HomeMy WebLinkAbout1982-1561 RESOLUTION NO. 82-156 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE STATE OF CALIFORNIA DEPARTMENT 3 OF TRANSPORTATION FOR THE DISPOSAL OF ANIMAL CARCASSES FROM STATE HIGHWAYS IN THE SAN BERNARDINO AREA. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 5 SAN BERNARDINO AS FOLLOWS: 6 I) SECTION 1. City shall take possession of animal carcasses removed by State forces from the State highways. Either party may terminate this contract by giving 30 days' written notice to the other party. It is mutually understood between the parties that there are sufficient funds for the purposes of this contract during the current fiscal year. Further, it is mutually agreed that the remaining portion of this contract is valid and enforceable only if sufficient funds are made available by the Budget Act of 1982, for the fiscal year 1982-83 (July 1, 1982 through June 30, 1983). Contract No. B-8644 Contract Sheet 3 of 3 CONTRACT PROVISIONS :+orker's Compensation Pursuant to the requirements of Section 1860 of the Labor Code (Chanter 1000, Statutes of 1965), the Contractor will be required to secure the payment of worker's compensation to his employees in accordance with the provisions of Section 3700 of the Labor Code. Prior to the commencement of work, the Contractor shall sign and file with the Mate representative a certification in the following form: "I am aware of the provisions of Section 3700 of the Labor Code which require every employer to be insured against liability for worker's compensation or to undertake self-insurance in accordance with the provisions of that code, and I will comply with such provisions before commencing the performance of the work of this contract." Said certification is included in the contract, and signature and return of the contract shall constitute signing and filing of the said certificate. Equivalent Materials For convenience in designation in these Contract Provisions, certain articles or materials to be incorporated in the work may be designated under a trade name or the name of a manufacturer and his catalogue information. The use of an alternative article or material which is of equal quality and of the required cnaracteristics for the purpose intended will be permitted, subject to the following requirements: The burden of proof as to the quality and suitability of alternatives shall be upon the Contractor and he shall furnish all information necessary as required by the State representative. The State represen- tative shall be the sole judge as to the quality and suitability of alternative articles or materials and his decision shall be final. Whenever the specifications permit the substitution of a similar or equivalent material or article, no tests or action relating to the approval of such substitute material will be made until the request for substitution is made in writing by the Contractor accompanied by complete data as to the quality of the material or article proposed. Such request shall be made in ample time to permit approval without delaying the work, but need not be made in less than 35 days after award of the contract.
