PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE PROPOSED MAINTENANCE OF IMPROVE -

MENTS IN THE AREA OF 16TH AND MUSCOTT STREETS, CREATING AN ASSESSMENT DISTRICT
TO COVER THE COSTS OF SAID MAINTENANCE, KNOWN AS ASSESSMENT DISTRICT NO. 953,
4 ORDERING THE WORK AND THAT THE SPECIAL ASSESSMENT, INVESTIGATION AND LIMITATIO'
ACT OF 1931 SHALL NOT APPLY.

6 WHEREAS, the Mayor and Common Council of the City of San Bernardino
have preliminarily found that the public interest, convenience, and necessity

8 require the maintenance of landscaping in a portion of the City, as more
fully hereinafter described, and the appurtenances and appurtenant work and
9
incidental costs and expenses in connection therewith, that the project is

feasible, and that the lands to be assessed will be able to carry the burden
11
of the proposed assessments to pay the costs and expenses thereof; and
12
WHEREAS, the Mayor and Common Council of the City of San Bernardino
13
have, on the 15th of March, 1982, passed and adopted Resolution No. 82-120
14
entitled:

16 THAT PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE FORMATION OF A
LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT: DECLARING ITS INTENTION
17 TO PROCEED TO ORDER WORK WITHIN THE DISTRICT, TO BE KNOWN AS ASSESS-
MENT DISTRICT NO. 953 AND SETTING AND DIRECTING PUBLICATION OF NOTICE
18 OF A TIME AND DATE OF A PUBLIC HEARING.
19 which said resolution duly and legally was published and notice of improvement
20 has been given in the manner required by Ordinance No. 3963; and written
21 objections and protests to the formation of the proposed district, the work
22 to be done or the extent of the district to be assessed were heard and consid-
23 ered.
24 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
25 CITY OF SAN BERNARDINO AS FOLLOWS:
26 SECTION 1. That a full and fair public hearing having been held, as
27 stated in the recitals herein, and the Mayor and Common Council, having heard
28 and considered any and all comments received thereon and being fully advised

I in the premises, hereby overrules any and all protests received.
2 SECTION 2. That the public convenience and necessity require, and
3 the Mayor and Common Council of the City of San Bernardino hereby declares by.
4 not less than 6/7ths vote that the public interest, convenience and necessity
5 requires and hereby orders, the formation of Assessment District No. 953; the
6 work described in said Resolution No. 82-120 to be done in portions of 16th
7 Street between Muscott Street and California Street as provided in said Reso-
8 lution and that the Special Assessment, Investigation and Limitation Act of
q 1931 shall not apply.
10 SECTION 3. The City Clerk hereby is directed to past a Notice for
11 five days on or near the door of the Council Chambers of the City Hall invit-
12 ing sealed proposals or bids for doing the work ordered and referring to the
13 specifications on file and to publish a Notice Inviting such proposals for at
14 least two days in the San Bernardino Sun, a newspaper published and circulated
15 in said City.
16 SECTION 4. The contract will be awarded pursuant to the standard
17 procedures used by the City in the award of Public Works contracts and the
18 work ordered hereunder shall be to the satisfaction of the City Engineer of
19 said City, and all of said work shall be done under his direction and shall
20 comply with the specifications prepared by him, and upon the completion of
21 said work, the City Engineer shall, and he hereby is directed to make the
22 assessment.
23 SECTION 5. Reference hereby is made to said Resolution No. 82-120
24 for a description of the work, the extent of the assessment district, the
25 financing alternatives and for further particulars.
26 SECTION 6. The City Clerk of the City of San Bernardino shall cause
27 a certified copy of this resolution to be recorded in the office of the County
Recorder of the County of San Bernardino.

I HEREBY CERTIFY that the foregoing resolution was duly adopted

3 recxular meeting thereof, held on the 19th day
