RESOLUTION OF THE CITY OF SAN BERNARDINO SOLICITING RELIEF
FROM CERTAIN PUBLIC UTILITIES' ENERGY POLICIES.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
4
SAN BERNARDINO AS FOLLOWS:

SECTION 1. Recitals.
6
(a) The rates for street lighting charged by utilities
7
governed by the California Public Utilities Commission do not
8
reflect the actual energy used by the street lights.
9
(b) Local agencies are discouraged from acquiring the
10
components of the utility -owned street light system because
11
procedures for acquisition of the components are vague and
12
unnecessarily cumbersome.
13
(c) Joint -tenancy of utility poles has been discouraged or
14
conditioned in such a manner as to be unfeasible.
15
(d) Utilities' rate structure adjusted and approved by the
16
Commission from time to time included provisions for the
17
amortization of utilities' installation and replacement costs of
18
street lighting facilities.
19
(e) Utilities' method of evaluating its street lighting
20
facilities (Reproduction Cost New Less Depreciation) does not
21
reflect the actual saleable worth of these facilities.
22
(f) Utilities require local public agencies to purchase
23
street lighting facilities which were previously installed by
24
property owners and developers and then dedicated at no cost to
25 the utilities.
26 (g) Utilities do not allow energy -conserving means of

SECTION 2. Implementation. The California Public Utilities
2 ( is requested to consider, amend and adopt regulations
3 igoverning and regulating street lighting which would provide as
4
follows:
5
(a) Rates charged for street
lighting reflect the actual
6
energy used by the lights; and
7
(b) procedures for acquiring
components of the utilities'
8
street lighting system be stated in
a clear and precise manner;
9
and
10
(c) utilities be required, if
requested by a local public
11
agency, to allow joint use of their
utility pole system, without
12
charge, to install street light fixtures
owned and maintained by
13
the local public agency; and
14
(d) the method utilized by utilities
for valuating street
15
lighting facilities to be purchased
by public entities be based on
16
actual cost of the facilities when
installed less depreciation and
17 11any other amounts recovered through utility rate charges, not to
18 11exceed salvage value; and
19 (e) utilities be required, if requested by a local public
20 agency, to transfer to the agency, without charge, any street
21 lighting facility which utilities acquired from property owners
22 and developers at no cost to the utility; and
23 (f) utilities be directed to utilize any and all forms of
24 energy-efficient, economical street lighting including but not
25 limited to both high and low pressure sodium vapor street lights,
26 when requested to do so by a public entity.
27 SECTION 3. The City Clerk is hereby directed to transmit a
28 copy of this resolution to the following individuals and
