Recommended motion:
1. That the Director of Public Works/City Engineer and the City
Clerk be authorized to proceed with the proposed vacation of
a public utility easement located between Cluster Avenue and
Mill Street and between Arrowhead Avenue and Pershing Avenue.

STAFF REPORT
A request was received to vacate a public utility
easement located between Cluster Avenue and Mill Street and
between Arrowhead Avenue and Pershing Avenue, from an adjoin-
ing property owner. This request represents one of the owners
who adjoin the public utility easement. The petitioner has
deposited the required $200.00, which represents one-half of
the total fee of $400.00. The remaining $200.00 will be due
after the investigative proceedings.
A Grant of Easement was recorded on March 3, 1925,
which created the easement, a 10' strip which runs North and
South between Cluster Avenue and Mill Street, for the con-
struction and maintenance of telephone poles and lines,
electrical poles and lines, gas pipes, sewers, and water lines.
The petitioner states that no surface utility
facilities are present, and that he has contacted the various
City utility companies and says there are no underground
utili ties. Apparently, these services have historically been
provided from either Arrowhead Avenue or Pershing Avenue.
Also, development has routinely occurred over the easement and,
in addition, North of Mill Street, several of the original lots
have been re-parcelized, so that the boundaries which previous-
ly served as the centerline of the easement no longer exist.
Since it appears that this easement is no longer
necessary for public use, we, therefore, recommend that the
Director of Public Works/City Engineer and the City Clerk be
authorized and directed to proceed with the proposed vacation.
Utili ty companies, affected City Departments, outside
agencies, and abutting residents will be notified during the
proceedings and afforded an opportunity to provide comments.
