RESOLVED, that the public lntereat and conven1ence require, and that 1t 1s the intention of the Mayor and Common Counc11 of the City of San Bernard1no to order that Mt V1ew Avenue, 1n sa1d C1ty, be 1mproved 1n the follow1ng manner, to wit: (a) That cement concrete curb and gutter (!~pe IBI) shall be constructed upon port1ons of both s1des of Mt V1ew Avenue between the North property 11ne of Mill Street and the South curb 11ne of Cluster Street. (b) That a b1tum1nous plant-m1xed surfac1ng two and one-half (2 1/2) 1nches 1n th1ckness shall be oonstructed upon a portion of the roadway of Mt V1ew Avenue, between the North property 11ne of M11l Street and the South property 11ne of Cluster Street. Reference 1e hereby made to Plans, Prof1les and Detailed Draw1ngs No. 2014, on f11e 1n the off1ce of the City Eng1neer of said C1ty, and to Spec1f1catlons No. 2014, on fne 1n the office of the City Clel"k)- of sa1d C1ty, for a', full and deta1led description of the said propos.. work and improvement, the part1cular 10oat1ons thereof, and the11a.. '</.':">", upon which, and grades to wh1oh, 1t shall be done; prov1ded 1;hat itber.,;;;~&;; , ..,.> 11nes or grades therefor, or for any port1on thereof, are not shown by, or set forth up~n, such Plans, Prof1les and Deta1led Draw1ngs, sa1d proposed work and improvement shall be done upon the off1clal 11nes and to the off1clal grades therefor. RESOLVED FURTHER, that said contemplated work and 1mprovement 1s of more than local or ord1nary pub11c benefit, and that sa1d Mayor and Common Counc11 do hereby make the expenae of such work and 1mprovement ,. -~., chargeable upon a district. which district is hereby declared to be the district benetited by said proposed work and improvement, and to be assessed to pay the cost and expense thereot, and which district embraces all that real property situate in the City ot San Bernardino, County at San Bernardino, State ot California. lying within the tollowing described exterior boundaries thereot, to wit: Beginning ~t the Southwest corner at Lot 28, Block B, McIn~oshls Little Farms, as per plat thereof recorded in Book 23 at Maps, at Page 53, records ot the County Recorder ot San Bernardino County: thence Northerly along the West line ot Lots 28 through 54 and said West line, said Lots, extended North to the center line ot Cluster Street: thence Easterly along the center line ot Cluster Street to a point. said point being the East line of Lot 4, Tract No. 3857, extended North, as per plat thereof recorded in Book lt9 at Maps, at Page 98, records of the County Recorder ot San Bernardino County: thence Southerly along said East line and East line at Lot 4 extended North to the Southeast corner of Lot 13, said Tract No. 3857: thence Westerly along the South line ot Lot 13, 'ract No. 3857. to the Northeast corner ot Lot 14, said Tract No. 3857: thence Southerly and parallel to the East line of Mt. View Avenue to the Southeast corner ot Lot 39. said Tract No. 3857: thence West.rly along~South line at Lot 39. said Tract No. 3857, to the East line of Mt View Avenue; thence Southerly along said East line of Mt View Avenue and East line at Mt View Avenue extended South to the center line of Mill Street: thence Westerly along center line of Mill Street to a point, said point being the East line ot Lots 28 through 54, McIntosh's Little Farms extended South; thence Northerly along said East line to the point at beginning. RESOLVED FURTHER. that serial bonds extending over a period ot n1ne years from the secon~ day ot January next succeeding the fitteenth day of the next October following their date and bearing interest at the rate ot six per cent per annum, payable semi-annually. shall be issued as provided by the Improvement Act ot 1911 to represent assessments at Twenty-five Dollars or over tor the cost ot said proposed work and improvement, remaining unpaid tot- thirty days atter the date ot the warrant. RESOLVED FURTHER. that all ot the owners of more than sixty (60) per cent in area of the property subject to assessment for said iaprovement have signed and filed with the City Clerk a written petition ror said improvement and work, and waiver ot the 'Special Assessment Investigation, Limitation and Majority Protest Act of 1931' and amend- ments thereto. ,. <, ,I ~ 11 RESOLVED FUR!HER, that the Street Superlntendent of said Clty hereby ls dlrected to deduct the amount of $8,674.00 from the total cost and expenses of the work, before spreadlng the assessment, which amount shall be pald to the contractor, or his ass1gns upon the issuance of the warrant to him, from the Tralt Fund of sald Clty. BESOLVED FURTHER, that The San Bernardino Evenlng Telegram, a daily newspaper published and circulated in said Clty, ls hereby designated as the newspaper in which this Resolution of Intentlon, and all further notlces and resolutions relatlng to sald work and improve- ment, shall be published. RESOLVED FURTHER, that notice ls hereby given that any and all persone havlng any obJectlons to sald proposed work and 18provement may appear before sald Kayor aBd Common Council on the 17th day of August, 1953, at the hour of 7:30 o'clock P.M., at the Councll Chamber, ln the City Hall, ln said City, and show cause whf sald proposed work and lmprovement should not be carrled out in accordance with this Resolutlon.
