersections of both City's streets, and
WHEREAS, the Ci ty of San Bernardi no and the City of
Colton desire to set forth herein the particular maintenance
functions to be performed by each and to specify distribution
of costs of maintenance and operation between the two Cities,
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
1. Thi s Agreement appl i es to those i ntersecti ons
and facilities named or listed in Exhibit "A", attached hereto
and made a part hereof. Upon approva I by both parties hereto
as evidenced by approval of the City of Colton, City Engineer,
and the City Engineer of the City of San Bernardino signal
installation and/or intersection lighting facilities designated
for maintenance purposes may be deleted from or added to this
Agreement by submittal of a revised Exhibit "A" which shall,
upon said approval become a part of thi s Agreement and shan
supercede and cancel all previous exhibits.
2. The party responsible for the maintenance work
or provision of the services shall be as indicated in Exhibit
"A", except that utilHy owned intersection lighting win be
maintained by the utility owning the same.

1 3. The City of San Bernardino and the City of
2 Colton shall bill each other for the cost of services provided
3 and shall provide a summary of actual maintenance and power
4 costs of each intersection within their area of responsibility,
5 as set forth in Exhibit "A". The cost of maintenance referred
6 to herein shall include all direct costs, plus a 5% functional
7 and administrative overhead assessment to cover indirect costs
8 incurred in providing the maintenance services.
9 4. The share of costs for the operation and
10 maintenance of traffic signals shall be based on a ratio of the
11 number of legs of the intersection that lie within each
12.jurisdiction.
13 5. Where highway lighting, flashers, or other
14 electrically operated traffic controls or warning devices have
15 been specifically approved at an intersection, the maintenance
16 and power costs thereon shall be shared between the City of San
17 Bernardino and the City of Colton in the same manner as
18 provi ded for shari ng traffi c si gnal costs.
19 6. Routine ma i ntenance work to be performed under
20 this Agreement will include patrolling, furnishing of electric
21 energy, and furnishing necessary repairs and/or replacements as
22 required to insure satisfactory service. Installation of addi-
23 tional facilities is not a maintenance function under this
24 agreement.
25 7. The net amount (actual cost less reimbursements
26 or contributions by other parties) of extraordinary expenses,
27 such as for repair of extensive damage or replacement of
28 components of the signal installation, shall be assessed

1 directly against the particular intersection involved, and
2 shall be the shared expense of the City of Colton based upon
3 the aforementioned ratio for share of costs, and as shown on
4 Exhibit. "A". These expenses sha.ll be assess.ed regardless of
5 whether the actual damage occurred withi n an incorporated or
6 unincorporated area of the intersection. Invoices for said
7 costs shall be itemized as to materials, including service and
8 expense, sa 1 ari es and wages, and equi pment rental. The party
9 with jurisdiction over the location of any facility damaged by
10 others shall make every reasonable effort to recover the costs
from the party responsible for said damage to any
11 of damages

17 9. This Agreement shall remain in full force and
18 effect until terminated by either party following a sixty (60)
19 day written notice of intention to terminate.
20 10. IT I S MUTUALLY AGREED THAT:
21 (a) Nei ther the Ci ty of Col ton nor any
22 officer or employee thereof shall be responsible for any damage
23 or liability occurring by reason of anything done or omitted to
24 be done by the City of San Bernardino under or in connection
25 with any work, authority or jurisdiction not delegated to the
26 City of Colton under this Agreement. It is also agreed that,
27 pursuant to Government Code Section 895.4, the City of San

1 Bernardino shan fully indemnify and hold the City of Colton
2 harmless. from any liability imposed for injury (as defined by
3 Government Code Section 810.8) occurring by reason of anything
4 done or omitted to be done by the City of San Bernardino under
5 or in connection with any work, authority or jurisdiction not
6 delegated to the City of Colton under this Agreement.
7 (b) Neither the City of San Bernardino nor
8 any officer or employee thereof shall be responsible for any
9 damage .or 1 i abi 1 i ty occurri ng by reason of anythi ng done or
