RESOLUTION NO. 82-163
A RESOLUTION OF THE CITY OF SAN BERNARDINO APPOINTING A TIME AND
PLACE FOR HEARING OF PROTESTS TO THE PROPOSED ASSESSMENT DISTRICT KNOWN
AS " ASSESSMENT DISTRICT NO. 949". (MUSCOTT AND WALNUT STREETS)
WHEREAS, The Mayor and Common Council of the City of San Bernardino,
by Resolution No. 81-650 adopted December 21, 1981 has declared its intention
to order work in portions of Muscott Street, Walnut Street, Rialto Avenue,
Pico Avenue, Belleview Street and Congress Street by the construction of
sanitary sewer facilities, and to be known as "Assessment District No. 949";
and
WHEREAS, the public interest and convenience require and said contem-
plated work and improvement is of more than local or ordinary public benefit
and said Mayor and Common Council intend to make the expense of such work
and improvement chargeable upon a district, which district is declared to
be the district benefited by said proposed work and improvement, and to be
assessed to pay the cost and expense thereof; and
WHEREAS, pursuant to said Resolution of Intention and to Section
10203 of the Streets and Highways Code of the State of California, an
Engineer's Report has been filed with said Mayor and Common Council through
the City Clerk of said City, which report was accepted, by said Mayor and
Common Council at their meeting of April 19, 1982;
NOW THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
DO RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to Section 10301 of said Streets and
23 IIHighways Code, notice is hereby given that on June 7, 1982 at the hour of

San Bernardino, there shall be
a public hearing before
said Mayor and
26
Common Council for the purpose
of hearing protests, if
any, to the proposed
27
improvement, the extent of the
assessment district or
to the proposed
28
assessment.

1 SECTION 2. At said hearing, any interested person may object to
2 the proposed improvement, the extent of the assessment district, or to the
3 proposed assessment by filing a written protest with the City Clerk not
4 later than the hour hereinabove set for hearing.
5 SECTION 3. At said public hearing, all persons will be heard, and
6 for the purpose of determining a majority protest, any holder of title to
7 taxable real property within the boundaries of the proposed district may
8 file a protest in writing with the City Clerk not later than the hour
9 hereinabove set for hearing, containing a description of the property in
10 which each signer thereof is interested sufficient to identify the same.
11 and, if the signers are not shown on the last equalized assessment roll as
12 the owners of such property, must contain or be accompanied by written
13 evidence that such signers are the owners of such property. The basis for
34 determining the existence of a majority protest shall be based on the area
15 of the respective lot or parcel involved in proportion to the area of the
16 entire district.
SECTION 4. The City Clerk is authorized and directed to cause
17
18 a notice of the adoption of this resolution to be published in a newspaper of
19 general circulation published in the City and shall cause a notice of said
20 adoption to be posted and mailed pursuant to Sections 10302, 10304 and
10306 of the Streets and Highways Code of the State of California.

SECTION 5. The San Bernardino Sun, a daily newspaper published
22
and circulated in said City, is hereby designated as the newspaper in which
23
all notices and resolutions relating to said work and improvement, shall be
24
published.

SECTION 6, Reference is hereby made to said Resolution of Intention,
26
being Resolution No. 81-650 and to the Engineer's Report on file in the
27
office of the City Clerk of said City for further particulars.

regular meeting thereof, held on the 19th day
