STAFF REPORT
On September 6, 1988, this office was requested to acquire additional right-of-way at
the Southeast corner of Gilbert Street and Waterman Avenue to increase the radius of
the curb return to facilitate the turning radius of the City Busses.
As Waterman Avenue is a major street and is subject to some future Federal or State
funded program, it is necessary to follow the quidelines of the Uniform Relocation
Assistance and Real Property Acquisition Policies Act of 1970 in acquiring this right-
of-way. Therefore, this office has obtained the necessary Appraisal Report and has
taken all the necessary steps to this point.
Prior to making a firm purchase offer of just compensation to the Owner of the land,
it is necessa ry that your Honorab 1 e Body consi der the Appra iser's report and
valuations. If the City accepts the Appraiser's valuation, then a Resolution should
be adopted which amon9 other things, establishes just compensation (fair market
value) for the property. The attached Resolution serves as the basis for the City's
purchase offer to the Owner,
If the City does not agree with the Appraiser's determination of fair market value,
then we will hire a second Appraiser to re-appraise the land.
This office has reviewed the report submitted by Mr. Ralph Monge, the Appraiser, and
recommends that the report and the valuations contained therein be accepted and that
the proposed Resolution be adopted.
This Resolution will also authorize the payment of the stated amount for the land and
direct this office to proceed with the negotiations and to enter into escrow if
necessary.

RESOLUTION OF THE C!TY OF SAN BERNARDINO ACCEPTING
APPRAISER'S DETERM INATION OF FAIR MARKET VALUE OF A STREET
HIGHWAY EASEMENT AT THE SOUTHEAST CORNER OF GILBERT STREET
WATERMAN AVENUE, SAN BERNARDINO, CALIFORNIA. AND CERTIFYING
WORK OF THE APPRAISER.

WHEREAS, the City of San Bernardino is contemplating the
6 acquisition of a Street and Highway easement at the Southeast
7 corner of Gilbert Street and Waterman Avenue in the City of San
8 Bernardino; and
9 WHEREAS, NEWMAN and BARNETT, a Partnership is the owner of
10 the lot and parcel of real property from whi ch the easement is
11 to be acquired; and
12 WHEREAS, the City desires to now acquire the said Street
13 and Highway easement across said lot and parcel; and
14 WHEREAS, City has reviewed the Appraiser's determination
15 of the fair market value of the land and his report thereon;
16 and
17 WHEREAS, the City intends to acquire said easement with
18 Traffic System Fees,
19 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
20 COUNCIL OF THE CITY OF SAN BERNARDINO THAT:
21 SECTION 1.. That said Street and Highway easement across
22 said lot and parcel of real property owned by NEWMAN and
23 BARNETT, a Partnership. situated in the City of San Bernardino
24 t 14B5 No. Waterman Avenue is described as follows:

All that real property in the County of San Bernardino, State
of California, described as follows:
3 That portion of Lot I, Prado Verde Tract, as per plat thereof
recorded in Book 21 of Maps, page 3, records of the County
4 Recorder of said County, described as follows:
5 Commencing at the Northwest corner of said Lot 1; thence East
along the North line thereof, a distance of 2.75 feet to the
6 East line of Watermen Avenue as described in the document to
the Ci ty of San Bernardi no, recorded January 10, 1972 in Book
7 7832, page 187, Official Records of said County, and the True
Point of Beginning; thence East along said North line of Lot 1
8 and being the South line of Gilbert Street, a distance of 22.83
feet; thence Southwesterly in a straight line to a point on
9 the East line of said Waterman Avenue which is South thereon, a
distance of 22.83 feet from the True Point of Beginning;
10 thence North along said East line, to the True Point of
Beginning.

12 is. hereby determined, based upon the Appraiser's report
13 submi tted herewi th, to have a fair market val ue of $2,610.00
14 and said amount is hereby established as the fair market value
15 for said property.
16 SECTION 2. The City of San Bernardino does hereby certify
17 that the work of the Apprai ser wi th respect to the lot and
18 parcel of real property has been performed in a competent
19 manner in accordance with the applicable State law, the Act,
20 and Department of Housing and Urban Development policies and
21 requirements.
