Dept: Date: Synopsis of Previous Council action: The conversion from the self-insured John Hancock Health Plan to the PERS Basic Health Plans was approved by the Mayor and Common Council at their meeting on November 21, 1988. At your January 3, 1989 meeting you adopted a resolution covering Councilmembers and Water Board Commissioners who are members of the PERS retirement system. DescriPtion) Finance: Council Notes: 75.0262 Agenda Item No 33 :e;ITY OF SAN Bl!RNJCDINO - REQU8ST PO COUNCIL ACTION STAFF REPORT In November, 1988, the Council adopted a series of resolutions making full-time city employees eligible to enroll in PERS Basic Health Plans. In December, Ms. Diana Davies, Public Agency Coordinator for PERS' Health Benefits Division, advised city staff that an additional resolution needed to be adopted to permit part-time elected Councilmembers and Water Board members to be eligible to enroll in the PERS Basic Health Plans. On January 3, 1989, the Council adopted such a resolution, however, Ms. Davies has since advised staff that the resolution only covers Councilmembers and Water Board members who are PERS retirement system members. since not all Councilmembers are PERS retirement system members and Water Board members are not eligible to be retirement system members, the attached resolution must be adopted for those people to be eligible to enroll in the PERS Basic Health Plans. RESOLUTION ELECTING TO BE SUBJECT TO PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL CARE ACT ONLY WITH RESPECT TO MEMBERS OF A SPECIFIC EMPLOYEE ORGANIZATION. WHEREAS, Government Code Section 22850.3 provides that a contracting agency may elect upon proper application to participate under the Public Employees' Medical and Hospital Icare Act with respect to a recognized employee group only; I.. and WHEREAS, Government Code Section 22754 (g) defines any Special District as a contracting agency, and WHEREAS, a Special District is hereby defined as a non- profit, self-governed public agency within the State of California, and comprised solely of public employees performing a governmental rather than proprietary function, and WHEREAS, City of San Bernardino , hereinafter referred to as Special District is an entity meeting the above definition; and WHEREAS, The Special District desires to obtain for its employees and annuitants the benefit of the Act and to accept the liabilities and obligations of an employer under the Act and Regulations; and WHEREAS, The Special District desires to obtain for its ELECTED OFFICIALS AND BOARD MEMBERS, who are employees and (CONTINUED) Page 1 ~ . . 1 2 3 4 S 6 7 8 9 10 11 12 13 14 IS 16 17 18 19 W 21 ~ ~ ~ 2S 26 27 28 '""' , - ~ annuitants of the agency, the benefit of the Act and to accept the liabilities and obligations of an employer under the Act and Regulationsl now, therefore, be it RESOLVED, That the Special District elect, and it does hereby elect, to be subject to the provisions of the Actl and be it further RESOLVED, That the employer's contribution for each employee who is a member of, and each annuitant who retired from employment which would be covered by the above identi fied recognized employee organization enrolled in PERS health benefits plan shall be as follows: WSixteen dollars towards the enrollment of each employee and annuitant including family members.w And that the contribution shall be in addition to those amounts contributed by the Special District for administra tive fees and to the Contingency Fund, and be it further RESOLVED, that the executive body appoint and direct, it does hereby appoint and direct, DIRECTOR OF PERSONNEL o file with the Board of Administration of the Public mployees' Retirement System a verified copy of this Resolu ion, and to perform on behalf of said Public Agency all unctions required of it under the Act and Regulations of the oard of Administrationl and be it further RESOLVED, that coverage under the Act be effective on .
