HomeMy WebLinkAbout2800 r-. 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 I I r 1 REOOIDTION NO. .2fOO 2 A RESOLUTION OF THE MAYOR AND C<loIMON COINCIL OF THE CITY OF SAN BERNARDINO PROPOSING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY HERE- 3 AFT~ DESIGNATED AS THE 67TH ANNEXATIctl DISTRICT OF THE CITY OF SAN BERNAR- DINO. 4 5 WHEREAS, and heretofore, there has been presented to the Mayor and 6 Common Council of the City of San Bernardino a written petition containing a 7 description of certain territory which is hereinafter more specifically descri- bed, and said petition requested that said territory be annexed to and included in the City of San Bernardino in accordance with the provisions of the "Annex- ation of Uninhabited Territory Act of 1939" as contained in the Government Code, Section 35300, et seq., and WHEREAS, each and all of the owners of all of tho aforesaid real property and each and every parcel contained therein, in consideration of the City Council approving the proposed annexation, has consented in writing and filed with the City Clerk of the City of San Bernardino, who acts as Clerk for said City Council, their consent and agreement that all of tho property included shall be taxed equally with the other property within the said City to pay the bonded indebtedness and any and all general indebt.edness and lia- bility at the time of the aforesaid proposed annexation of tho aforesaid property as provided in said Act; ani WHEREAS, the Council has made a complete investigation and report in reference thereto; 23 24 25 NOW, THEREFORE, BE, AND IT IS HEREBY RESOLVED BY TIlE MAYOR AND C<JO{ON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLI..<YtlS: SECTICti ONE: That a written petition containing a description of 26 certain uninhabited territory, hereinafter more specifically described, has been presented to the City Council of the City of San Bernardino. SECTIll'l TIIO: That said petition contains a description of the un- 27 28 29 inhabited territory sought to be included in the City of San Bernardino, and 30 that a petition is signed by the owners of .not less than one-fourth of the 31 assessed value of said territory according to the last preceding equalized 32 assessment roll of the County of San Bernardino, in which said County the City ,. -1- -", ... I II I, , ! : i, 'I 1 I: of San Bernardino is situated. , l~ I I 2 SECTION THREE: That each and all of the owners of all of the afore- 3 said real property and of each and every parcel contained tnerein, in consider- 4 ation of the City Council approving the proposed annexation, has consented in 5 writing and filed with the City Clerk for said City Council their consent and 6 agreement that all of the property included in the aforesaid territory shall 7 be taxed equally with the other property within the said City of San Bernardino 8 to pay the bonded indebtedness and any and all general indebtedness and liabili- 9 ty of the City of San Bernardino contracted prior to or existing or outstanding 10 at the time of the aforesaid proposed annexation of the aforesaid property as 11 provided in said Act. 12 SECTION FOUR: That notice is, therefore, hereby given of the proposed 13 annexation to the City of San Bernardino of the lininhabited territory contiguous 14 15 16 to the City of San Bernardino, the boundaries of which are particularly des- cribed as follows, to wit: Beginning at the Southwest corner of Lot 8, H.H. Linville Su~ division, records of the County Recorder, San Bernardino County, California, as recorded in Book 8 of Maps, at Page 47; thence Northerly along the West line of Lots 8, 7, 6 and 5, said H.H. Linville Subdivision and the West line of the South one-half of Lot 6, Block 58, Rancho San Bernardino, records of the County Recorder, San Bernardino County, California, as recorded in Book 7 of Maps, at Pag.$ 2, to the Northwest corner of the South one-half of Lot 6, Block 58, Rancho San Bernardino; . thence Easterly along the North line of the South one-half of said Lot 6 to the Northeast corner said South one-half said Lot 6; thence Southerly along the East line of Lot 6, Block 58, Rancho San Bernardino and the East line of H. H. Linville Subdivision to a point said point being 198 feet more or less South from the North East corner of Lot 2, H.H. Linville Subdivision, also said point being the present Corporate City Limits; thence Westerly along the present Corporate City Limits line to the East line of Pennsylvania Avenue 82.50 feet wide, dedicated as Olive street as shown on map of said H. H. Linville Sllbdivision as recorded in Book 8 of Maps, at page 47 , records of the County Recorder of San Bernardino County; thence South- erly along the East line of said Pennsylvania Avenue being along the present Corporate Limits to the Southwest corner of said Lot 2, of H.H. Linville Subdivision; thence Westerly along the present Corporate City timits line to a point said point being 323 feet West of the West line of Pennsylvania Avenue; thence Southerly and parallel with the West line of Pennsylvania Avenue along the present Corporate City Limits to the North line of Base Line Street; thence Westerly along the North line of Base Line Street to the point of beginning. That the aforesaid uninhabited territory included in the proposed annexation shall hereafter be generally kno\ffi and identified as Annexation District No. 67. SECTION FIVE: That upon the completion of said annexation of said territory, that all of the property included in said Annexation District No. 67 shall be taxed equally with the other property within the City of San Bernardino to pay the bonded indebtedness and any and all general indebted- ness of the City of San Bernardino contracted prior to or existing or out- standing at the time of the aforesaid proposed annexation of said described property as provided in said Act. SECTION SIX: That the 21ilt day of September, 1953, at the hour of seven-thirty 0 I clock P.M., in the Council Chambers in the City Hall, in the City of San Bernardino, is the day, hour and place herein designated when and where any person owning real property within such territory. 50 proposed to be annexed and having any objections to the proposed annexation may appear before the City Council and show cause why such territory should not be annexed; and further, that at aD;Y time not later than the hour set for hearing objection to the proposed annexation, any owner of property within the terri- tory proposed to be annexed may file a written protest against such proposed annexation. Such protest shall state the name or names of the owner or owners of the property affected hereby and the description and area of such property in general terms. SECTION SEVEN: That the San Bernardino Evening Telegram, a news- paper of general circulation in the City of San Bernardino, and the Colton Courier, a newspaper of general circulation published in the County of San Bernardino, are hereby designated as the newspapers in which this Resolution shall be published by the City Clerk in the manner, form and time provided by law..
